Description of Proposal: Proposal to construct a 6' x 50' pier, a 4' x 40 aluminum ramp and
an 8' by 16' float. The structure will extend 100' into the Hood
Canal. The pier will have two foot wide grating installed down its
middle (60% open area). The float area will have 50% of its area
grated. The proposed structure will be supported by ten ACZA
treated pilings. Three of the existing nine pilings at the site will be
removed, cut into 4' lengths and disposed of at an approved
disposal site.

The Lead Agency for this proposal has determined that it does not have a probable significant
adverser impact on the environment. An Environmental Impact Statement (EIS) is not required
under RCW 43.21 C.030(2)(c). This decision was made after review of a completed
Environmental Checklist and other information on file with the Lead Agency. This information is
available to the public upon request. MITIGATED MEASURES ARE ATTACHED.

This DNS is issued under 197-11-340(2), the Lead Agency will not act on this proposal for 14
days from the date below. Comments must be submitted to Diane Marcus Jones, C/O Mason

CONDITIONS OF THIS DETERMINATION
1) The pier, ramp, float, and associated moorings shall be located to avoid shading of
eelgrass and other aquatic vegetation.X
2) Floatation for the structure shall be entirely enclosed and contained to permanently prevent
the breakup or loss of the floatation material into the water.

3) Residential developers and individuals shall be required to control erosion during
construction. Removal of vegetation should be minimized and any areas disturbed should
be restored to prevent erosion and other environmental
impacts.X
4) Debris or deleterious material resulting from construction shall be removed from the beach
area and project site and shall not be allowed to enter waters of the State.

5) Water quality is not to be degraded to the detriment of the aquatic environment as a result
of this project. X
6) Recreational piers shall be no higher than 11 feet above mean higher high water. Piers
and docks shall have at least an eight foot span between pilings.

7) The surface of floating structures shall be a minimum of eight inches about the surface of
the water.X
8) All floating structures shall include intermittent supports which run parallel to the shoreline
to keep structures off the tidelands at low tide.X
9) The proposed project must be consistent with all applicable policies and other provisions of
the Shoreline Management Act, its rules and the Mason County Shoreline Master Program.

10) All other necessary permits from Mason County, Washington State and/or Federal
Agencies that are required for this proposed development and construction must be
obtained PRIOR TO SAME DEVELOPMENT AND CONSTRUCTION (Dept. of Fish and
Wildlife, US Army Corps, DOE Water Quality Concurrence).

11) The proposed dock shall comply with all conditions of the WDFW HPA and US Army Corps
permits that are required for this project.

12) Per the Shoreline Master Program, the total length of the proposed project shall not extend
waterward further than either 100 feet or minus 3 tide, whichever is more landward.

Dear Ms. Marcus Jones:
Thank you for the opportunity to comment on the mitigated determination of nonsignificance for the
replacement pier,ramp and float(#SEP2003-00058)located at 11170 East State Route 106,Union, as proposed
by Gordon Kauhanen. We reviewed the environmental checklist and have the following comments:
Shorelands
I appreciate the revisions to this proposal reducing the length of the proposed dock thus triggering a Shoreline
Substantial Development permit but not a shoreline Variance. However,I would like to point out that absent
documentation,including permits,approving the dock described in the submitted documents the previous
structure is not considered a legal pre-existing use. Therefore this proposal is a new dock and is not a
replacement dock with reduced impacts as seems to be stated in the Biological Evaluation.
On the upland end of the pier, is the applicant concerned with security issues that will require any sort of gate?
The pier ends directly adjacent to Highway 106 and any work done on the upland end will need to be described
as part of this permit.
