A RESOLUTION VACATING CERTAIN MASON COUNTY ROADS, NAMELY: THE ALLEY BETWEEN LOTS 5, 6 and 7, 8 IN BLOCK 10, AND THE ALLEY BETWEEN LOTS 1, 2 and 3, 4 IN BLOCK 13, AND THE ALLEY BETWEEN LOTS 3, 4 and 5, 6 IN BLOCK 13, ALL IN THE PLAT OF ARCADIA AS SHOWN IN VOLUME 1 OF PLATS, PAGE 6 OF THE PLAT BOOK OF THE AUDITOR, MASON COUNTY, WASHINGTON; SAID ALLEYS NOTED ABOVE WILL HEREINAFTER BE REFERRED TO AS THE ALLEYS (SEE ATTACHED MAP). WHEREAS, RCW chapter 36.87 provides for vacation of county roads, and, WHEREAS, the adjacent property to the ALLEYS herein is owned by the Port of Shelton, which has consented to this vacation, and, WHEREAS, said ALLEYS are useless as a part of the county road system and the public would benefit from this vacation as the Port of Shelton property would then be capable of being used for its maximum efficiency and best use. NOW, THEREFORE, BE IT RESOLVED that the ALLEYS are hereby vacated by order of law as of this date, PROVIDED HOWEVER, that pursuant to RCW 36.87.100-110, as a condition precident to said vacation, the Port of Shelton shall enter into an agreement providing that in the event that the property in Blocks 10 and 13 is sold and said sale includes the property comprising the ALLEYS herein, the Port of Shelton shall pay Mason County a share of the sale price in proportion to the amount of said sold property comprising the vacated alleys.
