These violations have been determined to contribute to a public health hazard and constitute a public nuisance as defined by RCW 7.48.130. General description of violation(s)found at time of inspection: The septic tank on the property collapsed, and the contents are exposed to the environment. Washington Administrative Code(WAC)or Mason County Code(MCC)Section(s)in Violation: 1. Discharge of Sewage onto the ground MCC 6.76.130-ENFORCEMENT(1) It shall be unlawful to discharge sewage from any on-site sewage system, including septic tank wastes and greywater to surface water or upon the surface of the ground. 2. Use of a malfunctioning on-site sewage system. MCC 6.76.130- ENFORCEMENT (2) It shall be unlawful to use or maintain a malfunctioning on-site sewage system. Upon the discovery of the existence of such a system, written notice of violation shall be given to the recorded owner and/or occupant of the premises. Upon failure to adequately repair and restore the sewage system to proper working order within the time frame stipulated on the written notice or thereafter amended,the premises may be vacated. Failure to so vacate shall constitute an additional violation. NOTICE IS HEREBY GIVEN that the Mason County Public Health Officer has determined the lack of adequate sanitary facilities on the property in question violates WAC 246-272A and Mason County Ordinance Title 6.Staff of the Environmental Health Section of the Mason County Public Health Department inspected your property and sanitary facilities and found a collapsed septic tank that was fully exposed to the environment. This lack of adequate sanitary facilities has been determined to contribute to a public health hazard and constitutes a public nuisance as defined by RCW 7.48.130. YOU ARE HEREBY ORDERED to abate the health hazard and public nuisance in the following manner: 1. COMPLETELY COVER THE COLLAPSED SEPTIC TANK TO PREVENT ACCIDENTAL ENTRY. CORDON OFF THE SEPTIC TANK AREA TO ALERT PEOPLE AND ANIMALS OF THE DANGEROUS CONDITION. 3. ABANDON THE COLLAPSED SEPTIC TANK BY REMOVAL OF THE CONTENTS AND AN APPLICATION OF LIME INTO THE VOID FOR DECONTAMINATION. 4. FILL IN THE REMAINING VOID WITH SOIL AND GRAVEL TO GRADE. 5. ALL CORRECTIONS MUST BE COMPLETED WITHIN 30 DAYS OF THE DATE ON THIS NOTICE AND ORDER. Extensions may be given to these timelines if good communication and efforts regarding the public health concern are observed. You must keep in contact with us throughout this process to avoid further enforcement, which may include civil penalties/fines and/or non-occupancy order(s). Determinations of the Health Department may be appealed to the Health Officer.Appeals must be made in writing to the Health Department within seven working days of the disputed determination. A pending appeal will not exclude you from the requirements outlined in this notice and order. Mason County provides this formal Notice and Order according to MCC 6.76.090. Proper communication and progress toward health violations must be made to avoid further enforcement actions,which may include civil infractions(fines)according to applicable codes and department enforcement policies.With good communication and efforts toward public health concerns, extensions to these timelines may be provided. MCC 6.76.140—Appeals: Determinations of the Health Director may be appealed to the Health Officer.Appeals must be made in writing to the director within ten working days of the decision which is being disputed.A hearing date shall be scheduled with the Health Officer to be held within 30 days of said decision being appealed. Determinations of the health officer may be appealed to the hearings examiner.Appeals must be made in writing to the director within ten working days of the decision which is being disputed. A hearing date shall be scheduled with the board for their next regular meeting. Departmental orders and determinations shall be stayed for the period the appeal is pending,provided no surfacing sewage or public health hazard results from said stay.Any variations from these regulations resulting in requirements less stringent than those found in Chapter 246-272A WAC shall have concurrence from the Washington State Department of Health. Administrative hearings shall be conducted in accordance with Mason County Office of Environmental Health Variance and Appeal Procedure. Copies of said document shall be maintained and made available to the public at the Mason County Public Health office. Pending appeals will not extend the outlined timelines and requirements from any surfacing sewage or public health hazards.
