Both culvert replacement proposals meet the criteria for exemption from the permit requirements of the Mason County Resource Ordinance. The specific exemption is "G" of Section 17.01.130, General Exemptions, which allows for"maintenance, operation, reconstruction of, or addition to, existing roads, streets, and driveways, provided that reconstruction of, or addition to, any such facilities does not extend outside the previously disturbed area.". In addition, the activity is exempt from the provisions of the Mason County Shoreline Master Program, per Section 7.13.010, (2),normal maintenance or repair of existing structures. Since this activity does not require a U.S. Army Corps of Engineers permit, Mason County is not required to issue a specific Shoreline Exemption document(See WAC 173-27-050,(1)). If you have any questions or require clarification regarding this determination, please contact me.
