A covered patio would have to meet those same shoreline setbacks, as well as your roofline or any decks.In order to go closer to the lake with any structures, an approved Shoreline Variance would be required.A Shoreline Variance entails a public hearing process and the Hearing Examiner actually makes the Decision to approve or deny the Variance, rather than staff. Administrative Variances,where you are proposing to move closer to the road than 25' or down to the minimum 5' side yard setbacks, are reviewed by staff. Grace >>> P CM <millerbash@gmail.com> 5/10/2016 9:54 AM >>> Grace the end of last year sometime you gave me a footprint to build.I found a plan that fits for the structure but wanted to build a covered patio.The home structure fits the footprint and want to start designing the building to put out to bid but do not know if a variance would be allowed closer to the lake for the covered patio it would be in the middle of the building for the most and then tying in maybe to the smaller porches on each side of the structure.The plan can be looked up on Alan Mascord designs plan #1148. I was told by a gal at the county to talk to you.You do variances permits too,I think that is the permits name? The minimum shoreline setback for all portions of a new residence,including decks and rooflines is 52'to 53'from the ordinary high water mark.(OHWM).It is 53'near the residence and north property line and 52'near south property line and adjacent Rv's.The shoreline setback was determined by drawing a line between the residence on the adjacent lot to the north,across the applicants property,to an approximate average line to the three RV's on the lot to the south,that are set up like residences.No portion of the new residence may project closer to the shoreline of Timberlake.The residence cannot be placed at the 45'from the OHWM that was indicated on the submitted site plan because it is too close to the lake. The Mason County Resource Ordinance also regulates development within 200'of Timberlake.This area is considered a Fish and Wildlife Habitat Conservation Area Staff explained the requirements for the buffer while on site.The area between the lake and the proposed development is considered to be a shoreline buffer.This area is parallel to the shoreline and 37 to 38'in depth.The intent of a shoreline buffer is to retain or enhance this area with a variety of native vegetation for fish and wildlife habitat.The proposed vegetative enhancement should become well establlished and maintained so that it acts as a buffer. There is an existing concrete block bulkhead at the OHWM that was installed to replace a railroad tie bulkhead without permits.As requested by staff,the applicant submitted photos of the pre-existing railroad tie bulkhead as evidence.No further enforcement action will be taken by Mason County. The property is located within the Rural Residential 5(RR5)Zonining.The parcel is 65'in width as indicated on the submitted site plan.Therefore,the minimum side yard setback for all portions of the new structure to the side property lines is 6.5'or 10%of the width of the lot. The minimum front yard setback from the road right-of-way is 25'.These setbacks are measured to all portions of the structure including rooflines,decks,steps,heat pumps,propane tanks,etc.The maximum height of all structures is 35'above grade. The large fir trees within the shoreline buffer have been determined to be danger trees to a new residence.The applicant has obtained an approved Mason Environmental Permit to remove the large fir trees and re-plant the buffer with native vegetation as proposed within the site plan that was approved for the Mason Environmental Permit.
