Tahuya, WA. 98588 RE: Mason County Building Code Violation: BCC2008-00123 Site Address: 131 NE Haven Lake Dr., Tahuya Parcel No.: 22330-50-00136 To all interested parties: The Mason County Building Department has an existing enforcement case against the above described parcel of land situated within Mason County for non-permitted construction. According to the Mason County Assessor records, you are the current Taxpayer of this parcel. Our records indicate that construction of two carports were completed in the absence of county permits or approval and a Stop Work Notice was posted on March 6, 2008. Pursuant to Mason County Code, Title 14, Building and Construction, permits for this type of activity is required under the 2006 International Building Code and your property is currently in violation. We discussed your options to permit or remove on March 10, 2008, and you had agreed to contact me with your intentions determining the cost involved with permitting. We also discussed the center structure, which you stated was storage only. I explained that the structure is to be used strictly for storage and not as habitable space as not approved for occupancy and use as habitable space. To date you have made no response or efforts to resolve these issues. A site inspection was conducted on November 20, 2008 to determine if the work was abated. It appears that additional work has been performed, see attached photos. In order to avoid additional enforcement actions, you are required to permit or remove the structures within 14 days. Failure to make the necessary arrangements will result in additional enforcement actions. TAHUYA, WA 98588 Notice The receipt of this notice shall constitute service regarding notification of violations of the Mason County Code, and shall also serve as Warning Notice pursuant to Mason County Code, Title 15, Section 15.13.035. The violation(s) are occurring at the following property: Enforcement Case No.: BCC2008-00123 Parcel No.: 223305000136 Site Address: 131 NE HAVEN LAKE DR TAHUYA During a routine inspection, staff from this office noted new construction to exising shed without county approval or permits. As a result of that inspection, a Stop Work notice was posted on March 6, 2008 for two carports constructed to existing shed off of each side measuring 24' x 19' 6" and 24' x 12' in the absense of a county permit. According to the Mason County Assessor records, parties named above hold legal interest in the parcel and are therefore subject to enforcement action for failure to comply. The parties shall respond to the county within twenty days of the postmark, posting on site, or delivery of the notice. Records indicate that this enforcement issue has not been resolved and is outstanding at this time. Order YOU ARE HEREBY ORDERED to abate violations in the following manner: 1) Immediately cease all construction. 2) Permit or remove the structures. 3) Contact Mindi Brock at (360) 427-9670 ext. 356 for compliance action within 21 days of the date of this letter or prior to April 4, 2008. 1 appreciate your quick response in contacting me regarding the Stop Work Notice. I explained to Mr. Ed Soden that the work conducted to the existing shed requires a building permit and that it must be removed or permitted. Mr. Soden was questioning the cost of the permit and I suggested he visit the Belfair Annex to get an estimate of cost which would then help him determine what he intends to do with the structure. He agreed to contact me with his decision. Thank you again for contacting me regarding compliance actions. I look forward to hearing from you within 21 days as to what you intend to do regarding permitting or removing the structures. Penalties This notice is to inform you that in the event that you fail to comply, we will pursue additional enforcement action against you, including but not limited to recording against the parcel, civil infractions, liens against the property through the Mason County Hearings Examiner process and/or criminal prosecution as allowed under Title 15.13 of the Mason County Code. Note that the removal, mutilation, destruction or concealment of any Notice posted on 3/6/2008 would be deemed a separate violation of Title 14. He has constructed a carport to each side of existing structure. The carport of the left(which was existing as a one bay) has now been extended and enclosed, now to be considered a garage as closed on three sides. The structure on the right side is a single bay and is also enclosed on three sides. Explained that he must permit or remove both. The left side may require engineering. He was instructed to obtain an ATF permit or remove. He had questions regarding cost of permits and I instructed him to come to the office to speak with a permit tech regarding requirements and if engineering was required. He agreed and stated that he would visit the Belfair Annex to get a rough estimate on the cost, which would then help him determine if he intends to permit or remove. See photos in file.
