CARSON PO BOX 5176 BELFAIR, WA 98528 RE: NOTICE AND ORDER FOR ABATEMENT Parcel No.: 22331 51 00017 Legal Description: Collins Lake Div 2 Tr 17 Site Address: i :72$ Collins Lk Dr., �C'f Dear Mr. Carson, The log structure (mobile cover) located at the above legal description and address, situated in Mason County, State of Washington built in violation of Mason County Ordinances and the Uniform Building Code has resulted in this structure being posted as a "Dangerous Building". Also posted at the site is a "Do Not Occupy" notice pursuant to Section 203 of the Uniform Building Code: Unsafe Buildings or Structures and the 1991 Uniform Code for the Abatement of Dangerous Buildings. Pursuant to the Uniform Code for the Abatement of Dangerous Buildings, Section 302, the structure has been found to be categorized under the following conditions/defects that exist to the extent that the life, health, j property or safety of the public or its occupants are endangered: Sec 302(5): Whenever any portion or member or appurtenance thereof is likely to fail, or to become detached or dislodged, or to collapse and thereby injure persons or damage property. Sec 302(6): Whenever any portion of a building, or any member, appurtenance or ornamentation on the exterior thereof is not of sufficient strength or stability, or is not so anchored, attached or fastened in place so as to be capable of resisting a wind pressure of one half of that specified in the Building Code for new buildings of similar structure, purpose or location without exceeding the working stresses permitted in the Building Code for such buildings. Page 1 of 3 Sec 302(8): Whenever the building or structure, or any portion thereof, because of (i) dilapidation, deterioration or decay; (ii) faulty construction; (iii) the removal, movement or instability of any portion of the ground necessary for the purpose of supporting such building; (iv) the deterioration, decay or inadequacy of its foundation; or (v) any other cause, is likely to partially or completely collapse. Sec 302(9): Whenever, for any reason, the building or structure, or any portion thereof, is manifestly unsafe for the purpose for which it is being used. Sec 302(13): Whenever any building or structure has been constructed, exists or is maintained in violation of any specific requirement or prohibition applicable to such building or structure provided by the building regulations of this jurisdiction, as specified in the Building Code or Housing Code, or of any law or ordinance of this state or jurisdiction relating to the condition, location or structure of buildings. Sec 302(1 7): Whenever any building or structure is in such a condition as to constitute a public nuisance known to the common law or in equity jurisprudence. Notification is hereby given that stop work orders have been placed on site on 9-1 1-90, 1-22-92 and 5-28-93. The failure to stop work, the resuming of work without permission from the Building Official, or the removal, mutilation, destruction or concealment of the Notice is punishable by fine and imprisonment. Page 2 of 3 The building official has determined that the structure must be demolished. All required demolition permits are to be secured by you within 45 days of the date of this Notice and Order (prior to July 19, 1993) Demolition of this structure must be completed within 60 days from the issuance date of the demolition permit or prior to September 17, 1993. If the demolition is not commenced within the time specified, the building official may proceed to casue the work to be done and charge the costs thereof against the property or its owner. Be advised that any person having any record title or legal interest in the building or structure, may appeal from the Notice and Order or any action of the building official to the Board of Appeals, provided the appeal is made in writing as provided in the Uniform Code for th Abatement of Dangerous Buildings and filed with the building official within 30 days from the date of service of such Notice and Order; and that failure to appeal will constitute a waiver of all rights to an administrative hearing and determination of the matter. Box 186 Shelton,Washington 98584 (206)427-9670 BUILDING PARKS & RECREATION FAIR/CONVENTION CENTER ADMINISTRATION INFORMATION RE: CARSON ABATEMENT 6-15-93: Alexander Cobb (275-0259) attorney for Mr. Carson called asking what was Mr. Carsons alternatives to the demolition order. I informed Mr. Cobb that an appeal must be made as required in the abatement code. He then asked what Mason County may accept in order for the building to remain. I stated that current policy calls for structural engineering on all log type structures and that certainly if Mr. Carson had the approved engineering plans and a copy of a field report from the Wa. State Lic. Structural engineer approving the way the structure was built meeting all compliance with UBC may be the only alternative to keeping the structure. The cost, from personal experience and hearsay, of both the legal fees and structural engineering fees and violation fees from both continuing after stop works were issued and for constructing without the required permits may be more than what the building would be valued at if a permit were issued and that Mr. Carson may want to consider that if making an appeal. I also indicated that further reports have been received that Mr. Carson is continuing to build in violation of the stop work orders and that further information on that would be available 6-17-93. Mr. Cobb will mail the intention to appeal the demolition order within the time frame specified to Mike Byrne, Building Official.
