After they found out that they will need a Development Regs Variance for any fence over 6'w/i the sideyard setback,I was informed by Charrell that they now plan to cut the fence down to 6' and leave no sections forward of the common-line. They are also inquiring with Charrell about options to build a"blockade"that will exceed 6'in height but meet sideyard and common-line setbacks. She's getting back to them on that... Based on the historical documentation that you provided, you will be able to complete and retain the fence structure provided that you satisfy the following requirements: 1. All portions of fence structure (including posts)must be 30"or less in height above average grade anywhere forward of the "common line." Please note that under current regulations, no fence structure—regardless of height—could be constructed forward of the common line. You are allowed to complete the fence construction that you initiated prior to the June 2002 regulatory change(based on the historical photographs that you provided). Please provide compliance photographs regarding this portion of fence by June 18, 2004. 2. All other portions of fence structure must be 6' or less in height above average grade if you wish to avoid permit requirements. It is my understanding that you plan to reduce the fence to 6' in height or less. Please provide compliance photographs regarding this portion of fence by June 18, 2004. 3. We discussed a deck railing project that you plan to pursue. If you are placing railing on an existing deck, it must satisfy minimum Building Code requirements. As we discussed, you need to work through the Building Department to determine what permit requirements apply. The complainant expressed concerns regarding the construction of a fence that ranges in height from 10' to 4' in height above grade. By May 14, 2004,please submit a Building Permit application that satisfies Shoreline Master Program and Resource Ordinance standards.
