Dear Mr. Looney,
Our office has received a series of complaints since 1994
regarding the condition of the manufactured home located at the
above address . Previously, our office has posted this structure
with Notice and Orders to Demolish and Dangerous Structure
postings . The most recent posting occurred on January 8, 1998,
after receiving an additional complaint .
As the new owner of the site, it is your responsibility to
comply with Mason County standards and regulations . This structure
was in a dilapidated state at the time of your purchase and
therefore, you should be aware that the problem exists .
The mobile home is considered to be an existing non-conforming
unit as it was placed on this site in August of 1994 without the
required permits . Since that time, the condition of the home has
seriously deteriorated.
Please take the time to respond to this notice with your
intent to bring the site into compliance with Mason County
regulations . At this point in time, the options would include
securing the appropriate building permit from Mason County and the
required Dept . of Labor and Industries alteration permit for the
repair of the unit which has substantial damage and to either
demolish the home or remove the home from the site . Placement any
where else in the county on private property would require a permit
unless it were going to a site such as a salvage yard for
demolition.

RE : Notice and Order for Abatement
Dear Mr. Looney,
On June 5, 1998, you acknowledged and received certified mail
containing a Notice and Order for demolition of a mobile home
located at Collins Lake, Div. 1, Lot 58 , Parcel No. : 22331-50-00058 .
The Notice and Order required a demolition permit and
commencement of demolition prior to June 20 , 1998 . On July 8 ,
1998, you contacted me by phone and assured me the unit would be
removed from the site within 2 weeks . On August 14 , 1998 , a
demolition permit was received by this office and you had indicated
a contractor had been hired and the unit would be gone within
August .
The unit remains on site and as such, additional enforcement
action has been taken.
On October 20 , 1998, the Mason County Permit Assistance Center
received authorization from the Mason County Board of Commissioners
to post for quotes for the demolition. The post for quotes was
opened and bids were accepted until Thursday, October 29, 1998 .
The Certificate of Abatement was recorded at the Mason County
Auditors office today. The awarding of the bid will be done within
the next two weeks . There were two bids received, which do not
include debris disposal costs, only labor and equipment . Copies of
those bids are enclosed as well as the authorization to post for
quotes as printed in the Shelton Journal and a copy of the
Certificate of Abatement . Historically, the demolition disposal
costs have equaled approximately 2/3 of the labor and equipment
charges . This will give you an indication of the approximate cost
to be billed to you as an assessment .

Due to your lack of cooperation in the past by failing to meet
the deadlines and agreements as you proposed, Mason County has had
no alternative but to pursue this action as originally stated.
Demolition is scheduled to be completed by December 21, 1998
and there will be further public hearings on the assessment of the
costs against the parcel in conformance with the Uniform Code for
the Abatement of Dangerous Buildings .
The public notice is scheduled to be published on November 5,
1998 regarding the demolition and awarding of the bid. A ten day
waiting period will follow and then commencement of demolition is
scheduled to occur.

Dear Mr. Looney,
On January 28, 1998, I sent notification to you regarding the
condition and non-conforming status of the manufactured mobile home
at the above address to which you responded by phone call however,
you did not leave a phone number where I could reach you. You had
indicated that you paid someone to remove the vehicles and garbage
and didn' t understand the reason for my letter. I have enclosed a
copy of that letter with highlighted areas to clarify. The mobile
was never permitted and is in violation of Mason County
regulations . The mobile is in a state of severe dilapidation.
To bring the site into compliance you must :
1 . Obtain the necessary permits to retain the mobile
from Mason County and a permit from the Washington
State Dept . of Labor and Industries to repair the
unit or;
2 . Demolish the unit and remove debris from the site or;
3 . Remove the unit from the site .
I hope this explains the current situation regarding the
mobile/manufactured unit and your responsibility to resolve this
matter as the legal owner of the site.
Please respond with your intent, or what action listed above,
that you will be selecting to bring this violation into compliance.
I will note on Enforcement Case No. : ENF94-0133/ENF98-0005
for your response to be received PRIOR TO APRIL 17, 1998 .

On September 8, 1994, notification was sent to you via certified
mail with return receipt requested for verification of receipt of the first letter
regarding violation of Mason County codes and ordinances. Receipt was signed
and dated September 12, 1994.
On October 18, 1994, a notice of Mason County Code Violation:
Abatement Order: Duty to Notify as well as a Notice and Order to Disconnect
Utility Service was posted on the violation site and a conversation ensued
which explained compliance methods with the occupant who claimed to be
Delancey Woods. Copies were sent to both parties named via certified and first
class mail. The certified copies were returned unclaimed.
On December 23, 1994, a site investigation resulted in the posting
of Do Not Occupy notices on the unit. The unit has been deemed a Dangerous
Structure and any continued occupancy of this unit is in violation and will be
prosecuted as such.
A notification has been sent to PUD #3 to begin disconnection of
utilities immediately under our authority pursuant to Section 202(f) of the
Uniform Administrative Code.

Pursuant to our authority under the Uniform Codes as adopted by Mason
County Ordinance 138-92, we hereby order that the utility service provided to
NE 920 Collins Lk Dr., Tahuya be disconnected immediately as the structure
has been deemed a Dangerous Building and posted as such.
Enclosed are copies of notifications sent to the owners, James Padgett
and Delancey Woods. Mr. Padgett also owns property at NE 880 Collins Lk
Dr., which is NOT included in this order.
To assist you with site identification, I have enclosed a photo copy of
photos taken on site. The structure is a 1970 Bon Prix, 52 x 24 mobile home
which was damaged by a tree and moved without a permit from another site
to this site. The half of the unit facing the road is blue and white, the back half
is green and white. Notices are posted both on the unit and on a tree to the
right of the driveway as you enter the site. The occupant, Delancey Woods,
was told on 10-18-94, that our office would pursue disconnection if he did not
take appropriate steps to be in compliance.

