She has worked on a variety of habitat restoration projects throughout the Midwest,Tennessee,and Washington. Allison earned a Bachelor of Science degree in Biology and Environmental Studies from the University of Cincinnati. She holds credentials as an ISA Certified Arborist and a Qualified Hydrologic Professional In-Training.Allison has also completed her certification in wetland delineations and watershed management. Elisabeth Gonzalez, Environmental Scientist Professional Experience: 2 years Elisabeth Gonzalez is a Wetland Scientist for DCG/Watershed. She assists in multiple consulting services including wetland delineations, permitting, critical areas reports, and biological site assessments. She earned a Bachelor of Arts degree in Environmental Science from the University of Colorado. The investigation, performed by DCG/Watershed (DCG) was limited to the property in question and the immediate surrounding area. _ CANADA U &A. The site currently contains a single-family residence(SFR),beach access stairs,a concrete bulkhead,and related utilities.The proposed project on the property includes replacement of the existing damaged bulkhead.The property falls within the jurisdiction of the Shoreline Management Act and is designated as Residential with a marine buffer of 100 feet per MCC8.52.170(C). Plans for the project can be found in Appendix I. 2 EXISTING ENVIRONMENTAL CONDITIONS 2.1 Vegetation and Habitat Features The site is located along the shoreline of Hood Canal. Upland vegetation includes a variety of landscaped deciduous and coniferous trees, shrubs,and grasses.There is a slope leading to the beach vegetated with grasses and shrubs, as well as invasive species scotch broom (Cytisus scoporius).The shoreline itself consists of large cobblestones and sand, with a wrack line of woody debris along the shoreline.The beach is sparsely vegetated with aquatic vegetation seepweed (Suoedo moritimo), however the Puget Sound Seagrass Monitor (2023) does not have any eelgrass mapped near the project area. 2.2 Surrounding Land/Water Uses The project site and all surrounding properties are residential. NE North Shore Road is directly adjacent to the east, and to the west is Hood Canal. 1 13753 NE North Shore Rd—Biological Site Assessment July 13,2023 2.3 Level of Development The project site is part of a small, low density residential community in a mildly developed area of Belfair. Most of the immediate surrounding area is zoned as Rural Residential. 2.4 Water Quality The Department of Ecology indicates the waters in the vicinity on the 303(d)list for the parameter of bacteria—fecal coliform.However,there are no impaired water directly adjacent to the proposed project area. 3 CRITICAL AREA REVIEW DCG staff conducted background research using a variety of online sources,literature,and maps to identify wetlands, streams, and site characteristics indicative of critical area features in the study area (Appendix II). Key sources of information included the following: • Department of Ecology Water(DOE)Quality Atlas and Coastal Atlas Map • Department of Natural Resources(DNR)Washington Natural Heritage Program(WNHP)Data Explorer • Mason County Critical Areas Map • National Wetlands Inventory(NWI) • Puget Sound Seagrass Monitor • Natural Resources Conservation Service(NRCS)Soil Mapper • Washington Department of Fish and Wildlife's(WDFW) Priority Habitats and Species(PHS)Mapper • WDFW Forage Fish Mapper 3.1 Fish and Wildlife Habitat Conservation Areas Puget Sound and the shoreline are considered Fish and Wildlife Habitat Conservation Areas (FWHCA) per MCC 8.52.170(b)(5). The shoreline designation for the property is Residential. The marine buffer for this shoreline designation is 100 feet, measured landward from the ordinary high-water mark(OHWM) or from the bank's most waterward edge,whichever is greater.The structural setback from the marine buffer is 115 feet. The WDFW PHS mapper(2023)does not indicate presence or habitat of any species onsite, however the potential presence of Dungeness crab(Cancermagister),oyster beds,and a"regular concentration"of Pacific herring(Clupea pallosi) are indicated with 1,000 feet of the subject parcel. No eelgrass is mapped at the project site(Puget Sound Seagrass Monitor,2023).The WDFW Forage Fish Mapper(2023)indicates a forage fish spawning area for surf smelt along the shoreline,as well as a spawning area for Pacific herring approximately 1,100 feet southwest of the subject property. Dungeness crab and surf smelt are species of local importance per MCC 8.52.170(8). The WDFW PHS mapper indicates the potential presence area for Dungeness crabs approximately 600feet west of the OHWM at the subject property. Protection measures will be implanted for surf smelt through the 8MPs listed in Section 8, including 'implementing the Agency-approved work window for the species.Therefore,the project will have no impacts on .species of local importance. Stream maps prepared by Mason County(2023) and Salmon5cape(2023) do not depict streams in or within 1,000 feet of the proposed action area.Therefore,the proposed project will have no impact on stream resources. 