Below you will find comments made regarding the proposed development and its critical values. In some cases, setbacks for development from shorelines, steep slopes, streams, and wetlands must be included in your specific proposal; these setbacks are included as part of the comments listed below. This information is based on County and State regulations as they exist to date. These regulations may change and may affect the requirements for development of the subject property. Sincerely, Allan Borden Land Use Planner Mason County Planning Department 10/7/2005 1 of 3 SP12005-00258 Site Inspection 10/7/2005 Case No.: SP12005-00258 ' Comments: Pre-inspection for Rita Pfeifer on Sept. 1, 2005: The purpose of the pre-inspection was to evaluate issues related to the construction of a single family residence on a 0.42 acre parcel along the southeast side of Collins Lake. The parcel is covered with evergreen and deciduous shrubs and trees and has a general slope of 15 to 30 percent in the southern 150 feet (near the road) and 5 to 10 percent in the northern 130 feet (near the "lake"); the natural shoreline edge is not protected with rock or bulkhead. The existing cabin with covered porch (16 ft. 4 in. deep by 26 ft. wide; total of 422.5 sq. ft. plus 38 sq. ft. footprint area) is located 43 feet from the high water edge of the category II wetland, known as Collins Lake; and about 140 feet downhill from the road. The zone designation for the site is Rural Residential 5. Standard building setbacks for this zoning are a 25 foot front yard setback, and 20 foot side and rear yard setback (lot line setbacks). The exception to this is for lots less than under 100 feet in width, where side yard setbacks are equal to 10% of the lot width, but no less than 5 feet; for the subject lot, the side yard setback would be 6 ft. 6 in. These setbacks are measured from structures above grade such as roof overhangs / gutters, and other structures, including balconies, decks, heat pumps etc. Landslide hazards: The steeper slopes observed are between 15 to 30 percent profile. Due to possible instabilities of such natural banks along the wetland area that are adjacent to or within 300 feet of a proposed building site, a Geologic Assessment is needed for any proposed construction. The Geologic Assessment format is contained in Mason County Resource Ordinance section 17.01.100 EA. The assessment must state that the hazards of the landslide area can be overcome in such a manner as to prevent harm to property and public health and safety, and must also assure the proposed site construction will cause no significant environmental impact. This study must accompany any development permit and should be based upon the footprint area where structures are proposed. See the enclosed Resource Ordinance information. Wetland critical area: Planning staff confirmed the parcel is bounded on the north by Collins Lake, which is regulated under Mason County's Wetlands chapter 17.01.070 of the Mason County Resource Ordinance. The ordinance chapter is enclosed with this letter. The "lake" is a Category II wetland with an aquatic bed lake. Buildings must be set back an additional 15 feet from the buffer, for a total of 100 feet from the edge of the wetland at any measuring point. The buffer, which starts at 43 feet from the porch roof, has been mowed and cleared of shrub vegetation that is present on the properties to the east and west of the subject parcel. This vegetation maintenance may be continued by the current owner in accordance with the Wetland area standards. Proposed new development on the property shall meet the 85 foot vegetation buffer plus 15 foot building setback development standards near wetlands. You were concerned whether the outhouse on this lot can be used. You would need to confirm with the Health Department what type of septic is appropriate to the continued use of the cabin or any new proposed structure. General process: Future site development must include a site plan, showing all setbacks from property lines, wetland edge, and existing improvements, will be needed for building permit application submittal. Background and Analysis Department of Community Development staff reviewed the development standards set out in the Mason County Resource Ordinance and has proposed changes in text to assure that the state law provisions are now part of the implementing regulations of the current Mason County Comprehensive Plan. The present Resource Ordinance Section 17.01.061 refers to allowed land uses set forth in the Mason County Development Regulations. The proposed additional text to this section provides specific standards of review to consider in the evaluation of a proposed land use occurring on designated Agricultural Resource Lands. The use of a special use permit to evaluate a home occupation or cottage industry provides for the public review of a proposed development and the inclusion of needed conditions of approval that are associated with that development or land use.
