IN THE MATTER OF THE PETITION OF:
Vacate all that portion of the unnamed road adjacent
to Tract 29 of Skookum Point Tracts, recorded in
Volume 4 of plats, pages 54 and 55, said Tract being
a portion of Resultant Parcel 1 of Boundary Line
Adjustment # 02-40, recorded under Auditor's File
No. 1760371, in the Southwest quarter of Section 24,
Township 20 North, Range 3 West, W.M. in Mason
County, Washington.
ORDER OF VACATION
VACATION FILE NO. 424
RCW 36.87
WHEREAS, it is the intention of the Board of Mason County Commissioners to vacate the
following described rights of way:
Vacate all that portion of the unnamed road adjacent to Tract 29 of Skookum Point Tracts, recorded in
Volume 4 of plats, pages 54 and 55, said Tract being a portion of Resultant Parcel 1 of Boundary Line
Adjustment # 02-40, recorded under Auditor's File No. 1760371, in the Southwest quarter of Section 24,
Township 20 North, Range 3 West, W.M. in Mason County, Washington.
WHEREAS, the Mason County Board of Commissioners agreed on April 15, 2025, by adopting Resolution
No. 2025-020 to publish and post, according to law, a notice of intent to close and vacate the described rights -
of -way and set a virtual hearing for May 28, 2025, at 1:00 p.m. with the Mason County Hearing Examiner.
WHEREAS, the hearing was held on May 28, 2025, at 1:00 AM via Zoom and the Mason County
Hearing Examiner considered the County Engineer's report, together with any evidence for or objection
against said vacation; and
WHEREAS, the Hearing Examiner has rendered to the Board of Mason County Commissioners, his
Findings of Fact, Conclusions of Law and Recommendations and the members of the Board have given them
due consideration, and
Order of Vacation No. 424
WHEREAS, the Petitioners, Sean Wessels and Maria Palanca-Wessels have paid in full the
administrative fee of $1000.00, and for a "Class A" per RCW 36.87.120 & MCC 12.20.040, 12.20.050, &
12.20.060, compensation is fifty percent (50%) of appraised value. The square footage of the unnamed road
adjacent to Tract 29 of Skookum Point Tracts requested for vacation is 4,000 sq ft, and the cost per square
foot is $0.77.
The compensation due for the unnamed road adjacent to Tract 29 of Skookum Point Tracts is $1,540.00 and
this amount has been paid; and
NOW, THEREFORE, IT IS ORDERED that the above described right of way is hereby vacated;
and
IT IS FURTHER ORDERED that said vacation is subject to any existing easements for ingress,
egress, drainage and other purposes, if any, and in accordance with RCW 36.87.140, and retaining an easement
in favor of Mason County for any utilities and drainage present in the vacated road right-of-way.
