X Resource Ordinance The applicant acknowledges that the project will be completed as proposed, so that the project will be consistent with all applicable standards of the Mason County Resource Ordinance. Future work within the vegetation buffer and shoreline critical area will be reviewed by the Dept. of Community Development prior to starting such work X Shoreline Management Act Property on Haven Lake: the proposed project must be consistent with all applicable policies and other provisions of the Shoreline Management Act, its rules, and the Mason County Shoreline Master Program. X Construction Debris Removal All construction and demolition debris must be removed from the shore area after project completion. Proper disposal of construction debris must be on land in such a manner that debris cannot enter or cause water quality degradation of State waters. X Surface Water Control All surface water and potential runoff from the proposed development will be controlled on site and shall not adversely affect any adjacent properties, cause sediment deposits, nor increase the velocity flow entering or abutting to any state or county culvert or ditch system or road way. X Vegetation buffer monitoring Monitoring of the native plant vegetation will be performed at least twice in the one-year period following the January 2014 permit issuance; early May and late August 2014 visits are the minimal monitoring effort. Monitoring will entail inspection of plant species within 50 feet of the lake for survival and vigor. Findings of the site monitoring will be reported to the Dept. of Community Development staff. Possible replacement of species that have not survived will be determined by Planning staff by September 2014. I received and reviewed both of your letters December 2"d and 12". 1 believe I understand Mason Counties concern, Mason County would like to avoid the destruction or alteration of streams and lakes and their buffers. I agree whole heartedly. With this in mind I called the Mason County Department of Community Development in June 2013 seeking guidance (this is prior to the removal of small invasive alder trees in the buffer-zone). I was advised that I could remove up to 10%of the vegetation within the buffer zone.With the information provided to me (please note at the time I was not provided Sec.17.01.110.F4 language) I was careful not to come close to exceeding the removal of the 10%of the total vegetation. I assessed all of the Invasive Alder Trees and measured the circumference of the large established cedar trees and determined that the small invasive alders did not add up to 10%of the combined circumference of the large established cedar trees in the buffer zone. The Alder trees were cut by hand. Also it should be noted that I did not pull the Alder roots out, I left 1 foot stumps so they can be hand sawed at ground level in the spring leaving their small root system intact to avoid any disturbance to the soil and ground covering. While I do not agree with the violation assessment("extensive vegetation removal') as I removed less than 10%of the total vegetation, leaving the ground covering and several massive established cedar trees with their extensive root systems to protect the shores integrity. I do agree with maintaining the integrity of the lake shore that is why the large cedar trees were not# removed, the ground covering remains intact and the alder stumps were not pulled out. Enclosed you will find a check in the amount of$885. For the Mason Environmental Permit and the Planning Violation Fine. I omitted the$445 for a Vegetation Restoration Plan Review. The vegetation remains intact;your pictures show the ground covering (mosses,ferns,grass, small shrubs), cedar trees and the clear soil undisturbed. You will note some old husks of vegetation in the picture, even they remain intact. Grass seed has been distributed and in spring more will be spread.
