If actual construction of a development for which a permit has been granted has not begun within two years after approval, the Review Authority, the Mason County Planning Department, shall review the Mason Environmental Permit (MEP) and upon showing good cause, may extend the initial two year period by one year. The property consists of one parcel situated in the Northw ' n 30, + Township 23 North, Range. 02 West, W.M. (Mason County Tax Parcel Numbers 2330-50-00183 This assessment was conducted in response to an Initial Contact Letter for Code Violation — m teon Order Fik + #ENF2018-00131 issued by the Mason County Community Services (County) on November 1, 2018, for n, alleged tree removal activities within a Fish and Wildlife Habitat Conservation Area buffer on the subject property without approval. In response to infestation of invasive English ivy severely impacting the health of r applicant removed h ire e s h resented a hazard to human trees on the subject property, the app cant the patted trees a they p (� health and safety. This Technical Memorandum documents the results of a site visit by SVC and outlines a tree replacement plan to remediate impacts resulting from the tree removal activities. Figure 1. Subject Property wr i« Location � x V► t, Soundview Consultants LLC March 14,2019 1801.0001 Sechrest—Tree Impact Evaluation&Restoration Plan Page 1 of 8 Background Information On November 1,2018,the County issued an Initial Contact Letterfor Code Violation(Mason County,2018)which confirmed the removal of trees within a recognized biodiversity corridor on and adjacent to the subject property (Mason County Tax Parcel Number 22330-50-00188) that is regulated as a Fish and Wildlife Habitat Conservation Area (FWHCA) under Mason County Code (MCC) 8.52.170. According to the County, the unauthorized clearing activities were conducted within the FWHCA buffer, which is in violation of MCC 8.52.170(D). Methods The vegetation impact evaluation was completed by qualified SVC staff in November 2018. The experienced scientists made visual observations and measurements of the stumps to estimate the diameter at breast height (DBH) and determine species of the trees removed. Existing tree stump locations were noted and obtained using a GPS device to document coordinates with high accuracy. The DBH of each tree removed was then used to estimate the area of canopy removal to determine the location of the proposed tree replacement activities. Results On November 30, 2018, qualified SVC staff performed a site investigation to evaluate the extent of the unauthorized clearing activities on the subject property within the recognized FWHCA.SVC staff identified 11 tree stumps with an approximate DBH ranging from 6 to 32 inches prior to removal. Through direct field observations and evaluation of historical aerial photographs depicting pre-violation conditions, it was determined that the removed trees consisted of red alder (Alnus ruraa),Western red cedar (Thuja pkcata), and Douglas fir (Pseudotsuga men#esiz). A site map depicting the locations of the existing stumps on the subject property is provided in Attachment A. The 0.28-acre subject property is located in a rural residential setting and is currently developed with a single- family residence,out building,dock,and associated infrastructurd. The subject property directly abuts Haven Lake to the east, residential properties to the north and south, and NE Lake Drive to the west. Onsite vegetation is dominated by mixed forest consisting of western red cedar,red alder,Douglas fir,and shore pine (Pima contorta),with an understory of hardhack(Spiraea douglarit),western swordfern(Polystichum munitum), salal (Gaultheria shallon), and aggressive non-native invasive English ivy (Nedera helix). English ivy is aggressively dominating the understory in spot as both a ground cover and woody vine that was climbing the native trees that were removed. The English ivy was effectively in the process of girdling the trees which would have caused them to die and eventually fall presenting a danger to health and human safety to the applicant and surrounding residents. Regulatory Considerations The wooded area where the tree removal took place is considered a biodiversity corridor that is regulated under MMC 8.52.170, and any modification of such areas should adhere to the requirements set forth in MMC 8.52.170(D). Within FWHCA's, clearing and grading activities must be fully permitted through the development of a Habitat Management Plan(HMP)as detailed in MMC 8.52.170(D)(2);however,the trees that were removed were infested with invasive English ivy severely impacting the health of trees on the subject property presenting a danger to health and human safety to the applicant and surrounding residents. In addition, the trees that were removed on the applicant's property posed a potential loss to improvements as they were located in close proximity to homes, docks, and outbuildings. As such, the felling of these trees should be considered exempt from the HMP under the MMC 8.52.170(D)(4)(b)"Danger Trees"provision.In coordination with Mason County, SVC and the Applicant are proposing to provide a tree replacement plan consistent with MCC 8.52.110(D)(4)(b)(iv)(a)including replacement of each felled tree with six native trees. Soundview Consultants I.I.0 March 14,2019 1801.0001 Sechrest—Tree Impact Evaluation&Restoration Plan Page 2 of 8 Tree Replacement Plan Correspondence with the County indicates that they concur that these trees qualify as "Danger Trees" that needed to be removed for safety reasons. Through coordination with the county, tree replacement at the required 6:1 ratio would be acceptable. The following sections provide the tree replacement plan as agreed to by the County official overseeing the violation to remediate the alleged, unauthorized tree clearing actions. The Applicant is eager to assist with remediation and restoration actions in order to resolve the violation. The tree replacement planting plan is included in Appendix B. Restoration Goals and Objectives This tree replacement