Applicant. The Applicant is Thomas Crosswhite. 19 2. Hearing. The Hearing Examiner conducted a hearing on the application on December 11, 2007 at 1:00 p.m., in the Mason County Board of Commissioners 20 Meeting Chambers. 21 Substantive: 22 3. Site/Proposal Description. The applicant seeks a special use permit to 23 designate an existing 900 square foot dwelling an ADU. The proposed ADU is located upon a two-acre lot. A primary dwelling of 3,552 square feet is planned for 24 the lot. 25 4. Characteristics of the Area. The site is located in an area designated as In- holding Lands and Long Term Commercial Forest. Residential Development is SUP for ADU P. 1 Findings, Conclusions and Decision {PA0682644.DOC;1/13009.900000/) located to the north, south and east. Forest lands are located to the immediate west. l All surrounding lots are greater than two acres in size. 5. Adverse Impacts of Proposed Use. There are no adverse impacts 3 discernable from the record. There was no public testimony against the project. The large lots and forest lands that characterize the area buffer any adverse impacts 4 created by the added density. Septic and building permit requirements will take care of health and safety issues. The ADU and primary residence will be connected to an 5 approved water system. 6 CONCLUSIONS OF LAW 7 Procedural: 8 9 1. Authority of Hearing Examiner. MCC 15.03.050(J) provides the Hearing Examiner with the authority to review and act upon special use permit applications. 10 Substantive: 11 12 2. Zoning Designation. The subject site is designated In-Holding Lands. 13 3• Review Criteria and Application. MCC 1.03.029 governs ADUs in rural lands. MCC 1.03.029 not only sets forth criteria for ADU approval, but also provides 14 that the same is subject to a special use permit. As noted above, the Hearing Examiner reviews and acts upon special use permit applications pursuant to MCC 15 15.03.050(J). The review criteria for a special use permit application are governed by 16 MCC 1.05.044, which are quoted and addressed below. 17 SPECIAL USE PERMIT 18 MCC 1.05.044(A): That the proposed use is not detrimental to public health, safety 19 and welfare. 20 4. As determined in the findings of fact, no potential detrimental effect has been identified for the project as conditioned. 21 MCC 1.05.044(B): That the proposed use is consistent and compatible with the 22 intent of the Comprehensive Plan. 23 5. The Housing chapter of the Comprehensive Plan (Chapter V) promotes 24 affordable housing and innovative housing techniques to further affordable housing. ADUs further these policies. 25 MCC 1.05.044(C): That the proposed use will not introduce hazardous conditions at the site that cannot be mitigated through appropriate measures to protect adjacent properties in the community at large. Septic regulations will adequately address sanitary waste. MCC 1.05.044(D): That the proposed use is served by adequate public facilities which are in place, or planned as a condition of approval or as an identified item in 4 the County's Capital Facilities Plan. 5 7. An approved water source is already available for the ADU and the 6 proposed primary residence. The property is currently under review for septic. It is unclear whether the septic under review is for the ADU or the proposed primary 7 residence. According to staff, the ADU is preexisting with an existing septic . Therefore, the septic under review is for the proposed primary residence. The 8 currently existing septic system meets County standards. The project will be 9 conditioned on County approved septic prior to issuance of building permits. 10 MCC 1.05.044(E): That the proposed use will not have a significant impact upon existing uses on adjacent lands. I1 8. As noted in the Findings of Fact, there are relatively large lots surrounding 12 the proposal buffers against any significant impacts created by the added density. As also noted previously, septic and building permit requirements will adequately 1 address any other adverse impacts that could affect adjoining properties. 14 MCC 1.05.044(F): If located outside the urban growth area, that the proposed use 15 will not result in the need to extend the urban services. 16 9. There will be no need to extend urban services. Water and sanitary waste 17 will be addressed as previously discussed. 18 MISCELLANEOUS CRITERIA FOR ALL HEARING EXAMINER REVIEW 19 MCC 15.09.055(C): Required Review: The Hearing Examiner shall review proposed development according to the following criteria: 20 21 1. The development does not conflict with the Comprehensive Plan and meets the requirements and intent of the Mason County Code, especially Titles 6, 8, and 16. 22 2. Development does not impact the public health, safety and welfare and is in the public interest. 