NOTICE IS HEREBY GIVEN that the Mason County Community Services has determined the above mentioned
property is in violation of Mason County Code, Title 6 Sanitary Code. These violations have been determined to
contribute to a public health hazard and constitutes a public nuisance as defined by RCW 7.48.130.

General description of violation(s)
• Onsite Septic System is failing and surfacing according to septic maintenance reports dated 3/18/2019,
3/27/2019, 4/7/2020, and 12/29/2020.
Washington Administrative Code (WAC) or Mason County Code(MCC) Section(s) in Violation:
Discharge of Sewage onto the ground
MCC 6.76.130-ENFORCEMENT(1)It shall be unlawful to discharge sewage from any on-site sewage system, including
septic tank wastes and greywater to surface water or upon the surface of the ground.
Use of a malfunctioning Onsite Sewage System
MCC 6.76.130—ENFORCEMENT(2) It shall be unlawful to use or maintain a malfunctioning on-site sewage system.
Upon the discovery of the existence of such a system, written notice of violation shall be given to the recorded owner
and/or occupant of the premises. Upon failure to adequately repair and restore the sewage system to proper working
order within the time frame stipulated on the written notice or thereafter amended, the premises may be vacated. Failure
to so vacate shall constitute an additional violation.
YOU ARE HEREBY ORDERED to abate the health hazard(s) and violations in the following manner:
1. All sewage discharges must be stopped by 11/20/2021 (2 days)
2. Submit a written Plan of Action that outlines repair actions and timeline for completing the necessary
repairs by 11/25/2021 (7 days)
3. All sewage repairs must be completed by 12/18/2021 (30 days), according to current rules and
regulations. Permits, disposal receipts, and certified contractors may be required.
Mason County is providing you with this formal Notice and Order according to MCC 6.76.130
Proper communication and progress towards the health violations must be made in order to avoid
further enforcement actions,which may include civil infractions (fines), Recorded Notice to Title of Non-
Compliance, and/or Non-Occupancy Notices according to applicable codes and department Page 1 of 2

enforcement policies. Extensions to these timelines may be provided with good communication and
efforts towards the public health concerns.
MCC 6.76.140—Appeals: Determinations of the Health Director may be appealed to the Health Officer.
Appeals must be made in writing to the director within ten working days of the decision which is being disputed.
A hearing date shall be scheduled with the Health Officer to be held within 30 days of said decision being
appealed. Pending appeals will not extend the outlined timelines and requirements from any surfacing sewage
or public health hazards.

violations.
