This report will address the prior removal of vegetation within a Fish and Wildlife Habitat Conservation Area Buffer and corrective action to comply with Mason County Code (MCC). The owner intends to reserve a small portion of the lot within the buffer for recreational use and access to the shoreline. In this report are findings, conclusions, and recommendations regarding the following: • Site description and areas of assessment. • Background information, research, delineation, and identification of regulated critical areas and fish and wildlife habitat on-site and within the project vicinity. • Existing conditions site maps of the subject property detailing critical areas Identified on-site with standard buffers and setbacks. • Site plan with location of the proposed buffer modifications. • Best Management Practices The following imagery and arial view of Panther Lake displays the location of the subject parcel and Panther Lake boat launch located on Mason County side of the lake. (Lakeview Planting Area) Methods Data Review Research was conducted of existing information on shoreline buffers, potential wetlands, streams, and other waterbodies that are documented within the project area vicinity. Search for pertinent and applicable data and maps consisted of a review of information from the United States Geological Survey (USGS), the Washington Department of Fish and Wildlife (WDFW), the United States Fish and Wildlife Service (USFWS) and the Washington State Department of Ecology. Additional information was obtained from Mason County ArcGIS mapping and the Mason County Shoreline Management Plan, Mason County Conservation District and the Hood Canal Enhancement Group, Salmon Center. Prior communications between the property owner and Mason County were also reviewed. Field Investigation In September 2023, this parcel was investigated for the presence of regulated critical areas not identified by outside sources.The site was walked to identify potential jurisdictional fish and wildlife habitats that would be regulated under the Mason County Code (MCC), state and federal agencies.Special consideration was given to areas where project activities may come within proximity to forested areas, and fish and wildlife habitat conservation areas, and their buffers. Shoreline Restoration Goals 1. Protect unique shoreline features and habitat that supports threatened species and maintain and/or enhance their ecological function. 2.Where feasible, improve connectivity between shoreline habitat areas and functional areas of native habitat. 3. Encourage good shoreline stewardship and voluntary habitat restoration efforts by shoreline property owners. Site Vicinity & Conditions Vicinity Panther Lake is a large freshwater lake located in both Mason and Kitsap Counties, of Washington State. Located at an elevation of 501 ft. and at the size of 100.9 acres, Panther Lake has residential zoning and also public access is maintained by Washington State Department of Fish and Wildlife(WDFW). The Mason County subject parcel 12306-50-01002 is a 0.65-acre parcel zoned "undeveloped" land.This parcel is located on Panther Lake and is part of the Panther Lake Tracts: Blk A and is identified as TR 2 S 45/134. This platted parcel is in a residential zone on a lake predominated by residential development, including residential docks.This parcel is accessible from NE Bear Creek Dewatto Road via an existing gravel driveway. There is a current, updated, and approved Mason County Road access permit on file with Mason County Public Works Department for modifications to the parcel access to bring it up to county standards for width and location. This parcel has an existing driveway, parking area and dock and was cleared at the same time as the subject parcel. There is currently a well house located on the parcel that supports a 2 party well capability for both parcels. Additional neighboring properties further to the west are of a relatively similar shape and size and are zoned both "residential"or"undeveloped land".To the east are two privately owned parcels.They are 4.5 and 32.7-acre in size both parcels are zoned as "Forestry". The following arial map shows Panther Lake with both the Mason and Kitsap County Boundaries, also displayed are previously referenced parcels within Mason County boundaries. These parcels are also accessible by NE Bear Creek Dewatto Road or NE Panther Lake Road. (See Figure 3 Proposed Project Site Plan). Developments include permitting road access utilizing an existing driveway, logging with slash piles, a joint well was dug and capped in 2018 on the subject parcel, and a joint well house was constructed on the adjacent parcel to the west of the subject parcel. (See Appendix A: Site Photos) The original septic design was completed and approved in 2018, and an updated design is pending approval of this restoration plan. A design for power installation requirements fortwo services;the residential primary service and separate well service have been completed and approved by PUD-3. In 2017 partial installation of power lines were terminated at a transformer pole location on the North side of Bear Creek Dewatto Road by PUD 3 and is currently awaiting on parcel installation to complete the updated power design. In addition, from the upland terrace, there is a flat depressional area with slight slopes to the north / northwest of the property towards the water. (See Figures 4) Figure 5, displays the topography of the shoreline buffer and setback area. There are no wetlands identified within the subject parcel itself. The National Wetlands Inventory (NWI) was established by the U.S. Fish and Wildlife Service (Service) to conduct a