23 3. Development does not lower the level of service of transportation and/or neighborhood park facilities below the minimum standards established within the 74 Comprehensive Plan. 2a 10. As noted previously, the project is consistent with the Mason County Comprehensive Plan. As conditioned, the project will generate no significant adverse impacts and, therefore, does not impact the public health, safety and welfare and is in SUP for ADU p. 3 Findings, Conclusions and Decision (PAO682644.DOC;1/13009.900000/) the public interest (since it promotes affordable housing). The proposal will involve 1 building and septic permits (apparently already issued for the ADU), which will ensure consistency with Mason County development standards. As noted in the staff report, the project is also consistent with MCC 1.03.029, which imposes specific 3 requirements for accessory dwelling units. The project does not involve any subdivision of land and is not subject to any subdivision standards. The project is 4 exempt from review under the State Environmental Policy Act. An accessory dwelling unit is not anticipated to violate level of service standards for park or 5 transportation facilities. 6 DECISION 7 The Hearing Examiner approves the requested Special Use Permit subject to the 8 conditions recommended by staff and the following: 9 1. Introduction. This report evaluates a proposal for the designation of an existing dwelling as an accessory dwelling unit (ADU) of approximately 900 square feet. The proposed primary dwelling to be built on the parcel will be approximately 3,552 square feet in its overall footprint area when completed. If approved, the newly constructed primary residence will be located 150 feet from the existing dwelling(Attachment 2). References to County Ordinances are as approved. Staff recommends approval of the Special Use Permit as conditioned. II. Applicant. Thomas Crosswhite. III. Property Location. NE 201 Ranch Drive, Belfair, WA 98528. Parcel # 22329- 34-90020. IV. Project Description. The proposal is to construct a 3.552 square foot primary dwelling and designate the existing 900 square foot dwelling as an accessory dwelling unit on the parcel. The distance between the existing residence and the proposal new single-family residence is approximately 150 feet. See site plan (Attachment 2). V. Evaluations. A. Characteristics of the site. The lot is approximately 2.00 acres in size and is surrounded by residential development to the east and west on lots of generally larger areial size. The surrounding property to the north, south and east is designated as In-holding Lands. Property immediately to the west is designated a Long Term Commercial Forest. On site development includes a single-family residence (900 sq. ft.) a well, and septic system. B. Characteristics of the area. The site is located in an area designated as In-holding Lands and Long Term Commercial Forest. Residential development is located to the north, south and east. Long Term Commercial Forest land is located to the immediate west of the subject parcel. There should be little impact CROSSMITE DDR2007-00310 Page 1 of 4 to the neighboring parcels with this proposed ADU due to parcel sizes generally greater than 2 acres in the immediate residential development area. C. Shoreline Designation. Not Applicable. D. Comprehensive Plan Designation / Zoning. The Mason County Comprehensive Plan designation for the site is In-holding Lands. VI. SEPA Compliance. Project is SEPA exempt per WAC 197-11-800 (1)(b)(i). VII. Other Permits/Approvals. The proposal will require Mason County Building Permit for the residential (ADU) construction. Environmental Health Department will need to approve the septic system and well prior to building permit issuance. A Notice of Application and Public Hearing (Attachment 3) was posted in the Shelton-Mason County Journal. Notice was posted on site and mailed to neighboring properties. No comments have been received to date. Vill. Analysis. This proposal requires a Special Use Permit due to the requirements of the Mason County Development Regulations, dated February 28, 2006, section 1.03.029. Applicable Development Regulations as listed under section 1.03.029 A. are: A. The ADU shall be subject to a special use permit, unless in the shoreline jurisdiction it is subject to a shoreline permit. Applicant has applied for a Special Use Permit. B. The owner of the ADU must reside on the lot in either the principal residence or ADU. The owner resides in the principal residence and a relative will reside in the ADU. C. The ADU shall be located within 150 feet of the principal residence or shall be a conversion of an existing detached structure (i.e. garage). The proposed ADU is 150 feet from the principal residence as scaled from the submitted site plan. D. The ADU shall not exceed 80% of the square footage of the habitable area of the primary residence or 1,000 square feet, whichever is smaller. E. All setback requirements must be met by the ADU. The proposed ADU is 924 square feet. The primary residence is 1,566 square feet. Eighty percent of that size would be 1,252 square feet. The proposed ADU meets the size requirements. F. All applicable health district standards for water and sewer must be met by the ADU. The ADU will be connected to an approved two-party water system (permit WEL2007-00059). The Environmental Health Department is currently reviewing the septic system. The building