Dear Applicant: Pursuant to your application, a site pre-inspection (SPI)was performed on your property. Below you will find comments made regarding the proposed development and its critical values. In some cases, setbacks for development from shorelines, steep slopes, streams, and wetlands must be included in your specific proposal; these setbacks are included as part of the comments listed below. This information is based on County and State regulations as they exist to date. These regulations may change and may affect the requirements for development of the subject property. Sincerely, Rick Mraz Land Use Planner Mason County Planning Department 11/19/2004 Page 1 of 3 SP12004-00304 Site Inspection 11/19/2004 Case No.: SP12004-00304 Comments: A field inspection of the subject property was conducted on 11/12/04 to assess critical areas issues and setbacks relevant to redevelopment of the parcel. The tract has frontage on Haven Lake and contains an existing small cabin but no well or septic system. A desired proposal expressed by the applicant was to remove the cabin, construct a larger residence and install a well and septic system. The shoreline setback for this parcel is derived using a common line procedure. An imaginary line is drawn from the most waterward portion of the roofline of one adjacent residence to the most waterward portion of the roofline of the other adjacent residence. The position where this line crosses the subject parcel serves as the setback for the parcel. No structure may project into the setback. The current cabin exists at approximately the common line setback. The parcel also contains or is near adjacent to a Type V stream, a seasonal, non-fish bearig stream begins midway down the parcel and flows into Haven Lake. The Mason County Resource Ordinance requires setbacks from streams. The setback for a type V stream is 90', which is comprised of a 75' vegetative buffer plus a 15' building setback. The existing cabin is entirely within the strea buffer and setback. Existing construction is grandfathered and may be repaired and maintained but new expanded construction must meet current requirements. New construction that further encroaches into the stream buffer and/or building setback would require a variance. A variance from the Fish and Wildlife Habitat Conservation Areas chapter may be necessary to pursue this project. A Habitat Management Plan (HMP), prepared by a qualified biologist, would be required to support the variance request. The HMP addresses impacts to the buffer and offers measures to preserve and protect the buffer or mitigate impacts. A copy of the Fish and Wildlife Habitat Conservation Areas chapter is enclosed. It includes details on the contents of an HMP. Application for a variance does not guarantee approval. The proposal must meet specific criteria listed in the Resource Ordinance. Other setback requirements for structures include 5' from lot lines as measured from the furthest projection of the structure, and 25' from the road right-of-way.