nationwide inventory of U.S. wetlands to provide biologists and others with information on the distribution and type of wetlands to aid conservation efforts. Rare Plants No rare plants were observed on-site or within the immediate vicinity, nor are they shown to be in the area by the Washington Department of Natural Resources Natural Heritage Program. The Washington Department of Natural Resources' Natural Heritage Program maintains a database of the documented locations of rare species and rare and/or high- quality ecosystems that occur in the state. Soils (Well Log) Water Well Report WE29401 for Well ID Tag No. BKH579 was filed with Washington State Department of Ecology(SWRO)in June 2018.The Water Well Report documents soil types in each stratum from 0-476 feet at the well head location on the subject parcel. Each Stratum penetrated is documented with material description, color, character, size of material and structure. (see Appendix C) Priority Habitat Species (WDFW) Washington Department of Fish and Wildlife (WDFW) Priority Habitat Species(PHS) database does not list the presence of any protected species within the vicinity of the subject parcel. Ordinance number 17-02, amending the Mason County Resource Ordinance 77-93, Fish and Wildlife Habitat Conservation Areas states the listed protected species of importance that may occur in Mason County. None of these species have been identified in Panther Lake. Panther Lake has been historically stocked with rainbow trout by the Washington State Department of Fish and Wildlife on a yearly basis. Unlike most salmon, steelhead can survive spawning, and can spawn in multiple years. Rainbow trout are the most common and hence most popular species of trout in Washington.There are thousands of wild populations statewide but the main reason for their popularity is that the Washington Department of Fish and Wildlife stocks millions of rainbow trout every year across the state for the specific purpose of providing recreational angling opportunities. Rainbow trout are an excellent game fish for their willingness to bite bait and lures,their scrappy nature when on the end of a fishing line, and the fact that they are excellent table fare. Steelhead are also highly regarded game fish, and the steelhead is the state fish of Washington. Largemouth bass (Microptems salmoides) a fhurrie Rover - (I,SFIVA Photo by Largemouth bass Category: Fish Common names: Black bass, Brown bass, Green bass, Widemouth bass, Bigmouth, Bucketmouth, Black trout Largemouth bass is a member of the sunfish family,though larger than those species considered "panfish". Together with six other species of bass,they make up the group typically known as the black basses. Other than the largemouth,the only other member of the black basses in Washington is the similar looking smallmouth bass Micropterus dolomieu. Largemouth bass are less "flattened" and are longer than other sunfishes. They usually have a general greenish-black color to them,with a prominent dark horizontal band along their midline,whereas smallmouth bass are more of a brownish-green color with subdued dark vertical bands. Also,with their mouth closed, the maxillary(upper lip) of the largemouth bass extends fully past their eye,whereas in a smallmouth bass, it will reach only the middle of the eye.Average 12-15 inches. Largemouth bass can grow 17-20+ inches in quality populations. Contrary to popular belief,there is little difference in the growth or size of bass between eastern and western Washington. Vegetation The following vegetation has been identified both along the shoreline and in the upland zones of the said parcel. See table 4 and 5. An area within the shoreline buffer will be defined for recreational use by the property owner, will incorporate an unpaved trail and low growing vegetation. Existing logs and debris on site are proposed to be removed and/or used for personal use of the property owner.The planting will occur within four zones, each having plants ideal to that specific area. • Habitat Restoration Area Total: 10,300 sq.ft. Zone 1: 7,000 sq.ft. (East Planting Area) Zone 2: 450 sq.ft. (SW Planting Area) Zone 3: 1,000 sq.ft. (Path Area) Zone 4: 1,850 sq.ft. (Lakeview Planting Area) The estimated start of shoreline buffer enhancement is slated for the upcoming 2024-2025 planting season, winter dormancy periods into early spring and fall. Ideally all species to be transplanted will be placed between October and March, the optimal time for planting is from February to March, though planting can begin as early as October. Cooler and wetter weather is preferred to ensure optimal survival of all plants.All measures should be taken to avoid shock to the immature plants and that the plants do not die out after installation. Temporary irrigation measures may also be necessary.Removal of woody debris piles and logs within the cleared area on site may occur at anytime. The outcome of the proposed plantings will be to achieve increased tree, sapling, shrub, and herb density on site for the foreseeable future. The proposed enhancement measures will also provide for increased capture of stormwater and runoff when plants mature and establish their respective root systems.The combination of plants proposed(see Table 7)will also provide for increased canopy habitat similar to other areas within the vicinity that remain fully vegetated. Trees will be spaced 10-foot on center as a minimum standard, shrubs five (5)-foot on center, herbs four(4)-foot. A conceptual Planting Plan designed with assistance from Hood Canal Salmon Enhancement Group is available in (Figure 7: Shoreline buffer Planting Zone).and (Table 7: Plant List for Restoration