In addressing a still active enforcement case (ENF2009-00112) on your property, Planning Department enforcement staff worked with you in resolving the removal of trees in the vegetation buffer of Haven Lake in late October 2009. The solution to the tree removal concern (a Mason Co. Resource Ordinance standard) was the replanting of six trees (each a minimum of three-years old) along the Haven Lake shoreline (with technical assistance from Mason Conservation District). In regard to the needed tree replanting: On October 25, 2012 and January 29, 2013, Staff inspected the above-referenced property regarding this complaint and found that no new trees were ever replanted and no notification to Planning Department staff that the trees were planted was made, as noted in the ENF2009-00112 case file. A new complaint(ENF2011-00024) was received by the Mason County Department of Community Development. The complaint referred to a)the needed replanting of trees along the lake shoreline and b) the removal of soil along the north property line that causes a cut and steep slope between the properties. When the site was inspected in April 2011, Planning Department staff concluded that no grading permit was needed but some short retaining wall may be necessary at the toe of the cut to stabilize the sloped bank. When observed in October 2012 during permit review, the same area was cut further to prepare for the location of a new garage (permit number BLD2012- 00774). It was expected that a certain amount of backfill would be placed at the exposed toe of bank after a short retaining wall was located near the north property line. An inspection on January 29, 2013 noted that the new building roof gutters with downspouts were located 5 to 7 feet from the north property line and ended in exposed pipes that appear to direct roof runoff downhill towards the lake. This water runoff, primarily from gutters and downspout, will cause soil erosion and sedimentation in Haven Lake. This letter brings to your attention these issues and seeks resolution to the problems that they likely will cause. In regard to the runoff from roof gutters and larking area: The garage on the subject property is located right at the common property line to the north, and this garage has a gutter and downspout Ates Lake Dr buffer alteration and runoff letter.doc system that is exposed and directed towards the lake to the east, with no attempt to convey area and roof runoff safely on the property. Mason County Code 14.48.140 regarding small parcel runoff and erosion control states that adjacent properties and waterbodies shall be protected from sediment deposition and water runoff when development takes place or is proposed. A reasonable solution to address problems caused by the roof and area runoff would be to provide an adequate downspout that would convey the collected runoff from the garage to a sub-surface pipe and then to an existing 12-inch conveyance pipe (capturing runoff adjacent to Lake Dr.) or to a catchbasin that is connected to this conveyance pipe. Planning and Public Works Department staff could assist in helping work out such a proposal that would have minimal impacts to the waters of Haven Lake. A proposal like this would be a cooperative solution to a problem shared by the landowners along this portion of Lake Dr. and the Haven Lake shoreline. Staff would request that you perform these corrective actions to address the stated problems in this letter by April 3, 2013 for the roof runoff and tree replanting issues.