3.2 Wetlands Wetland maps prepared by NWI (2023) and WDFW PHS mapper(2023) depict the potential presence of estuarine and marine wetlands in the project area. No other wetlands are indicated within 1,000 feet of the project area. A site visit was completed in June of 2023 and no wetlands or suspected wetlands were found.Therefore,the proposed project will have no impact on estuarine or marine wetland resources. 2 13753 NE North Shore Rd—Biological Site Assessment July 13, 2023 3.2.1 Soils The NRCS soil survey map identifies one soil type within the subject property, which is not listed as hydric per the NRCS Hydric Soils List.The DNR WNHP Data Explorer also does not identify any hydric soils on the project site. No other geologically hazardous areas were noted on the property.A geotechnical report has been prepared for the property and can be found in Appendix III. 3.4 Frequently Flooded Areas The Mason County Critical Areas Map(2023)identifies the water edge portion of the property being located within FEMA Flood Zone AE.All work is planned landward of the OHWM in the dry and will not add any new impervious surface coverage to the site.Therefore,a Puget Sound BiOp Floodplain Habitat Assessment is not required. 4 ACTION AREA The action area is defined by the ESA regulations(50 CFR 402.02)as"all areas to be affected directly or indirectly by the Federal action and not merely the immediate area involved in the action."The action area is distinct from the project footprint and encompasses a larger area extending to where no measurable effects from the project are anticipated to occur. For this project,the action area includes the project area as described above and upland areas within which all project-related noise levels reached background levels. 5 SPECIES INFORMATION The following species listed under the federal Endangered Species Act may occur in the vicinity of the project area or might be affected by the proposed work: 1. Hood Canal Summer Chum Salmon(Oncorhynchus keta) 3 13753 NE North Shore Rd—Biological Site Assessment July 13,2023 5.1 Golden Paintbrush Golden Paintbrush(Costillejo levisecta)is a rare perennial plant native to the Pacific Northwest.It typically grows as a rosette in its early stages, forming a basal cluster of leaves close to the ground. In late spring or early summer, flowering occurs with stems that can reach a height of up to 12 inches,however flowering can begin early as February (FSW, 2023).The fruit of golden paintbrush plants is in the form of capsules,which generally reach maturity in late summer. Prior to the seed capsules maturing, seeds begin to disperse into the fall. As the plants' only means of reproduction is by seed, and they do not produce a large amount,seeds are not usually spread far from the parent plant unless assisted by wind or animals. Habitat for golden paintbrush consists of prairie and grasslands with very limited competition from trees, shrubs,or tall grasses,as the plant is very susceptible to any shade. For this reason,the paintbrush can thrive in areas recently impacted by a prescribed or wild forest fire. 5.2 Marbled Murrelet Marbled murrelets are small marine birds in the alcidae family that nest in the coastal old-growth forests of the Pacific Northwest. The breeding season of the marbled murrelet generally begins in April, with most egg laying occurring in late May and early June. By the end of August, chicks have fledged and dispersed from nesting areas (Marks and Bishop, 1999). Marbled murrelets differ from other seabirds in that their primary nesting habitat is old- growth coniferous forest within 50 to 75 miles of the coast.The nest typically consists of a depression on a moss- covered branch where a single egg is laid.When not nesting,the birds live at sea,spending their days feeding and then moving several miles offshore at night(SEI, 1999). 5.3 Yellow-Billed Cuckoo The yellow-billed cuckoo is a relatively large riparian bird that is distributed throughout the U.S., however, due to reductions in habitat, are very rare in Washington State (WDFW, 2023). Breeding season typically occurs in late spring to early summer. During this period,they tend to move around and have large home ranges but are mostly found in areas with more than 200 acres of deciduous forests(USFWS,2023).Nesting habitat usually occurs at lower elevation riparian woodlands that contain willow trees, alders, or cottonwoods that are close to streams or rivers. Though there are no recent documents of yellow-billed cuckoo nesting in Washington,it can occur anywhere in the state as much would be considered generally good habitat for nesting. 