The request was reviewed on July 8, 2015 by the Mason County Hearing Examiner and approved with no special conditions on that date, pursuant to the Mason County Title 17.05.044 Special Use Permit review criteria, specifically to evaluating a proposed accessory dwelling unit on the subject parcel (PN 22330-75-00070) along NE Eagle View Dr., in the Rural Residential 5 zone at 6.0 miles north of the Tahuya WA. The proposal was exempt from SEPA review per WAC 197-11-800 (1 ). This is a final County decision. No further appeals to the County are available. Appeal of this decision may be made to Superior Court or the appropriate administrative agency as regulations apply. It is the appellant's responsibility to meet all legal requirements of any appeal process. Time Limit for Action. Per the Mason County Code Title 15 - Development Code - No permit authorizing construction shall extend for a term of more than five years. if actual construction of a development for which a permit has been granted has not begun within two years after the approval, the Hearing Examiner shall review the permit and upon a showing of good cause, may extend the initial two year period by permit for one year. Otherwise, the permit terminates; PROVIDED that no permit shall be extended unless the applicant has requested such review and extension before the Hearing Examiner PRIOR to the expiration date. The SUP is approved with conditions. 11 ORAL TESTIMONY 12 Allan Borden, Mason County planning staff summarized the staff report. 13 14 EXHIBITS 15 The seven exhibits identified in the "case index" to the July 8, 2015 staff report were 16 admitted into the record during the hearing. 17 FINDINGS OF FACT 18 Procedural: 19 1. Applicant. The applicants are Michael and Brenda Baca. 20 2. Hearing. A hearing was held on the application on July 8, 2015, at 1:00 21 p.m., in the Mason County Board of Commissioners Meeting Chambers. The hearing examiner participated by phone conference. 22 Substantive: 23 24 3. Site/Proposal Description. The applicants seek a special use permit ("SUP") to place a 532 square foot manufactured home on a residential lot as an accessory 25 dwelling unit ("ADU") at 111/113 NE Eagle View Dr. Tahuya, WA. The lot fronts Eagle View Dr. The lot is 5.0 acres in area and is 430 feet wide at the road and 500 feet deep on the sides. The lot is currently developed with a 1,596 square foot residence that will be located 70 feet to the west of the proposed manufactured home SUP/ADU P. 1 Findings, Conclusions and Decision location. The existing residence is located 120 feet from Eagle View Dr. The owner 1 of the subject lot is residing in the currently existing residence. 4. Characteristics of the Area. The area is characterized by medium-density rural residential development (one dwelling per 1.3 to 5 acres) in an area zoned as RR5. The vicinity (Exhibit 3 and 4) is 6.0 miles north of Tahuya. Half of the parcels 4 in this part of Mason County have a residence, garage or agricultural building (Exhibit 4). 6 5. Adverse Impacts of Proposed Use. As conditioned, there are no adverse impacts associate with the proposal. The addition of a manufactured home is 7 compatible with the residential development of the area and the increase in density will not be noticeable given the heavily treed nature of the subject lot and surrounding 8 lots (see Ex. 4). Beyond compatibility, staff have found that the proposal will be 9 served by adequate private well water and a septic drain field. 10 CONCLUSIONS OF LAW l t Procedural: 1? 1. Authority of Hearing Examiner. MCC 15.03.050(10) and 17.05.42 1 provide the Examiner with the authority to review and act upon Special Use Permits. 14 Substantive: 15 2. Zoning. The area is zoned as Rural Residential 5. 16 3. Review Criteria and Application. MCC 17.03.029 governs ADUs in rural 17 lands. Under MCC 17.03.029, ADUs in rural lands shall be subject to a Special Use Permit, unless they are located in the shoreline jurisdiction, in which case they are 18 subject to a shoreline permit. The proposed ADU is not within 200 feet of a shoreline 19 and, therefore, shall not be reviewed per the Shoreline Master Program policies and use regulations. The review criteria for the Special Use Permit application are 20 governed by MCC 17.05.044. These criteria, in addition to miscellaneous criteria applicable to all hearing examiner decisions,are quoted and addressed below. 21 MCC 17.05.044 SPECIAL USE REVIEW CRITERIA: 22 23 (1) That the proposed use will not be detrimental to the public health, safety and welfare. 24 4. There are no significant adverse impacts associated with the proposal as determined in Finding of Fact No. 5. Given these factors, there will be no detrimental impact to the public health, safety, and welfare as a result of the proposed .ADU. SUP/ADU p. 2 Findings, Conclusions and Decision (2) That the proposed use is consistent and compatible with the intent of the 1 Comprehensive Plan. 5. The ADU is consistent and compatible with the intent of the Comprehensive Plan. Chapter 9 of the Mason County Comprehensive plan provides that ADUs should be permitted "when minimal impact would occur to surrounding 4 areas. The cumulative impact of like structures on neighboring properties must be considered." As determined in Finding of Fact No. 5, the proposal will not create any significant adverse impacts. Given the minimal nature of the impacts, it is further determined that even if several similar PP were approved the cumulative 6 proposals impact would be nominal. 7 (3) That the proposed use will not introduce hazardous conditions at the site that 8 cannot be mitigated through appropriate measures to protect adjacent properties and 9 the community at large. 