Roads are required to meet the minimum Mason County Fire Marshal standards for Fire Apparatus Access Roads up to the point where su r JZnect with a county maintained public road or to another fire apparatus access road which connects to a county maintained public road. X 2) C ractor registration laws are governed under RCW 18.27 and enforced by the WA State Dept of Labor and Industries, Contractor Compliance Division. The portico is on the front of the house,the covered patio is on the back. We got the engineering done for the patio cover, but when we tried to get the permit, we were told we couldn't get one until we also had engineering done for the portico. We approached several engineers. MC Squared currently has the portico project, but they have not worked on the project since they received it last June. Please see letter attached. Why do we need to have the portico engineered in order to get a permit for the patio cover? They are two separate additions and neither is related to the other. If they were separate, then we could get on with the patio cover retrofit because the engineering was done for that a year ago. My father is 98 years old and we are going to be in California with him until March 20th. Hopefully we will hear from MC Squared about the portico when we return. When I have some response from them we will certainly let you know the results. If we could split the projects we might be able to finish the one in question. By the way, the cover is completely freestanding and is built over a concrete driveway/patio,not over a "deck'. Sincerely, Judy and Bill Ross P.S. Let me explain why we are asking.When we first moved to Mason County we bought property that included an existing ten year old three-car garage and a large manufactured home.The house front faces south on an open hill with no trees blocking our view(we are not on the water, but we can see it in the distance).Without a front porch cover, during every rainstorm our entry hall would flood.Therefore, because there was already a 16 foot wide gable on the front, we determined that a 16 foot wide by 12 foot deep portico would be sufficient to protect the entry. We have only a small concrete patio in front and two steps up to the house under the portico, but no actual porch. Although Bill is an engineer,we were lucky that some friends provided us with engineered plans for their portico (built in Grays County on their manufactured home)to use for our project. We took the plans down to your office in Shelton to get a permit. We mentioned to the person at the front desk that we had a manufactured home.The person we spoke to (5 years ago)told us that any structure we added to our manufactured home had to be permitted and inspected by Labor and Industries(L&I)and that we should get the permit from them. She then gave us instructions on how to find L&I. So we went to L&I in Bremerton, had them review and approve the plans,got our permit, built the portico and had it inspected by L&I according to their requirements. L&I's main requirement was that the structure be self-supporting and free standing. Because they didn't have any details about the support structure of the house and we couldn't provide any,they did not want the portico to be permanently attached to or supported by the house framework nor did they want it affixed in such a manner that it could not be easily removed (think MOBILE home although our house is triple-wide, 2400 sq.ft. and will never be moved). Specifically,that meant that where the portico met the gable/roof of the house, it had to be screwed, not nailed, into the gable.We did that per their requirement. We also set the supports in concrete according to their standards. L&I did not require increasing the size of the bolts we planned to use. The L&I inspector came out,did his inspection, double-checked that we'd used screws to adhere the portico to the house,etc.,and told us we had done an exceptional job.Then we put the decorative sheathing on the posts, had the new roof put on to blend the portico to the house, had the house painted and went on to the next project. Imagine our surprise when your Mason County inspector("TR" —he would not give us his first or last name)just drove up one day and insisted that we had to remove the portico because we "didn't get a permit to build it," especially when we had done so exactly per your permit staffs instructions. We had gone to L&I. The first question we would like answered is, "Why do we need a permit from Mason County if we got the permit from L&I and did everything they required by the book?" A second question is, "Why did the person in your office that we spoke to personally for advice,tell us to go to L&I if we really had to get the permits from Mason county?" In a previous visit to your office we brought the L&I paperwork to show that we did as required through L&I, but we didn't think to ask these questions at that time. Also,we are very curious about why we need a permit for the patio cover. Our garage is about 20 feet from the house and as you know when it is raining it is nice to have a covered area so you can walk from the garage to the house. When it is hot here in the summer, since most of the trees were removed when the property was leveled,the shade from the patio cover keeps the concert patio cool. An additional benefit is that the laundry room does not flood when rain comes down from the north, like it did before the cover was built, because this house has neither deep eves nor any other protection over the back porch or the patio sliding door. By the way,there was also a concern (which we do understand)about the location of the septic system relative to these structures and we have already brought to Mason County the paperwork necessary to show that the structures are not close to, and do not interfere with,the septic system in any way. When asking about the patio cover, L&I told us that as long as it was NOT attached to the house,they had no objection to us building it. Per their requirement,this patio cover is completely freestanding. After all, it is not a building and we don't store anything under it nor do we reside in it.We most frequently WALK beneath it, and we also occasionally sit under it, but NOT when it is snowing.There is some concern (we suppose from Mason County)that should we get two feet of snow;the weight might cause some of the structure to sag or collapse because of the span. We doubt that is a problem