5.4 Coastal Puget Sound Bull Trout The Coastal Puget Sound bull trout population is thought to contain the only anadromous forms of bull trout in the contiguous United States (Federal Register /Vol. 64, No. 210 / 1999). Spawning occurs typically from August to November in streams and migration to the open sea (for anadromous populations) takes place in the spring. Following this season, bull trout migrate to freshwater river systems to overwinter. Bull trout prefer colder water temperatures than most salmonids, and clean water substrates for spawning and rearing.They require complex habitats such as streams with riffles,deep pools, and undercut banks. 5.5 Georgia Basin Bocaccio and Yelloweye Rockfish The Georgia Basin bocaccio is a type of large rockfish species with a long-life span (reproducing between 4-7 years old, living up to 50 years),making them particularly sensitive to overfishing.They are known to spawn in Southern California from October to July and in central and northern California from January to May(NOAA Fisheries, 2023). Bocaccio are now very rare due to past overfishing, but if found are most abundant in depths of 165 to 825 feet within rocky reefs or underwater structures(WDFW,2023).Yelloweye rockfish have similar life histories to bocaccio, with a slow growth and mature rate and a long lifespan(reproducing between 5-20 years old,living up to 100 years) (NOAA Fisheries,2023).Past overfishing occurrences have depleted populations which have not yet recovered,and Yelloweye rockfish remain rare in the Puget Sound area.Spawning patterns of yelloweye rockfish are similar to the patterns of bocaccio,occurring over a long span from winter to summer of the coast of California.Yelloweye rockfish 4 13753 NE North Shore Rd—Biological Site Assessment July 13,2023 are most abundant in depth of 300 to 600 feet and,like bocaccio,prefer rocky reef habitats at these depths(WDFW, 2023). 5.6 Humpback Whale There are at least four humpback whale populations known within the North Pacific, three of which occur in Washington(NOAA Fisheries,2023).They migrate seasonally,feeding in colder,northern waters in the summer and traveling up to 5,000 miles to warm,tropical waters to mate and calve in the winter. Humpback whales are known to make one of the largest migrations of any animal and can travel up to 16,000 miles in a single year between feeding and mating. Females reach maturity between 4-10 years old and produce one calf per pregnancy every 2-3 years.Calves stay with the mother for about a year after birth,though they usually are found in the same breeding and feeding sites as the mother well after their first year of life (WDFW, 2023). Humpback whale sightings in the Salish Sea usually occur from July-September during their journey to their northernmost feeding grounds in the Pacific Ocean.As populations have slowly been regaining the last several years,protection measures for the whales are crucial. 5.7 Streaked Horned Lark The streaked horned lark is a small,ground dwelling bird species endemic to the Pacific Northwest,specifically only found in Oregon and Washington.�'Tbey require open fields and grasslands for both nesting and foraging, as their diet consists of seeds and grasses that their beaks are well adapted to extract (WDFW, 2023). Additionally, the habitat is beneficial to find a wide range of insects that are the sole diet of the juvenile birds.Streaked horned larks' peak breeding season usually occurs from mid to late spring, with the construction of nests occurring in areas of bare ground or short vegetation. As the birds are non-migratory, they remain in the fields and grasslands unless under environmental threats such as flooding. 5.8 Puget Sound Chinook and Steelhead Trout Most Chinook in the Puget Sound are "ocean-type" and migrate to the marine environment during their first year (Myers et al. 1998).They may enter estuaries immediately after emergence as fry from March to May or they may enter the estuaries as fingerling smolts during May and June of their first year(Healey, 1982).Chinook use estuaries as rearing areas and are the most dependent of all salmon species on estuaries for survival.There are estuaries present in the action areas.The shorelines along Washington are in generally good condition for salmonid habitat. As they grow and move into neritic habitats,they feed on decapod larvae, larval and juvenile fish,drift insects, and euphausiids(Simenstad et al., 1982). Steelhead trout exhibits perhaps the most complex