Plan) Plant quantities listed in this report are estimates derived and careful review of conditions within the site and calculation of the maximum number of plants that will fit within the proposed restoration area based on minimum plant spacing requirements per plant type. If the species listed within this report are not available, substitutions must be similar in nature providing the same habitat benefit as those proposed. Alternative species are listed in the Planting plan. All plant materials used for the enhancement actions will be nursery grown stock from a reputable local source or from Mason County Conservation District or a referred entity. Native species are to be used; existing native seedling from said parcel may be used. Plant material provided will be typical of their species or variety; if not, they will exhibit normal densely developed branches and vigorous,fibrous root systems. Plants will be sound, healthy, free from defects and all forms of disease and infestation. Invasive Species Invasive vegetation will be removed from the restoration area and continue to be removed as they are established.Washington State-listed or county-listed noxious weeds observed in any area of the mitigation site must be eradicated with no part of the plant remaining. Non-native species will include less than 10% cover in the mitigation area during the monitoring period. Due to the ecological sensitivity of the enhancement area, use of pesticides for noxious weed control should be avoided.Continued manual removal is the appropriate course of action for this area. Prior to planting,the monitoring for invasive and nonnative species within the enhancement area will be conducted and overseeing for any surface preparation will take place for planting. Care should be taken to avoid disturbing any native seedlings that are reemerging. Installation This action may also be performed by the client or a specialist. Holes for each plant will be dug individually and will be two to three times the width of the container. Mixing compost to the soil placed back into the holes will help to ensure retention of moisture for the plants. Mulching around installed trees and shrubs is also recommended. Maintenance Maintenance of the enhancement area should consist of all actions necessary to promote survival of the planted native vegetation. Actions may include irrigation during the dry season, mulching,fertilizing and similar measures. Broadcast fertilization, however, will not be used. Client Responsibility Client will monitor growth and adhere to best management practices outlined within this report. Best Management Practices Where not otherwise required, Mason County encourages the use of best management practices that are part of site preparation, development construction, and use activities after construction: erosion and sediment control measures; maintain existing vegetation and minimize site clearing; use native plants in landscaping rather than lawn areas; control runoff to small ponds and buffer vegetation; and minimize use of fertilizers and chemicals in property maintenance (pest, weed, and moss control; sealants, oils, and fuels). Monitoring The annual Monitoring Report should include a brief letter that consists of a summary of actions taken and associated maps and pictures, and other information deemed necessary by Mason County. It is suggested that monitoring occur in late summer or early spring as these are the ideal time of year to assess the health of the plantings. The annual monitoring reports should include the following minimum information: a. Observations of species survival. b. The use of the site bywildlife species. c. Any disturbance caused bythe development and its effect on protected zones and associated aquatic habitat. d. Any occurrence of exotic species and its removal within the restoration zones e. Replacement of vegetation since planting. f. Any corrective measures that may be deemed necessary to provide desired conditions. g. Any maintenance actions taken. Final Completion Five (5)years post planting, a review of the vegetation within the buffer enhancement area shall be completed and a final Monitoring Report provided to Mason County.This document should be a determination of success regarding vegetation coverage, health, and sustainability. Performance Standards The following performance standards are targeted for the proposed enhancement identified within this report. These performance standards are necessary for the evaluation of success achieved in implementing the proposed enhancement. Survival and Coverage Individual plants that die in the first or second year must be replaced (at a 1:1 ratio)with native species suggested by a qualified biologist and approved by Mason County.After the second year, if mortality of the installed vegetation exceeds 20 percent,those dead materials over 20 percent will be replaced at a ratio. If mortality is related to an inappropriate species for the site conditions, adjustments to the Plant Schedule may be made to replant with a species more likely to survive. Other actions include changes to or adoption of a watering schedule, or integrated pest management(excluding pesticide use). Table 8. No substantial or detrimental impact to critical areas,their associated buffers or to priority habitat species that may be located within the area are anticipated if the restoration is approved for implementation.All existing native vegetation within the standard buffer will be retained in its natural condition during the execution of the planting plan. In addition, the proposed buffer restoration will help ensure a no net loss of ecological functions to the greatest extent possible.
