Belfair. This letter is to notify you that an extended period of time has passed since progress has been made in response to the work done without proper permit on the property of concern. You agreed to complete the necessary permits and remove construction debris as a way of resolving violations of Mason County Codes, following an October 20, 2008 meeting with Planners Ryan Crater and James Scholtz. The Department of Community Development is now requesting that you submit the needed Geotechnical Report, Development Regulations and Resource Ordinance Variance requests, and updated Habitat Management Plan for your development proposals on this property. Staff previously completed a site inspection on January 28, 2005 and observed this property along North Shore Road that contains no direct path from the road to a point where possible development could be proposed. The lot was well vegetated and contained mature deciduous and evergreen trees throughout. Steep slopes of 40 to 60 percent exist for 45 to 50 feet south from North Shore Road, then sloping down to a narrow 6-foot area of 5 percent slope, and then within 23 feet of the Hood Canal shoreline are slopes approaching a 50 percent angle. No streams or wetland areas were observed during the inspection. Standard building setbacks for the Rural Residential 5 are 20-foot side and rear setbacks and a 25-foot front yard or road setback. If these standards are limiting, Mason County may review a request for administrative variance at the time of development review (to no less than 5 feet from the side property lines and 10 feet from the road easement). Any distance less than these standards requires the review of a Development Regulations Variance request. Resource Ordinance standards state that due to the greater than 40 percent slopes on or adjacent to the site, the development of the property would require that a Geotechnical Report be provided prior to permit issuance in accordance with the Landslide Hazard Ordinance, section E.5. The Report will need to address the full extent of site development (proposed site preparation and structures), erosion control, and vegetation and storm water management. Actual slope setbacks will be established by the contents of the geotechnical report. The report must state that the hazards of the Phil Bennett feb 2009.doc landslide area can be overcome in such a manner as to prevent harm to property and public health and safety, and must also assure the project will cause no significant environmental impact. At least 2 copies should be provided to the County. A Landslide Hazard Covenant may need to be completed and recorded with the County Auditor, if it is determined through a Geotechnical Report that proposed construction will occur within a landslide hazard area or it's buffer. Prior to ground disturbing activities, excavation or grading, an acceptable geotechnical report will need to be submitted to the County and a permit issued i.e. building permit or Mason Environmental Permit. A topographic profile will need to be provided when submitting a building permit application. This profile view should show existing and proposed topography with regards to cutting, filling etc. When you did not follow this standard, you were cited with Resource Ordinance violations in the form of the Enforcement cases ENF2006-00133 and ENF2008-00098. Staff noted that the potential area for a new structure or residence will require some amount of grading and excavation. Recommendations on a proposed bulkhead along the shore or bank protection on the slope will need to be part of the geotechnical report. Such construction will need additional permit review by a shoreline permit when no residence is already on the property at the time of request for such protection. Due to the adjacent residences being located very near the ordinary high water mark of Hood Canal, the minimum shore setback distance for this property is 35 feet (20 feet of vegetation buffer at the tide line and 15 feet of building setback from the outer edge of vegetation buffer). All portions of proposed structures (roof eaves, balconies, decks, and stairs) must be behind the 35-foot shore setback distance. Proposed development not meeting this shore setback must be reviewed as a Variance to the Mason County Resource Ordinance standards. A public review process by the County Hearing Examiner is necessary that includes the submittal of a habitat management plan prepared by a qualified biologist to address impacts to the shoreline vegetation buffer by proposed development. From the property limitations noted above, Mason County Department of Community Development is now requesting that you submit the needed Geotechnical Report (completed to current standards), combined Development Regulations and Resource Ordinance Variance requests, and updated Habitat Management Plan for your development proposals on this property. These reviews shall proceed as a unified development proposal and may take up to 3 to 4 months to complete once your submittal is complete. A submitted site plan, showing all improvements and the setbacks from property lines, slopes and shoreline will be needed for all permit and variance application submittals. In addition, a topographical profile or other topographical information provided by the project geotechnical engineer or geologist will also be needed to understand the full extent of site work. To complete these applications, these materials shall be submitted with any review fees to the Permit Assistance Center at 426 Cedar St. in Shelton. To show progress on resolving the past violations and to proceed on the development review, you shall submit the applications by April 10, 2009.
