SinjUs C ecker Lanfanner Mason County Planning Department 7/23/01 1 of 2 BLD2001-00647 NOTIFICATION OF INCOMPLETE APPLICATION 7/23/01 Case No.: BLD2001-00647 Comments Per our conversation the grading work that was done on your lot at Blacksmith lake was a violation of the Mason County Resource Ordinance, Fish and Wildlife Habitat Conservation Areas Chapter 17.01.110, which I had previously sent you. A Stop Work Order was posted on site on 7/19/01. This Stop Work Order only applies to work done within 165 feet of the ordinary high water mark of the lake. Normally the 150 foot vegetated buffer of this lake is a no-touch area except for particular projects that are permitted through a Mason Environmental Permit, MEP. No MEP was issued for this project. As per your request to reduce the 165 foot setback / buffer (150 ft. buffer plus 15 ft. setback) a Habitat Management Plan HMP is needed to consider such a reduction. The requirements for an HMP are included in the Fish and Wildlife ordinance I have sent you, but I will try to help you with the process and understand what we are wanting to see in the way of an HMP. Since the vegetated buffer was removed without a permit, and after the fact permit (MEP) will be needed. Unfortuneatly after-the-fact permits fees are triple that of the normal fee, had it gone through the appropriate process. The fee for this MEP will be $480.00. Regarding your request to reduce the 165 foot buffer/ setback, without going through a variance process the County can consider buffer average, where the width in one area is reduced up to 25% and expanded in other areas, so that there is no net loss of buffer area. A request for buffer averaging will require the submission of a Habitat Management Plan showing how the buffer will be averaged and providing for mitigation and habitat improvements etc. Through buffer averaging we can reduce the buffer in the area where you propose to site your house and expand the buffer in other areas. Through this process this buffer can be reduced to as much as 124 feet in the location of your proposed residence. Please contact me with questions regarding the process.
