RE: Property Line Encroachment
Dear Mr. DeLost,
In response to a complaint received by this department, a site
investigation was done at property located within Mason County on
Horseshore Drive of which you are the record owner.
The complaint, accompanied by a legal survey, indicates an encroachment
of a non-permitted storage shed onto the adjacent lot. Mason County presently
has an exemption for storage sheds if they meet all of the following criteria:
Less than 120 sq ft of roof area, one story limitation, detached from any other
structure and the shed must maintain the 5' required setback from all property
lines, easement lines and right of ways to the furthest extension of the
structure.
The building department has established policy which allows structures
that were built beyond an established time frame without the required permits
to remain if they are not habitable structures, they meet all setback
requirements and there appears to be no immediate hazard to property or
persons. However, any repairs, additions or change of use to these structures
requires permits and the structure then must meet current standards. The file
is also noted that there is an "Existing Non-Conforming" structure on site.

At present time, it will be necessary for you to relocate the "existing non-
conforming" shed on the property so that it meets the minimum setback
requirements of 5' from the furthest extension to the property line, easement
line or right of way pursuant to Mason County Ordinance No.: 138-92.
Since the survey was done in 1993, it should be fairly uncomplicated to
establish the property line based on the survey stakes locations.
I will mark this complaint file for compliance on OCTOBER 14, 1994.
Failure to meet compliance by this date or contact this department with your
intentions regarding the non-conforming building and encroachment will result
in further action.