permit will not be issued prior to this approval to ensure the proposal meets all health district standards. G. No recreational vehicles shall be allowed as ADUs. CROSSWHITE DDR2007-00310 Page 2 of 4 The proposed ADU is a manufactured home and not a recreational vehicle. H. Only one ADU is allowed on any property. Only one ADU is requested. I. An additional off-street parking space must be provided for the ADU. Additional parking has been provided for as indicated on the site plan. Staff Response: The ADU as proposed meets all of the above criteria A — I. Applicable Special Use review criteria: See the applicant's answers to these criteria, marked (Attachment 1). A. Will the proposed use be detrimental to the public health, safety and welfare? Staff Response: The placement of the ADU meets all county setbacks and assures adequate off street parking. No potential detrimental effects have been identified. The ADU will be connected to an approved water system (WEL2007- 00059) and the septic system is currently under review by the Environmental Health Department and a permit will not be issued until this system meets all health district standards. B. Will the proposed use be consistent and compatible with the intent of the Comprehensive Plan? Staff Response: There do not appear to be any conflicts with the County Comprehensive Plan. Section H-109 states "Mason County should provide for accessory dwelling units in any district which is otherwise restricted for use only to single family dwellings."Mason County Code Rural Residential 5 zoning does allow for one accessory dwelling unit per parcel. The applicant resides on the parcel. C. Will the proposed use introduce hazardous conditions at the site that cannot be mitigated through appropriate measures to protect adjacent properties and the community at large? Staff Response: No hazardous conditions would be expected as a result of the proposal. All construction will be to County code and per the submitted site plan meets all required setbacks. D. Is the proposed use served by adequate public facilities, which are in place, or planned as a condition of approval or as an identified item in the County's Capital Facilities Plan? Staff Response: The ADU will be connected to an approved water system (WEL2007-00059) and the Environmental Health Department is currently reviewing the septic system. A building permit will not be issued until this system meets all health district standards. The existing driveway accesses the proposed ADU and parking space is identified on the site plan. E. Will the proposed use have a significant impact upon existing uses on adjacent lands? Staff Response: It appears there will be no significant impact upon existing, adjacent land uses. Adjacent land uses are residential. Adjoining parcels tend to be larger in area than the subject parcel. No comments have been received from neighboring properties. Staff Response: The addition of a single-family residence would not result in a need to extend urban services. The current residence is accessed via NE Ranch Road (county road). IX. General Review Criteria Mason County Code 15.09.055(C) A. The development does not conflict with the Comprehensive Plan, and meets the requirements and intent of the Mason County Code, especially Title 6, 8, and 16. The proposal does not conflict with the Comprehensive Plan. The proposal meets the requirements of Title 6. The ADU will be connected to an approved water system (WEL2007-00059) and the septic system is currently under review by the Environmental Health Department. A building permit will not be issued until this system meets all health district standards. Regarding Title 8, the proposal does not lie within any critical area or its buffer. The proposal is SEPA exempt per WAC 197-11-800 (1)(b)(i). Title 16 does not apply. B. Development does not impact the public health, safety and welfare and is in the public interest. The proposed ADU will be constructed to current county code, meets all required setbacks and will meet all health district standards prior to building permit issuance in order to address public health, safety and welfare issues. C. Development does not lower the level of service of transportation and/or neighborhood park facilities below the minimum standards established within the Comprehensive Plan. The proposed residence will not lower the level of service of transportation and/or neighborhood park facilities below the minimum standards established within the Comprehensive Plan. The proposed is for a single-family residence within In-holding Lands. X. Conclusions. As designed, the project is consistent with the Mason County Development Regulations. Staff recommends approval with conditions. XI. Conditions. 1.The owner shall reside in either the principal residence or the ADU. 2.Approved per dimensions and setbacks on submitted site plan. Setbacks are measured from the furthest projection of the structure. XII. Choices of Action. 1. Approval of the SUP request. 2. Denial of the SUP request. 3. Conditional approval of the SUP request. 4. Postpone the decision for further information.