suite of life-history traits of any of the Pacific salmon.Steelhead can be anadromous or freshwater residents and,in some circumstances,yield offspring of the opposite life-history form.The anadromous form can spend up to seven years in freshwater prior to smoltification, although two years is most common, and then spend up to four years in saltwater prior to first spawning. Unlike the Pacific salmon species, steelhead are iteroparous (individuals can spawn more than once). The adult winter steelhead run is generally from December to February,and spawning occurs from March through June(Wydoski and Whitney,2003). Juvenile steelhead out-migrate from April through June and are not anticipated in the nearshore in large numbers because the majority of steelhead smolts migrate directly to the open ocean(i.e.,they are not nearshore dependent) and do not rear extensively in the estuarine or coastal environments(Burgner et al., 1992). Critical habitat was designated for Puget Sound Chinook salmon on February 16, 2000,and Puget Sound steelhead on March 25, 2016(Federal Register, 2016). All proposed work will occur landward of the OHWM, outside of the critical habitat for these species. 5.9 'Southern Resident Killer Whale The southern resident killer whale consists of three social groups, identified as the J,K,and L pods(NOAA Fisheries Species Information, 2023), which are known to spend more time in Puget Sound than transient orcas, travel in larger pods, and eat mostly fish(Krahn et al., 2004). Chinook salmon are particularly important in the whales'diet, 5 13753 NE North Shore Rd—Biological Site Assessment July 13,2023 which is key to understanding their migratory patterns as they tend to travel based on prey availability.Though the whales generally stay within known foraging grounds within Puget Sound,in recent years,they have been regularly spotted as far south as central California during the winter months and as far north as Southeast Alaska (NOAA Fisheries Species Information, 2023). Killer whales reach maturity around the ages of 10-12, and though breeding occurs year-round, calving usually peaks in the summer. Habitat for killer whales is wherever prey species can be found, which generally encompasses most coastal inland waters within Washington State, though they are not normally found in water with depths less than 20 feet(NOAA Fisheries,2023). 'A.10 ;Taylor's theckerspot Taylor's checkerspot is a medium-sized butterfly native to the Pacific Northwest,with 8 of its 11 known populations residing in Washington(WDFW,2023).The checkerspots are usually seen in the spring when the females emerge to lay eggs.Once the eggs hatch as larvae,they feed until early summer before entering a diapause stage for the winter, usually not re-emerging again until February to feed and find a spot to create their pupa on nearby vegetation(FWS, 2023). The pupae stage usually occurs in April or May, with metamorphosis completing in May with the butterfly emerging from the pupa to continue the cycle(Denman Conservancy,2023). As the checkerspot relies on plants such as the golden paintbrush and similar host plants preferrable for feeding and development,the butterflies can be found in similar habitats including prairies and grasslands,but can also be found coastal bluff,dunes, and balds. 5.11 Eulachon Eulachon are a smelt species in the Osmeridae family found along the western coast of the US, primarily from northern California to Alaska.Though they are an anadromous species, an overwhelming majority of 95%of their lives are spent in the ocean(NOAA,2023).Eulachon spawning occurs in freshwater rivers or streams from late winter to early spring,but is highly dependable based on temperatures,as they prefer cold temperatures from 0-10 degrees C. Following spawning,as eulachon are semelparous,most males and females will die.Once the eggs have hatched 3-8 weeks later, they will develop until becoming fry, when they start their downstream migration to the ocean. They spend about the first year of life in estuaries or nearshore areas, where they are able to find abundant food resources while they grow and develop(ADFG,2023).Once reaching maturity at age 2-5,the eulachon will typically return to their natal freshwater system to spawn. Puget Sound does not currently have any rivers hosting spawning runs of eulachon, and they appear to be rare in the area, and the only current designated critical habitat includes the Elwha River. 