1 6. No hazardous conditions are expected, nor have any been identified as a result of the proposed ADU. No adjacent properties, nor the community at large, will 1 1 be impacted by the introduction of hazardous conditions from the ADU. 12 (4) That the proposed use is served by adequate public facilities which are in place, or planned as a condition of approval or as an identified item in the County's Capital 1' Facilities Plan. 14 7. As determined in Finding of Fact No. 5, adequate private well water and a 15 septic drain field are available to serve the proposed ADU. According to the staff report, the addition of an ADU should not lower the level of service of transportation 16 or neighborhood park facilities below applicable minimum standards and there is no 17 evidence to the contrary. The criterion is met. 18 (S) That the proposed use will not have a significant impact upon existing uses on adjacent lands. 19 8. As determined in Findings of Fact No. 5, no significant impacts are 20 expected to result from this proposal, including impacts on adjoining properties. 1 (6) If located outside an Urban Growth Area, that the proposed use will not result in the need to extend urban services. 2; 9. The addition of an ADU and its use by a single family should not result in a need to extend urban services. The site is accessed from existing roads. The ADU 24 will be served by a septic drain field and private well. Therefore, the project will not 25 result in the need to extend urban services. MISCELLANEOUS CRITERIA FOR ALL HEARING EXAMINER REVIEW: SUP/ADU p. 3 Findings, Conclusions and Decision MCC 15.09.055(C): Required Review: The Hearing Examiner shall reviei, proposed development according to the following criteria: 1. The development does not conflict with the Comprehensive Plan and meets the requirements and intent of the Mason County Code, especially Title 6, 8, and 16. 4 2. Development does not impact the public health, safety and welfare and is 5 in the public interest. 6 3. Development does not lower the level of service of transportation and/or neighborhood park facilities below the minimum standards established within the 7 Comprehensive Plan. 8 10. There is nothing in the record to suggest any compliance issues with the Mason County Code, including Title 6 and 8 as staff have determined proper sewer 9 and water facilities to be available and the proposal is SEPA exempt pursuant to WAC 197-11-800(1)(b). The project is not subject to Title 16 which only governs subdivisions. As confirmed by staff in the staff report, the proposed ADU with one 1 1 additional family should not lower the level of service of transportation and/or neighborhood park facilities below the minimum standards established within the 12 Comprehensive Plan. The project will also have no adverse impact upon health, safety and welfare since it will not create any significant adverse impacts as 13 determined in Finding of Fact No. 5. 14 The ADU meets the specific requirements for ADUs in rural lands as laid out in MCC 1; 17.03.029 because the owner of the proposed ADU will occupy the primary residence; the size of the ADU is less than 1000 square feet and is less than 80% of 16 the primary residence; only one ADU will result from the project; adequate parking is provided for the ADU; the ADU is located within 150 feet of the primary residence; 1 and the ADU will be served by adequate water and septic. It is somewhat unclear 18 from the staff report if the ADU meets applicable setback standards. The staff report notes that the "existing sheds and residence structure" meet applicable setback 19 requirements. It's unclear from this statement whether staff is referring to the setbacks of the existing residence or the proposed ADU. Since MCC 17.02.029 requires that the ADU comply with applicable setback requirements,the conditions of 21 approval will require that the ADU comply with applicable setback requirements. 22 DECISION 23 The proposed ADU is consistent with all applicable SUP standards as outlined above 24 and is approved subject to the following condition: 25 1. STAFF REPORT I. Introduction. This report evaluates a proposal to review a new manufactured as an Accessory Dwelling Unit on a 5.00-acre property. The completed unit will be 532 square feet in area. Staff finds all review standards for the Special Use Permit are met. II. Applicant. Michael and Brenda Baca. III. Property Location. 111 / 113 NE Eagle View Dr. Tahuya, WA.; Parcel #22330-75- 00070. IV. Project Description. An application for Special Use Permit was received on May 13, 2015 to review a new manufactured home (532 sq. ft. area) as an Accessory Dwelling Unit on a 5.00-acre property (Exhibit 2);to be used on the property for a family member residence of the owner. The existing septic and new water connections and driveway are now present; connections will be provided. The existing 1,596 square foot primary residence, approved in 1993 / 1994, is located approximately 70 feet to the west of the proposed manufactured home location. See site plan in the application(Exhibit 5). V. Evaluations. A. Characteristics of the site. The parcel is 430 feet wide at the road, 500 feet deep on the sides and is sloped at less than 15 percent to the southeast(Exhibit 4). The primary residence and sheds are nearly 120 feet from Eagle View Dr. Two driveways connects all buildings on the property. This Special Use Permit request will evaluate the use of the small residence as an Accessory Dwelling Unit on the subject property. B. Characteristics of the area. The area is characterized by medium-density rural residential development(one