Box 186, , Shelton, WA 98584 Enforcement Case No. ENF2008-00135 '�''' �� ^° C Dear Mr. Crater, Since our last conversation on the phone I have organize my data on the excavation work on my Blacksmith Lake property at 60 NE LAKEWAY DR SOUTH, BELFAIR. Enclosed is a plot plan of performed work. You will notice only brush and fallen trees were removed between the 450' to 610' marks to the lake. From the 400' to 450' marks comprising of the circular loop road I had to remove 5 mature trees. One of them was a large dying hemlock on the southern loop. All the roads were chosen by finding the easiest path through the least populated tree terrain. The 300' to 400' marks is where the majority of trees and brush were removed. 120' of 18" culvert was used to reclaim land above a dry gully. At the 200' mark, 30' of 12" culvert was used under the elevated road section. Key show this site before and after the work was performed. Placement of culverts in Stream Crossing The specific Mason County Code(s) that apply to this activity are as follows.. ❑ Wetland section 17.01 .070 (D)(1)(a),(f) Fish & Wildlife Habitat Conservation Areas section 17.01 .110 (G)(1)(a) According to the Mason County Assessor records, parties named above hold legal interest in the parcel and are therefore subject to enforcement action for failure to comply. The parties shall respond to the county within twenty days of the postmark, posting on site, or delivery of the notice. Order YOU ARE HEREBY ORDERED to abate violations in the following manner: By November 21,2008 you must: Mason County Ordinance No. 77-93 (Revised Dec 27, 2008 regulates specific types of activities conducted within critical areas of Mason County. Ordinance No.77-93 is known as the Mason County Resource Ordinance (MCRO) and is approved by the County Commissioners. The Commissioners have authorized the Planning Department through Title 8.52.270 to enforce the MCRO as set forth in Title 15.13 (Enforcement). The development activity located on your parcel is within a regulated critical area. Under the MCRO the work falls under Section 17.01.070 (Wetlands) specifically section 17.01.070 (D)(1)(a),(f) of the Wetlands Ordinance and Section 17.01.110 (Fish and Wildlife Habitat Conservation Areas), specifically section 17.01.110 (G)(1)(a) of the Fish and Wildlife Habitat Conservation Areas Ordinance. The item(s) listed below will need to be submitted to the Planning Department/Mason County to facilitate compliance with the MCRO. Requested Items/Initial Compliance: 1) Submit a Wetlands Delineation Report from a qualified consultant (a list has been provided) with the review fee of$130.00. Please have your consultant identify the stream type where the culverts were placed (this can be part of the same report). Once the Wetlands Delineation Report has been submitted and reviewed by the Planning Department you will be advised of any additional permits or reviews that are required. Item(s) need to be submitted to the Permit Assistance Center in Building 3 with associated review fees.