5.12 Green Sturgeon Green sturgeon are an anadromous fish and are among the largest and longest living species found in freshwater, living up to 70 years and weighing up to 350 pounds(FWS,2023).Spawning typically occurs in freshwater from April to July,and,unlike salmon,they may spawn several times during their long lives,returning to their natal rivers every 3 to 5 years(NOAA, 2023). Following the larval stage, where they journey downstream to the ocean to grow and mature,green sturgeon become primarily bottom feeders and have been known to migrate great distances between feeding grounds. However, they tend to travel long distances back to their natal freshwater site to spawn. The specific rivers utilized by green sturgeon for spawning in Washington State include the Columbia River and its major tributaries, such as the Snake River. These rivers provide the necessary conditions for successful reproduction, including appropriate gravel substrates for egg deposition. 5.13 Hood Canal Summer Chum Salmon Chum salmon may historically have been the most abundant of all Pacific Salmonids.They are an anadromous fish, which means they can live in both fresh and saltwater.Chum Salmon typically weighs on average 8-15 pounds and are up to 3.6 feet long with a lifespan of about 4 years (NOAA, 2023). Chum salmon have a relatively complex life history that includes spawning and juvenile rearing in rivers followed by migrating to saltwater to feed, grow,and mature before returning to freshwater to spawn(NOAA, 2023). Chum can be found in virtually every small coastal stream.In the fall,large numbers of Chum can often be seen in the lower reaches of these streams.Chum fry do not 6 13753 NE North Shore Rd—Biological Site Assessment July 13,2023 rear in freshwater for more than a few days.Shortly after they emerge,Chum fry move downstream to the estuary and rear there for several months before heading out to the open ocean(WDFW,2023). Critical habitat was designated for chum salmon on June 28, 2005 (Federal Register, 2005), and includes the nearshore marine area from the line of extreme high tide out to a depth of 30 meters (Federal Register,2005).The project is planned to occur landward of OHWM.Therefore,the project is not within the designated critical habitat for chum salmon. 6 EFFECTS ANALYSIS This section describes potential direct, indirect,and interrelated-interdependent effects of the proposed action on listed species and habitats. Potential disturbances caused by project activities are presented along with measurable indicators of habitat health. 6.1 Direct Impacts Construction activities will likely have temporary direct impacts on habitat through reductions in overall habitat quality for shorebirds,small mammals,fish,and any invertebrates/amphibians in the area. No habitat known to be used by any listed or sensitive species will be directly affected. However, sand lance and herring spawn are in the area therefore timing and other protective measures will be required to minimize and avoid impacts to the species. The project will occur within the same footprint as the existing, therefore no additional nearshore habitat will be impacted. 6.2 Indirect Impacts Likely indirect effects of the proposed action on listed species may include temporary behavioral responses to non- injurious noise from construction activities. Physical elements of habitat will not be significantly affected by the proposed action. Should ESA listed species be present they may experience some energetic cost from dispersal of prey,resulting in short-term expenditure of energy seeking other sources or browsing while waiting for prey to re- aggregate following noise effects. 6.3 Cumulative Impacts This section discusses how activities associated with the project will contribute to improvement, maintenance, or degradation of habitats used by ESA listed species in the project area. Potential disturbances caused by project activities are presented along with measurable indicators of habitat health.Net effect is considered to be the overall effect on the species and habitat in the long term. If short term adverse conditions occur when few or no listed species are present in the action area, and if those conditions are no longer present when listed species return to the area,those conditions do not constitute adverse modification of the indicator of habitat quality. Therefore, with BMPs in place, it is expected the project may affect,but is not likely to adversely affect the following aquatic species: • Coastal Puget Sound bull trout(Salvelinus confluentus) • Puget Sound chinook(Oncorhynchus tshowytscha) • Puget Sound steelhead trout(Oncorhynchus mykiss) • Hood Canal Summer Chum Salmon(Oncorhynchus keto) The subject parcel does not contain habitat that yellow-billed cuckoo (Coccyzus americanus) prefer. Additionally, nesting sites for this species have not been noted in Washington for several years.It is very unlikely that these species would be present in the action area due to this.Therefore,this project will have no effect on yellow-billed