dwelling per 1.3 to 5 acres) already in an area zoned as Rural Residential 5. The vicinity(Exhibit 3 and 4) is 6.0 miles north of Tahuya and accessed by the paved roads (Tahuya-Blacksmith Rd)and gravel road(Eagle View Dr.). Half of the parcels in this part of Mason County has a residence, garage, or agricultural building (Exhibit 4). Baca ADU staff report DDR2015-00049 1 C. Shoreline Designation. Not applicable in this case. D. Comprehensive Plan Designation/Zonin>?. The Mason County Comprehensive Plan designation for the site is Rural and the zoning is Rural Residential 5. VI. SEPA Compliance. Project is SEPA exempt per WAC 197-11-800 (1)(b)(i). VII. Other Permits/Approvals. The proposal will require a Mason County Building Permit (the residence will located following SUP approval). Approval of the ADU request will address the provisions of residential density. A Notice of Application and Public Hearing (Exhibit 7)was placed in the Mason County Journal on June 4 and June 11,2015,posted on site on June 26,2015, and mailed to neighboring properties on June 15, 2015. An Affidavit of Posting was completed. VIII. Analysis. The proposal requires a Special Use Permit(Exhibit 2)per the requirements of Mason County Development Regulations, M.C.C. 17.03.029 Accessory Dwelling Units. The applicable Development Regulations standards are: A. The ADU shall be subject to a special use permit,unless in the shoreline jurisdiction it is subject to a shoreline permit. The site is outside of shoreline jurisdiction (Exhibit 3), so a Special Use Permit review is the subject of this public hearing. B. The owner of the ADU must reside on the lot in either the principal residence or-- ADU. The owner is residing on the property, and the principal residence was constructed in 199311994. C. The ADU shall be located within 150 feet of the principal residence or shall be a conversion of an existing detached structure (i.e. garage). The small manufactured home residence where the ADU is proposed is 80 feet from the primary residence (Exhibit 6). D. The ADU shall not exceed 80%of the square footage of the habitable area of the primary residence or 1,000 square feet, whichever is smaller. The size of the proposed ADU is 532 sq.ft. in habitable area, or 33%of the primary residence size (Exhibit 2). E. All setback requirements must be met by the ADU. The existing sheds and residence structure are 100 feet from the north property line, 200 feet from the south property line, and 80 feet from the west property line (Exhibit 5). F. All applicable health district standards for water& sewer must be met by the ADU. The existing residence has three bedrooms and the proposed manufactured home has one bedroom, that will be connected to the existing septic drainfield via grinder and pump system meeting Health Dept. reviews. Private two-party well provides to the residences. G. No recreational vehicles shall be allowed as ADUs. No recreational vehicle will provide the proposed AD U structure. H. An additional off-street parking space must be provided for the ADU. The parking area for the proposed ADU will be provided nearby to manufactured home. The ADUas proposed(532 sq.ft. livin area) meets all of'the above criteria A —I. Applicable Special Use review criteria: 1. Will the proposed use be detrimental to the public health, safety and welfare? The review of the proposed manufactured home as an accessory dwelling unit with the existing residence and shed structures meets all county setbacks, assures adequate off street parking, and is provided with proper septic and water services. No potential detrimental effects have been identified. 2. Will the proposed use be consistent and compatible with the intent of the Comprehensive Plan? The proposed residential land use in the Rural Area is consistent and compatible with the Comprehensive Plan. Rural Residential 5 zoning standards does allow for one ADUper parcel. 3. Will the proposed use introduce hazardous conditions at the site that cannot be mitigated through appropriate measures to protect adjacent properties and the community at large? No hazardous conditions are expected as a result of the review of the proposed home for a family member as an accessory residence. Due to adequate setbacks, no impacts to neighboring propertiesby the residence and new driveway are anticipated(Exhibit 6). 4. Is the proposed use served by adequate public facilities, which are in place, or planned as a condition of approval or as an identified item in the County's Capital Facilities Plan? No public facilities are present in the vicinity;private water and individual septic systems are in place to serve the proposed ADU. The project will not lower the level of service of transportation or neighborhood park facilities below applicable minimum standards. 5. Will the proposed use have a significant impact upon existing uses on adjacent lands? The proposed manufactured home as an accessory dwelling unit accessed by a separate driveway and adjacent to the primary residence will have no significant impact upon existing adjacent residential land uses or vacant lots (Exhibit 5). The review will make the existing development conform to the Rural Residential 5 standards. 6. If located outside an Urban Growth Area,will the proposal result in the need to extend urban services? The review of the proposed manufactured home as an Accessory Dwelling Unit would not result in a need to extend urban services to this location. Project Analysis: Based upon these policies and regulations,this review conforms as noted to the use regulations of the Mason County Development Regulations in regard to the Accessory Dwelling Unit standards.