as we have observed firsthand how sturdy the structure really is. Note that we were here last winter in December and January when we had about two feet of snow, but the patio cover structure held up just fine under the weight. In fact, it did not show any signs of sagging or giving way.We monitored it closely. Because of Mason County's concern,we eventually climbed up on the cover and scraped off the snow, but the snow had stopped falling by then. Anyway,we have since discovered that the engineers at MC Squared, who worked on the retrofit design for the patio cover and charged us$850 for their hours,were inexperienced.After reviewing their "solution" we agree they did a rushed, inadequate job.One of the two "engineers"admitted to us that she was just out of college and had never done a project like this before.They both were fired. Therefore we are suspect of their work and feel their solution to"strengthening the structure" is beyond over-kill, unsightly,too expensive and is poorly designed. So,we want to revisit their"solution." Although we would like to know why Mason County is even concerned about our patio cover since it is independent of the structures of both the house and the garage,we do understand about the portico, since it is attached to the house with screws and if it came down it could cause damage to our entry. But what we don't understand is a Mason County employee sending us to L&I for permits and inspection,then Mason County inspector"TR" coming by,out of the blue and after the fact, and telling us that we should have gotten a permit from Mason County,when that is what we attempted to do before starting construction. Although it is more attractive, our observation is that our patio cover is not much different than any of these 20X20 ft.freestanding metal or fabric carports that we see all over Mason County. Now, if one of them collapses under the snow, what is Mason County's responsibility for that collapse? Does that apply to our type of structure, as well,which is firmly planted in concrete and is much better built?Are permits required for installing one of these metal or fabric structures? We might look into getting one or more of these other structures for our property; however,we don't want to run into any problems with Mason County so we thought we had better ask. With our existing patio cover structure, is it possible to sign a waiver both with the County and with our insurance company and not modify the structure at all? We are confident it will not collapse. Scraping snow off is no big deal. Even though we've already spent a lot of money and probably will spend more on the engineering review,we would prefer getting your advice before we move along. What are the alternatives? Is this merely to assess us more taxes? We are already paying over$3000 per year. We are retired and live on a fixed income.We spend some of our time outside of Washington State caring for elderly parents(85 years old and almost 99 years old)and are therefore not at this time able to easily or quickly comply with the modifications suggested by MC Squared for this patio cover. After an assessment of their"design," we find that it will cost more to"modify it"than it did to build it. We are willing to upgrade to slightly larger bolts for the portico. It was just a shock to have to spend $500 for engineering of a design that had already been engineered. However,we believe that MC SMJvrad had tc;.id om. : ½7 t.-c-range, and this is what they finally came up with to justify their fee. Personally,we consider this"modification" to be unnecessary or L&I would have insisted on it. We would appreciate your insight via written answers to these questions and observations.Also,we could use any other information you can provide that will help us resolve this satisfactorily. Why are these permits necessary from Mason County and Labor&Industries? Permits for your structures are required under the International Building Code,(IBC). The construction at your residence does not fall under the exempt section of chapter 1 in the code nor is it factory assembled that would require it be governed by L&I (labor& industries). L&I is only concerned with the attachment of any additional structures to their factory assembled units. They look at the attachment to see if it has imposed any load to the structure.All other components of the additional structures are governed, reviewed,permitted&inspected by your local jurisdiction. In many cases permits are required from both agencies and are always required from both when a load has been placed on the factory assembled unit. I am sure if you read the permit you received from L&I you will see no requirements placed on the construction of the additional structures other than the attachment. #2. Why did the person in our office instruct you to go to L&I? This would have been for the"alteration permit"only. This would have been required if your structures rested and were dependant on the factory assembled unit for support. Also L&I should have been clear on what the requirements from their department were. It sounds like from your letter they may have made you believe that they were permitting the secondary structures. The free standing metal carports you are referring to also require a building permit. if you would like to go over what is exempt from permit i would be more than happy to talk to you about it. We were finally able to engage an engineering firm to review our portico design. MC Squared,who was the only firm who agreed to take the job, determined that all we need to do is to add six slightly larger bolts. Otherwise,the structure is sound as designed and constructed. Please tell Michael Luke this. Now we want to have the engineering reviewed for the patio cover, because we were informed by the owner of MC Squared that the two engineers who completed our original design were fired. Since the patio cover survived the snow storm last winter without difficulty,we suspect that their calculations are incorrect.We are in their queue for review and would like to get that done before spending any more time or money on retrofitting our patio cover, because MC Squared's design is so poor. We are leaving Friday,September 25, for Wyoming to care for Bill's mother who is having hip surgery and we do not expect to return to Washington until the end of the year.You asked to be kept informed of our progress on this matter, so I wanted to give you a status report.