NOTICE AND ORDER TO DISCONNECT UTILITY SERVICE

On September 8, 1994 notification was sent to the above parties
regarding a violation of the Uniform Building Code and Mason County Ordinance
No. 138-92. On September 12, 1994, this notification was accepted via
certified mail.
To achieve compliance with the violation order, a building permit was to
be submitted prior to September 30, 1994. To date, no permit has been
received.
Pursuant to the Uniform Administrative Code, Section 202(f): The building
official or the building official's authorized representative shall have the
authority to disconnect a utility service or energy supplied to the building,
structure or building service equipment therein regulated by this code or the
technical codes in case of emergency where necessary to eliminate an
immediate hazard to life or property. Furthermore, the Uniform Code for the
Abatement of Dangerous Buildings allows for classification of a structure as a
Dangerous Building if it meets one of eighteen specifications. Section 302(13)
applies as follows: Whenever any building or structure has been constructed,
exists or is maintained in violation of any specific requirement or prohibition
applicable to such building or structure provided by the building regulations of
this jurisdiction, as specified in the Building Code or Housing Code, or of any
law or ordinance of this state or jurisdiction relating to the condition, location
or structure of buildings. Since the building/structure is classified as a
Dangerous Building, any power connected to such building/structure is
considered to be fire hazard and thus an emergency exists and authority to
order disconnection is warranted:
Disconnection of this utility service is hereby ordered effective OCTOBER
31, 1994 by order of the Mason County Building Department.

Dear Karen,
A damaged double wide mobile home was moved from NE 21 Pine Tree
PI., the McMichael's residence, to the above site address also located at Collins
Lake. McMichael's replaced the mobile home in June and received the
necessary permits to do so however, the moving and placement of the old
mobile was not permitted by the new owners. Our records indicate that the
mobile is a 1970 Bon Prix, 52' x 24',
Enclosed is a copy of the violation letter sent to Woods/Padgett. They
are both listed by the Mason County Assessors office as the owners of the
property. Their mailing address is listed as NE 880 Collins Lk Dr., however the
site is NE 920 Collins Lk Dr., I have mailed notification to both addresses.
I have given a compliance date to submit for a permit by September 30,
1994. If I have not received the application or permit by October 3, 1994, 1
will send notification to them of our authority to request disconnection of
utilities and give them until October 10, 1994 to respond. I will send you a
copy of that letter in the event that I need to mail it.
Since the home received structural damage by a tree falling on it last
Spring, I will also notify the Dept. of Labor & Industries to perform an
investigation.

Our office received a complaint regarding the placement of a mobile home
without the required building permits. It was determined after the site
inspection that a violation did exist and as a result a Stop Work Order was
posted.
THE FAILURE TO STOP WORK, THE RESUMING OF WORK
WITHOUT PERMISSION FROM THE BUILDING OFFICIAL, OR THE
REMOVAL,MUTILATION, DESTRUCTION OR CONCEALMENT OF
THE NOTICE IS PUNISHABLE BY FINE AND IMPRISONMENT.
It will be necessary for you to apply for the required permits to retain the
mobile home on site. I have enclosed the applications for your completion and
submittal prior to September 30, 1994. 1 have also enclosed Mason County
regulations regarding mobiles older that June 15, 1976 as records show that
the mobile you have moved on site is a 1970 Bon Prix, 52 x 24 which
previously received structural damage due to a tree falling on the unit at a
different location.

Remove this structure, demolish the structure and dispose of debris as
per Mason County Regulation or obtain a permit to retain the structure on site.
All permits must be secured by October 31, 1994.
FAILURE TO COMPLY WITH THIS ORDER WILL SUBJECT YOU TO PENALTY,
ABATEMENT, AND MISDEMEANOR ACTIONS
MISDEMEANOR/PENALTY
You shall correct all violations by October 31, 1994. Any person, firm or
incorporation violating any provision of this Code shall be deemed guilty of a
misdemeanor and upon conviction thereof, shall be punishable by a fine of not
to exceed $300.00 or by imprisonment in the Mason County Jail for not to
exceed 3 months, or both fine and imprisonment. Each separate day or any
portion thereof during which any violation of this Code occurs or continues,
shall be deeded to constitute a separate offense, and upon conviction shall be
punishable as herein provided. Anyone who fails to comply with any final order
of the Building Official may be guilty of a misdeamenor and applicable penalties
will be assessed.
ABATEMENT WORK/NOTICE OF LIEN
In the event compliance has not been accomplished by October 31 1994, the
Building Official may abate the above violations by causing the correction work
to be done. The cost of the abatement work is charged as a PERSONAL
OBLIGATION OF THE PROPERTY OWNER and/or as a LIEN AGAINST THE
PROPERTY. Utility disconnection has been ordered if compliance is not
achieved.

APPEAL
Any person having any record, title or legal interest in the above-described
location may appeal the Notice and Order of any action of the Building Official
to the Board of Appeals, provided the appeal is made in writing, as provided in
this code and filed with the building official within 30 days from the date of
service of such notice and order; FAILURE TO APPEAL WILL CONSTITUTE A
WAIVER OF ALL RIGHTS TO AN ADMINIStRATIVE HEARING AND
DETERMINATION OF THE MATTER. The appropriate form for appeal may be
secured from the Department of General Services, Building Division.
YOU HAVE THE DUTY TO NOTIFY THE BUILDING DEPARTMENT OF ANY
ACTIONS TO CORRECT THE ABOVE VIOLATIONS YOU HAVE TAKEN SINCE
THE RECEIPT OF THIS NOTICE AND ORDER.
