Comments:
Pre-inspection for D. Jackson / Janet Hogle on Oct. 18, 2006:
The purpose of the pre-inspection was to evaluate issues related
to the construction of a single family residence on a 0.61 acre
parcel on Wooten Lake. The parcel is vegetated with evergreen
and deciduous trees and has no cleared areas for a yard; the
shoreline is a slight slope ending with a low bank into the lake and
adjacent shoreline vegetation. Several old trees damaged by
elements are situated at the north end of the property, as well as
a 14 ft. deep by 21 ft. long cabin shelter near the shoreline and a
short dock into the lake.
Geotech Report / Landslide hazards: The property has a low bank
shoreline adjacent to the lake. Due to the less than 12 percent
slopes on the site, the development of the property would not
require a special geologic study to review proposed development.
The zone designation is Rural Residential 20. Standard lot line
building setbacks for this zone are a 25 foot front yard or access
easement setback, and 20 foot side and rear yard setback. For
existing lots that have width at 100 feet or less, the side yard
setback can be equal to 10 percent of the lot width; for the subject
parcel that setback is 5 feet to the property line. These setbacks
are measured from structures 30 inches or greater above grade
such as roof overhangs, stairs, balconies, decks, fuel tanks, and
heat pumps.
Shoreline setbacks: The shoreline designation for the area is
Urban Environment per the Mason County Shoreline Master
Program and setbacks would be determined by the Mason County
Resource Ordinance. The shoreline setback is determined by
measuring distances from the lake ordinary high water mark
(OHWM) to the eaves of the adjacent neighbors' rooflines
adjacent to the applicant's property as indicated on the submitted
site plan. Any portion of the new structure, including decks,
balconies, and rooflines, must be behind this common line.
Landward of this line for 15 feet toward the inlet is an area that
may be used for lawns or patios or landscaping, etc. development
at grade level. From that point toward the lake is considered to be
a required vegetated buffer and is regulated by the Mason County
Resource Ordinance Fish and Wildlife Habitat Conservation Areas
Chapter. Within this chapter are those activities listed that can be
done both with and without a Mason Environmental Permit.
Staff did not measure distances for the common line setback from
the OHWM of the Wooten Lake shoreline to a proposed building

site. The applicants wish to build a residence and/or garage close

to the road, well away from the lake shoreline. Staff measured
from the road down the driveway to a point on the shoreward side
of the residence on Lot 12 to the east (a distance of 215 feet) and
from there toward the lake shoreline (a distance of 58 feet more).
The applicants want to build within 115 feet of the road and locate
the drive on the west property line, the utilities of well and power
near the road, and the garage and residence beyond the 25 foot
setback from the county road. This will entail removal of trees in
the area of these improvements. With the platted lot of less than
1 acre, no forest practice permit is needed for clearing of the 25 to
30 trees in that 115 foot deep area near the road. Selected falling
of the dying trees along the lake is allowed as long as portions of
the fallen trees are left in the buffer vegetation area along the
lake.
Resource Ordinance development standards states that the
vegetation buffer along the lake is to remain, but does permit the
limited limbing of trees for view improvement and a 3-foot wide
trail to the lake through the vegetation buffer. The maintenance of
the dock and float along the lake is allowed and does require
building permit review by Planning Dept. staff if support elements
are replaced or added to during repairs.
General process: Future site development must include a site
plan, showing all setbacks from property lines, improvements,
slopes, and shoreline; the site plan will be needed for building
permit application submittal.

Comments: FINDINGS OF RE-INSPECTION completed with Mr. & Mrs. Hogle
on June 12, 2007. The re-inspection is to verify the layout of
property, how county standards apply to the curved shoreline
present, and how much area is available to develop.
Shoreline setbacks: The shoreline designation for the area is
Urban Environment per the Mason County Shoreline Master
Program and setbacks would be determined by the Mason County
Resource Ordinance. The shoreline setback is determined by
measuring distances from the lake ordinary high water mark
(OHWM) to the eaves of the adjacent neighbors' rooflines
adjacent to the applicant's property as indicated on the submitted
site plan. Any portion of the new structure, including decks,
balconies, and rooflines, must be behind this common line.

The applicants wish to build a residence near the lake, and
garage close to the road, well away from the lake shoreline. The
subject property lot 11 has an extensive curved shoreline from lot
11A at the west side facing north, around to the south facing east,
then to connect with lot 12 facing north. Staff made
measurements to establish distances for the proportional setback
from the OHWM of the Wooten Lake shoreline to a proposed
building site. To mark the common line from the residence to the
west across the subject parcel to the roofline of the small cabin on
the subject parcel, staff measured distances from the lake and
placed ribbon flaggings on tree or shrub at 46 feet near the west
property line and 45 feet south from the existing dock (this flag
was beyond the 35-foot minimum distance from the curved east
side shoreline). The 17-ft. deep by 21-ft. wide cabin is 19 feet
from the lake at the north side and 22 feet from the lake at the
south side. The 35-foot minimum distance from the lake was also
measured at a 54.5 ft. distance south of that north commonline.
The attached drawing shows that the possible building area is
roughly 54.5 feet north to south and from 33 to 39.5 feet west to
east, using the 5 foot side yard setback.