cuckoo. The project will not affect marbled murrelets(Brachyromphus marmoratus)due to the proximity of disturbance and a negligible effect on food supplies. No adverse indirect, interrelated, and/or interdependent effects of the action 9 13753 NE North Shore Rd—Biological Site Assessment July 13,2023 were identified.Therefore, it is expected that the project,with conservation measures in place,will have no effect on marbled murrelets. The project will not affect southern resident killer whale (Orca orcinus) or humpback whales (Megaptera novaeangliae) due to the absence of the species in the project area as a result of water depth. Due to the work occurring landward of the OHWM, there will be a negligible effect on food sources for these species. With conservation measures in place,it is expected that there will be no effect on whale species. The project will not affect eulachon (Thaleichthys pacificus) due to the unlikely occurrence of the species in the project area.Puget Sound does not currently have any rivers hosting spawning runs of eulachon,and they appear to be rare in the area, and the only current designated critical habitat includes the Elwha River. With conservation measures in place,it is expected that there will be no effect on eulachon. The project will not affect green sturgeon (Acipenser medirostris) due to the unlikely occurrence of the species in the project area as a result of insufficient habitat and water depth.Green sturgeons are very rare to estuaries within Puget Sound than to other estuaries across the state of Washington,so it is unlikely to come across any spawning or rearing sites within Puget Sound.With conservation measures in place,it is expected that there will be no effect on Green Sturgeon. The subject parcel does not contain riparian woodlands that contain willow trees, alders, or cottonwoods that are close to streams or rivers that streaked horned larks prefer for nesting. No habitat or sighting have been recorded near the site.Therefore,this project will have no effect on streaked horned lark. The subject parcel does not contain open grassland area that Taylor's checkerspot(Euphydryos editho taylori) and golden paintbrush(Costilleja levisecta)prefer. It is very unlikely that these species would be present in the project area due to the lack of habitat present.Therefore,this project will have no effect on Taylor's checkerspot or golden paintbrush. 8 BEST MANAGEMENT PRACTICES/CONSERVATION MEASURES The following measures and BMPs shall be incorporated by the applicant in order to avoid, reduce intensity, or otherwise minimize potential site impacts: 1. Potential adverse effects of this project on listed salmonids will be avoided or minimized through the adherence to agency-approved work windows when few juvenile salmonids are present in the action areas. 2. All construction debris will be collected and not allowed to reenter waters of the state. 3. The contractor will prepare a spill prevention control and countermeasures plan. 4. If debris or spill material accidentally enters the waterway,immediate actions will be taken to remove the material,and proper entities will be notified. 5. Care will be taken in all work to prevent debris,oils, and grease from entering the water. 6. All debris or spill material will be properly disposed of at an approved off-site disposal facility. 7. Refueling will be conducted away from the project site in accordance with the Washington State Department of Ecology. 8. All equipment will be checked daily for leaks and any necessary repairs will be made prior to commencement of work. 9. If fish are observed to be in distress or if a fish kill occurs,work will be stopped immediately. USACE and WDFW will be contacted by the applicant and work will not resume until approval is given by all of these agencies. 10 13753 NE North Shore Rd—Biological Site Assessment July 13,2023 9 REGULATORY SUMMARY The project will occur on a private parcel located landward of OHWM in Mason County. OHWM was investigated during the June 2023 site visit and was determined at the face of the existing bulkhead. Agencies that will have jurisdiction and will require protection measures include Mason County, the Washington Department of Fish and Wildlife,and the Department of Ecology. 10 BIOLOGICAL SITE ASSESSMENT CONCLUSION Based on the analysis of this document, the project development is unlikely to cause a significant impact on any critical areas or species as long as the recommended BMPs are followed.The discussion areas above conclude that all species were given a no effector not likely to adversely affect determination.The project development is planned landward of the OHWM and is unlikely to cause a significant impact on any critical areas or species.