plan identifies the mitigation actions that have been developed to remedy the alleged violation. The general goals and objectives for the restoration actions proposed for this project are intended to provide a native tree canopy that will not pose as great a threat to the safety of the surrounding residents as the trees mature and provide continued slope stability within the buffer. In order to meet these goals, the aggressive non-native invasive English ivy will be treated in order to prevent it from killing the proposed plantings. Desj;dption of Restoration Strategy The proposed restoration actions include invasive treatment and the replacement of each tree removed at a 6:1 replacement ratio,which results in 66 trees to be planted. Per MCC 8.52.170(4)(b)(iv)(a),the replacement trees should be a minimum of three years old. Given the linear nature of the site and narrow width of the lot, the planting of 66 trees of the specified age within the affected area is not feasible as it would result in excessive competition and inhibit tree regeneration success. As a result, a portion of the planted trees will consist of willow stakes nearest the shoreline with the remaining tree consisting of shore pine.This replacement effort will provide a native canopy of small trees with a dense root structure to maintain slope stability. Planting activity should occur in mid fall once rainfall for the season has begun and root growth potential is high to assure regeneration establishment and survival. Because of the high stem density of the planted trees as a result of the required replacement ratio, it is anticipated that whatever trees species are chosen to plant,voluntary periodic future thinning activity by the landowner in coordination with the county would be beneficial to allow the remaining planted trees to fully mature. This planting design will meet the goal to provide appropriate tree replacement to the site without creating potential hazard trees onsite as the they mature to fiill size. A conceptual restoration plan is included in Attachment B. The sections below outline the planting plan and proposed vegetation species,spacing,and general location of planting areas. Proposed restoration actions include,but may not be limited to,the following recommendations: • Spot pre-treat invasive plants onsite(namely English ivy)with a Washington Department of Agriculture approved herbicide in the spring.Pre-treatment of the invasive plants should occur a minimum of two weeks prior to removal,then follow up treatments in the summer,and if necessary,early fall; • After pre-and follow up treatment;remove the invasive and non-native plants and replant the restoration area with native trees. Use proposed species listed in Attachment B or substitutes approved by the responsible Project Biologist and County,to help retain soils and increase onsite vegetative structure and complexity.Bare roots or container plants may be used, • No additional tree removal activities will occur without appropriate permits and/or appropriate authorization from the County; • Remove any trash/debris from the restoration area; • Maintain and control invasive plants annually, at a minimum, or more frequently if necessary, Soundview Consultants LTC March 14,2019 1801.0001 Sechrest—Tree Impact Evaluation&Restoration Plan Page 3 of 8 • Fall planting is recommended Provide temporary dry-season irrigation as necessary to ensure native plant establishment. Performance Standards The goals and objectives for the proposed restoration actions are intended to ensure no net loss of ecological functions relative to pre-disturbance conditions. The goals and objectives of the restoration actions are as follows: Goal 1—Restore tree canopy and root structure to the affected area within the critical area buffer without creating potential hazard trees onsite as the they mature to full size. Objective 1—Replace the removed tree canopy and live root structure. Performance Standard 1.1—Minimum plant survivorship will be at 80 percent of installed plants at the end of Year 1 (replacement of lost plants required if mortality rate exceeds 20 percent),75 percent at the end of Year 2,70 percent at the end of Year 3. Due to the high planting density required, specified planting survival will result in sufficient cover and root structure.Native recruits may be counted towards survivorship totals. Performance Standard 1.2—Non-native invasive plants will not make up more than 10 percent total cover in any growing season during the monitoring period following Year 1. Plant Materials All plant materials to be used for restoration actions will be nursery grown stock from a reputable,local source. Only native species are to be used; no hybrids or cultivars will be allowed. Plant material provided will be typical of their species or variety; if not cuttings they will exhibit normal, densely-developed branches and vigorous,fibrous root systems. Plants will be sound,healthy,vigorous plants free from defects,and all forms of disease and infestation.Bare roots or container stock may be used. Container stock shall have been grown in its delivery container for not less than six months but not more than two years. Plants shall not exhibit rootbound conditions. Under no circumstances shall container stock be handled by their trunks, sterns,or tops. Fertilizer will be in the form of Agroform plant tabs or an approved like form Mulch will consist of sterile wheat straw or clean recycled wood chips approximately 1/2 inch to 1 inch in size and 1/2 inch thick. Plant Scheduling,Species.Size,and Spacing Plant installation should occur as close to conclusion of invasive vegetation removal as possible to limit erosion and limit the temporal loss of function. All planting should occur between September 1 and May 1 to ensure plants do not dry out after installation,or temporary irrigation measures may be necessary.All planting will be installed according to the procedures detailed in the following subsections using the species and densities in the conceptual restoration plan provided in Attachment