Box 4128 Bremerton WA 98312 RE: Update Status Regarding Case NMP2009-00002 Terry Duggins: This letter is the findings for the inspection of the property(PN 22330-50-00259 and-00260) along Tahuya Blacksmith Rd. for vegetation restoration work from a past enforcement case ENF2008-00117. I went to the site on March 30,2011 and found that that the necessary native plants have been planted as recommended by Earl Kong in his habitat management plan and wetland restoration plan prepared for the subject property. Although the plants were small,they were located in the wetland buffer and were mulched to some degree, and each plant was flagged with color survey tape. This effort meets the conditions of MEP2009-00002. Please note that two other MEP conditions must be carried out: a) maintain for survival of native plants for at least three to five years(failed plantings replaced . in winter or spring); and b) invasive species, such as scotch broom and Himalaya berry, shall be removed by hand from the wetland and wetland buffer. Since you plan to have water and septic provided on the property,you must keep the elements of this development outside of the 40-foot wetland vegetation buffer. A crossing of the wetland and wetland buffer shall be limited to one crossing,and native plants that must be removed during development may be salvaged and replanted in the vegetation buffer. A small bridge crossing is preferred, as ground disturbance is minimized and water flows can keep the wetland and buffer saturated or moist through the year. Your eventual cabin or garage shall be setback the needed 40-foot buffer and 15=foot building setback [55 feet total] from the edge of the wetland, and access to the structure(s)will be via the same bridge crossing. Unfortunately, it is currently missing and/or has inadequate information. A Restoration Plan needs to be included because stream and wetland buffers have already been impacted. Per the provisions of Section 17.01.210,certain components of a restoration plan are required. Enclosed for your convenience are the minimum requirements necessary to address in a Restoration Plan. After speaking with the planner, it has been determined that you do not need a Shoreline Exemption (SHX2009-00003). The planner has stated you will need a Mason Environmental Permit (MEP2009-00002) which you have applied for. The fee collected was $380.00. This price was discounted, based on other applications for additional permits/reviews. Because there is no need for the Shoreline Exemption, there is no discount for the additional permits. This increases your fee to $630.00. I have taken the fee collected for the Shoreline Exemption ($255) and credited it to the Mason Environmental Permit. This left you with a credit of$5.00. The planning department will be sending you a letter, stating that you also need a Habitat Management Plan. The review fee for this plan is $445.00. With the $5.00 credit you now have a balance due of$440.00. Additionally you will need to hire a biologist to complete a Habitat Management Plan. I have enclosed a new receipt, to show the correct credited amounts. Please replace the original receipt as it has been voided. The original information noted on the Investigation Report Form was incorrect concerning the actual parcel number(s) and owner's name (the correct information is above and has already been changed in Tidemark by Sandra). I inspected the site 10/13/08, the parcel had been cleared, saw where the stream came out at front of property and followed it back. Parcel was cleared and trees cut right up to stream edge (see photos under documents in Enforcement Case). Went back and posted stop work order on 10/15/08 but did not send out to owner. Definite F&W stream buffer violation. I have included photos that I took during site inspection along with a completed Resource Ordinance Code Selection Sheet. And I have updated the Enforcement Case in Tidemark with all additional information.
