Noll, On January 17, 2001, a field inspection verified that the illegal addition to the existing storage building at the above location had been removed as requested. As per the phone conversation I had with Mrs . Noll recently, enclosed you will find the requirements for an efficiency dwelling unit in the event that you decide to apply for a change of use for the storage building to remodel and convert it to living area. The enclosure is based upon currently adopted building code regulations . The proposal will need to meet all regulations pertaining to use as a single family residence in effect at the time of application. I would like to thank you for your cooperation with this department and inform you that the enforcement case has been closed. MEMORANDUM DATE: January 9 2001 TO: Tami Griffey, Terry Ryan FROM: Betty Wing SUBJECT: Noll Complaint Collins Lake Mr. and Mrs. Pellegrini at 206-932-3020 met with me to discuss the neighboring property owned by Candy Noll. They indicated that the "do not occupy" signs that had been posted on the shed had been removed and they saw this morning someone coming out of the storage shed that looked like they were living there. They indicated it was not Judith Ann, the prior occupant. I assured them that the building would be re-posted do not occupy and that once you returned from vacation I would get an update from you on what the Noll's were doing to get their property into compliance. I explained to the Pellegrini's the challenges we have when people do not comply with our requests. I explained that our next course of action is to pass this on to the Prosecutor's office but they consider landuse issues as their lowest priority. The Pellegrinni's also mentioned that their septic system for their house is located on the adjacent property owned by Candy Noll. They have concerns that if the system fails they might be in a bind or if the adjacent property is sold. . .there might be a problem for them down the road with a new owner. I suggested they make contact with a good land use attorney to discuss the specifics of their own contract with the Noll's and that sometimes a letter from an attorney gets the attention of the property owner. They agreed that they would make contact with a landuse attorney. They also indicated that Collins Lake Maintenance Group met with them last night to express their frustration that Judith Ann had moved to a new location and they were concerned about the number of dogs on the property. I also suggested the Pellegrinni's and the Collins Lake Maintenance Group might want to consider talking to the same land use attorney about their joint concerns. They were very polite, but frustrated. The meeting went well and they seemed to believe that making contact with a landuse attorney would be a good idea. (It sounds like they may make contact with Rob Wilson-Hoss. ) I told them we would re-post the house and you would get with me once you return and we would see where we are with the Noll' s. I apologize for not updating Tidemark. . .computers were down and I did not have a case number to attach this to. Noll PO Box 2703 Belfair, WA 98528-2703 RE: Violations of Mason County Ordinance 45-99 1997 Uniform Building Code Dear Mr. and Mrs . Noll Mason County has recently received complaints regarding two separate violations and parcels which have been identified as belonging to you. The parcel number, legal descriptions and related enforcement case numbers of the violation sites are as follows : 1 . Parcel No. : 22331 --52-00006 Legal Description: Collins Lake, Div 3 Lot 6 Enforcement Case No. : ENF2000-00093 Site Posted: 7-7-00 2 . Parcel No. : 22220-52-00008 Legal Description: Twanoh Falls Addn 3 Tr 8 Enforcement Case No. : ENF2000-00092 Last Posting: 7-5-00 Both of the complaints have been validated by site inspections and have been posted with Stop Work Orders and in addition, the site at Collins Lake with a Do Not Occupy Order. The Collins Lake site has been posted on two separate occasions over the past six months . Enclosed is a copy of Mason County Ordinance 45-99 . I have highlighted Sections 14 . 12 . 030, 14 . 12 . 040 and 104 . 2 . 5 . Mason County will be proceeding with enforcement action against the legal owners of the property. As stated, the Mason County Assessor' s office indicates that you presently have legal ownership of both of the sites . If, Mason County has inaccurate information regarding ownership and you have sold these parcels, please contact me immediately so that I may correct our records and proceed against the responsible parties . r To bring the sites into compliance with Mason County regulations, it will be necessary to either obtain after the fact building permits for the non-permitted structures or remove the illegal construction by demolition. Please contact me within 15 days of the receipt of this letter to notify me of your intentions to comply or to assist us in establishing correct owner information.
