Ad t2 Date of Site Visit Meeting: July 19, 2018 Zoning: The zoning designation for the site is Rural Residential 5 (11115). Standard setbacks for this zone are a 25-foot front yard setback and a 20-foot setback for side and back yards. The front yard refers to the lot line adjacent to the property access, including access easements. The setbacks are measured from structures above grade such as roof overhangs (roof gutters), and other structures/appurtenances, including heat pumps etc. When the lot width is less than 100 feet, setbacks would equal 10%of the lot width. An administrative variance can be applied for to get a reduction in the required setbacks (minimum of 5 feet for sides, minimum of 10 feet for front and rear) if the lot meets certain criteria. Other setbacks can apply when critical areas are present, see below. All setbacks are measured from the furthest projection of the structure (including roof eves and gutters). Height limit per Mason County Code (MCC) 17.04.224.0 is 35 feet. Height shall be measured using average grade level.The average of the natural or existing topography of the portion of the lot, parcel, or tract of real property which will be directly under the proposed structure and shall be determined by averaging the ground elevations at the midpoint of all exterior walls of the proposed structure. Drainage: Stormwater runoff from the roof must be directed to something like a French drain in order for the water to filter before entering the lake. Must have some kind of filtering method, can not be directly tightlined to lake. Deck:The allowed deck, up to 200sq. ft, 15 feet waterward of the house setback can use the post to pier foundation connection. Shorelines: Shoreline Designation under the Mason County Shoreline Master Program (MCSMP) is Residential. Minimum structural setback is 115' per the MCSMP Table 17.50.110-A: Buffer and dimensional standards for shoreline Development. However,the Mason County Resource Ordinance uses a "common line" provision per MCC 8.52.170(E)(3)(b), which applies in this case: "Common Line" on Residential Lots. The following are special provisions for buffers and setbacks for single family residential development on lots created prior to December 5, 1996, and which are located on saltwater or on a freshwater lake twenty (20) acres or larger in size. (i) Where existing residences are on both sides of and within 150 feet of the lot line of the subject lot, and no more than 200 feet from the shoreline OHWM,the setback on the subject lot is determined by an imaginary common line drawn across the subject lot which connects the shore-side roof lines of the first adjacent existing residences. (iii)The common line set back may be more or less than 115 feet from the OHWM, provided, however, that: a. the buffer shall not be less than 20 feet in width from the OHWM and a minimum setback from the edge of the buffer is 15 feet; (for a total of 35 foot building setback) b. If the resulting common line setback is less than the standard setback (shown in Table 8.52.170.C), a Common Line Mitigation Plan or a Habitat Management plan shall demonstrate that mitigation will be provided to offset the potential impacts (resulting from the proposed development and use) to the buffer and resource. A Common Line Mitigation Plan may be prepared by the property owner or his/her designee and shall meet the requirements in Appendix B, or a Habitat Management Plan shall be prepared by a qualified habitat biologist and meet the requirements in subpart J. Mitigation Manual. Best management practices such as those in Appendix C shall also be implemented to limit impacts to the resource. (iv) As used in this section, a "residence" refers to the principal dwelling/residential structure and does not include outbuildings or other structures. You can find resources at: https://www.masoncd.org/top-5-shoreline-recommendations-725401.html Outbuildings and other structure are not allowed in the buffer, exception being play equipment (swings, slides, temporary plastic above ground pools, but not including tree houses or other play houses), and picnic tables and chairs. View Corridors: Per MCC 8.52.170 (D)(4)(k) Buffer alterations for view corridors are allowed with emphasis placed on limbing and with selective timber removal minimized to the extent possible. Proposed alterations shall be the minimum to afford views within the buffer and shall minimize shrub vegetation removal and ground disturbance while maintaining the large mature trees. Under this provision, no more than ten percent of the shrubs and ten percent of trees in the buffer less than six inches in diameter at breast height may be cut. Docks: Repair/or Replacement of the dock at 1900 Ne Tahuya-Blacksmith Rd would require, from Mason County, a Shoreline Exemption using the JARPA form, a SEPA Checklist, and a building permit(if over 120 square feet). The State(Hydraulic Project Approval-HPA) and Federal (USACOE) permits may also be required. Enlargements are considered new construction.
