will find comments made regarding the proposed development and its critical values.
In some cases, setbacks for development from shorelines, steep slopes, streams, and wetlands must
be included in your specific proposal; these setbacks are included as part of the comments listed
below.
This information is based on County and State regulations as they exist to date. These regulations
may change and may affect the requirements for development of the subject property.

Comments: Pre-inspection for Don Bocksch:
Zoning / General Info: Rural Residential 5 zoning designation.
Standard building setbacks for this zoning are 20-foot side and
rear setbacks with a 25-foot front yard setback. The exception to
this standard is for lots under one acre and less than 100-feet in
width, in which case the side yard setback is equal to 10% of the
lot width. Other setbacks can apply when critical areas are
present such as streams, wetlands, steep slopes etc. The
Shoreline (SMA / SMP) designation is Urban.
The review included evaluating requirements for work within the
Mason Lake shoreline buffer, including repair/ reconstruction of a
shoreline bulkhead, which has partially failed, removal of a
shoreline deck, removal and reconstruction of paved / concrete
stairs, grading, and construction of a retaining wall. Note retaining
walls must be under 30-inches above grade per the Mason
County Shoreline Master Program (SMP). Retaining walls or other
structures that require a Building Permit (within the shoreline
buffer, with the exception of normal protective bulkheads) would
also require a Variance from the Mason County Resource
Ordinance, section 17.01.110. Small landscaping walls (1 - 2
feet tall normally do not require a Building Permit. The permits /
reviews required for this work would be SEPA review for the
bulkhead work, a demolition permit for the deck removal, a Mason
Environmental Permit for non-exempt work (grading, retaining
walls, impervious surfaces etc. within the shoreline buffer/
setback, a Habitat Management Plan (HMP) to evaluate work in
the shoreline buffer (note: enclosed list of wetland consultants,
many of whom provide HMP related services). The bulkhead
repair will also require a Shoreline Permit Exemption (JARPA
application), and Mason County Building Permit. The enclosed
JARPA application also needs to be forwarded to WA Dept. of
Fish and Wildlife and the US Army Corps of Engineers for review
(addresses at back of JARPA form).
Shorelines: The first 15-feet between the home and lake
constitutes a building setback area, with the remainder between
the home and lake a natural buffer (approximately 40-50 feet).
Existing improvements / structures within the buffer and setback
area which existed prior to current buffer requirements under the
Mason County Resource Ordinance may be continued, repaired
etc. New structures, uses, improvements, grading, clearing,
altering of vegetation, addition of impervious surfaces etc. must
meet current standards (see Resource Ordinance, section
17.01 .110, F. and G. in particular, also section J. regarding

requirements for a Mason Environmental Permit and Habitat
Management Plan.
Stairway: Unpaved 3-foot wide walkways (paths) are permitted in
the shoreline buffer without a Mason Environmental Permit and
Habitat Management Plan (including wooden stairways up to
4-feet in width if needed due to steep slopes). However a paved
path, retaining walls etc. would require these permits and reviews
as well as grading, excavation, removal or filling of material within
the shoreline buffer/ setback area.
Bulkhead: A small section of the bulkhead (15-feet plus or
minus) has collapsed. The remainder appears relatively solid,
however may at some point collapse due to poor initial
construction. The Mason County Shoreline Master Program
provides that bulkheads may be repaired within 5-years after
decay or partial destruction. The Mason County Resource
Ordinance, section 17.01.110 F.1. also provides a two year
window for the reconstruction of structures destroyed by fire or
other means within Fish and Wildlife Habitat Conservation Areas,
including shoreline buffers. It appears that the portion of the
bulkhead on-site, which has collapsed, would qualify for this
provision. Generally it is encourage that shoreline bulkhead
construction follow WA Fish and Wildlife standards
[INTEGRATED STREAMBANK PROTECTION GUIDELINES,
April 2003] available on-line at

Permits / other information: It may be most effective to review the
entire project under one Mason Environmental Permit and Habitat
Management Plan to avoid duplication of efforts / fees etc.,
although only the bulkhead portion requires review through SEPA
(environmental checklist). Staff spoke with the County Treasurer
about a contact person or office regarding the adjacent County
property and informed that the County Commissioners Office
should be contacted about this. Their phone number is 360
427-9670 ext. 419.