B. All plant material shall be inspected upon delivery. Plant material not conforming to the specifications above will be rejected and replaced. Rejected plant materials shall be immediately removed from the site. Under no circumstances shall container stock be handled by their trunks,stems,or tops. Product Handling,Delivery.and Storage All precautions customary in good trade practice shall be taken in preparing plants for moving. Workmanship that fails to meet industry standards will be rejected. If plants cannot be planted immediately upon delivery they should be protected with soil,wet peat moss,or in a manner acceptable to the responsible Project Biologist. Plants,fertilizer,and mulch not installed immediately upon delivery shall be secured on the site to prevent theft or tampering. No plant shall be bound with rope or wire in a manner that could damage or break the branches. Plants transported on open vehicles should be secured with a protective covering to prevent windburn. Preparation and Installation of Plant Materials Circular plant pits with vertical sides will be excavated for all container stock. The pits should be at least 12 inches in diameter,and the depth of the pit should accommodate the entire root system. The bottom of each pit will be scarified to a depth of 4 inches. Broken roots should be pruned with a sharp instrument and tootballs should be thoroughly soaked prior to installation. Set plant material uptight in the planting pit to proper grade and alignment. Water plants thoroughly midway through backfilling and add Agroform tablets. Water pits again upon completion of backfilling. No filling should occur around trunks or stems. Do not use frozen or muddy mixtures for backfilling. Form a ring of soil around the edge of each planting pit to retain water,and install a 4-to 6-inch layer of mulch around the base of each container plant. Optional Temporary Irrigation Specifications While the native species selected for restoration are hardy and typically thrive in northwest conditions,and the proposed restoration actions are planned in areas with sufficient hydroperiods for the species selected, some individual plants might perish due to dry conditions;therefore,irrigation or regular watering may be provided as necessary for the duration of the first two growing seasons while the native plantings become established. Maintenance and Monitoring Plan The Applicant is committed to compliance per approved plans as well as achieving and maintaining overall success of the minor restoration project. As such,the Applicant will continue to maintain the project,keeping the site free of non-native invasive vegetation,trash,and yard waste. The restoration actions will rely primarily on the planting and maintenance of replacement vegetation. The project proposes annual monitoring to be conducted by the homeowner for a period of three(3)years following installation as detailed in MCC 8.52.275.B. The inspection will occur in August or September of each year. Maintenance and monitoring measures include the following. 1. The condition plant species; 2. The number of individuals surviving at the time of monitoring; 3. Additional or corrective measures which should be taken to ensure the success of the restoration; Following plant installation,the homeowner will verify the restoration work and provide written documentation to the County in email format that demonstrates compliance with this restoration plan. The brief email will document As-Built conditions,including actual plant species and quantity,photographs,and any modifications to the approved plan. Following As-Built, the restoration site.will be monitored annually for a period of three years with formal inspections by the homeowner. Each year,a brief report in email format will be prepared by the homeowner for the County that documents the monitoring results. Each monitoring summary email will include photographs and document compliance with the components of this restoration plan. The bond must be sufficient to q p cover the cost of conformance and must be approved by the director. The bond shall be released after the director has determined that restoration has been completed and is in compliance with approved plans. The county may collect against the bond when work which is not completed is found to be in violation of the conditions set forth in the restoration plan and/or the director determines that the site is in violation of the purposes of this chapter. Contingencz Plans Careful attention to maintenance is essential in ensuring that problems do not arise. Should the restoration plantings fail,a contingency plan is recommended. Such plans are adaptive and should be prepared on a case- by-case basis to reflect site characteristics. The MCC BMPs indicate that trees should be replaced at a 1:1 ratio if there is 10 percent or greater mortality of the plantings. However,given the small size of the site and high planting density required,we anticipate competition between the plants will result in natural mortality as the plants become established, and only recommend replacements if mortality exceeds 20 percent. Contingency plans can include additional plant installation and plant substitutions including type, size, and location, consistent with the recommended plant species in Table 1 and Attachment B of this technical memorandum. Contingency/maintenance activities may include,but are not limited to: • Replacing plants lost to vandalism,drought,or disease,as necessary; • Irrigating the restoration area only as necessary during dry weather if plants appear to be too dry,with a minimal quantity of water; • Reseeding and/or repair of the restoration area as necessary if erosion or sedimentation occurs; • Removing all trash or undesirable debris from the restoration area as necessary. Should additional contingency measures be necessary to ensure compliance with the restoration objectives outlined herein,the Applicant and/or qualified Project Biologist will prepare a more detailed contingency plan and obtain County approval prior to implementation.
