Dear Applicant: As part of this department's review of your permit application, a Resource Lands and Critical Areas (RLC) site inspection was performed on your property. Below you will find comments made regarding the proposed development and its critical values. This information is based on County and State regulations as they exist to date. The Shoreline Master Program designation of the area is Urban Residential and the Comprehensive Plan designation is Rural. Currently this is an essentially vacant shoreline lot on Haven Lake that appears to have been used for recreational and camping purposes. The only structure on site is a small shed. The lot is currently heavily forested with 20 - 30 year old conifers. Work is being done near the access road to design a septic system to support future residential development of the property. the West half of the property near the access road is relatively flat, however the East half towards the shoreline slopes down towards the lake for 120 - 150 feet. the top of the slope averages approximately 22% and reaches a maximum of approximately 29% near the shoreline. The residence is proposed to be placed in an area with a slope between 20 - 25%. Per the Mason County Resource Ordinance a 50 foot vegetated buffer is normally required from slopes exceeding 15%. If residential construction is proposed within this buffer, or on slopes greater than 15%, a Geological Assessment will be needed when a building permit is applied for. The enclosed Landslide Hazard Areas chapter of the Mason County Resource Ordinance explains the requirements for Geological Assessments and Reports. If significant vegetation and/or tree removal is proposed on these slopes or buffer areas a Mason Environmental Permit may be needed. the normally required 50 foot landslide hazard area vegetated buffer may be reduced based upon the recommendations contained within a Geological Assessment or Report. If a buffer reduction is requested, a title notification would also need to be recorded with the Mason County Auditor (attached to the back of the enclosed landslide hazard areas chapter). Also the names and addresses of the adjacent properties would need to be submitted in order to perform public notice requirements of the Mason County Resource Ordinance. The Shoreline common line setback was determined by drawing an imaginary line between the two adjacent residences. Using this method the building setback for structures over 30 inches above grade would be 40 feet on the North property line and 62 on the South property line. These measurements were taken from the ordinary high water mark of Haven Lake. A line drawn between these two points would approximate the shore common line setback. The other standard building setbacks and regulations are 5 foot sideyard setbacks, 50 foot County right-of-way setbacks and a 35 foot height limit on new construction. 9/11/01 2 of 3 RLC2001-00079 Resource Lands & Critical Area Site Evaluation 9/11/01 Case No. RLC2001-00079 The applicant was also interested in the processes for putting in a bulkhead and dock on the shoreline. It was explained that permits would also be required by the WA Dept. of Fish and Wildlife and US Army Corp. of Engineers for these projects. The approval of a bulkhead on this shoreline is unlikely given the requirements of the Mason County Shoreline Master Program. Per SMP chapter 7.16.110, policy 6.a. bulkheads should only be allowed if serious wave erosion threatens an established use or existing buildings on upland property. In this case there are no signs of serious erosion and no established buildings or uses that are threatened. If desired an upland retaining wall under 30 inches above grade may be constructed, however this appears to also be unnecessary to control erosion as the shoreline is fairly well vegetated. At this time there would not appear to be any significant restrictions regarding the construction of a recreational dock that meets the requirements of the Mason County Shoreline Master Program. The County has a standard permitting process and applications available for dock construction. No other critical areas or issues were identified on site that would be impacted by the proposed development of this property.
