BOX 578 SHELTON, WASHINGTON 98584 • (360) 427-9670 FINDINGS FOR MASON ENVIRONMENTAL PERMIT DATE: April 27, 2000 PERMIT NO.: MEP2000-0005 PROPOSED ACTION: Frederick Beninger / Country Estate Development Parcel Number 22310-75-00110 (in the NW of the NE of Section 10 in R2W, T23N) Installation of new 24-inch culvert in a Type 5 stream and the replanting of streamside plants around the culvert and along the stream vegetation buffer. Proposed project: To develop the subject rural property for residential use, a 24-inch culvert along an unnamed type 5 stream is to be installed to provide access to the center of the property; revegetating the stream buffer at the culvert construction location and along the stream nearby the septic drainfield area is also required; silt fencing on the perimeter of the exposed soils where sloped will be needed. DEPARTMENT OF COMMUNITY DEVELOPMENT: The proposal is located within the Rural Area of Mason County. The unnamed type 5 stream flows north to south and has been culverted to provide the driveway access to the property during the site clearing and upcoming placement of the septic system and residence. A portion of the 50 foot deep vegetation buffer was removed during the site clearing. The work was done without consultation with Mason County Planning staff and the potential impacts to the stream and its buffer were not avoided through such discussion. One section of the Mason County Resource Ordinance applies to this proposal: Fish and Wildlife Habitat Conservation Areas (Sec. 17.01.110). This permit will allow the placement of the culvert section in the actual alignment of the stream. The use of erosion control silt fencing on the perimeter and revegetation by plantings in the project area will address the temporary impacts of the proposed culvert construction and vegetation buffer removal. DEPARTMENT OF PUBLIC WORKS: No review by Department of Public Works was needed for this proposal. DEPARTMENT OF HEALTH (ENVIRONMENTAL HEALTH): No review by Department of Health was needed for this proposal. FIRE MARSHAL: No review by the Fire Marshal was needed for this proposal. COUNTY BUILDING OFFICIAL: As the proposal to locate culvert is exempt from county building codes, no building permit was required for this proposal. OTHER COMMENTS: Planning Department discussed with Health Services that the septic drainfield and tanks and the wellhead were outside of the management area of this type 5 stream; when developed as proposed on the septic permit site plan, this residence should be able to meet all development standards. CONCLUSIONS: Based upon the above review, this Department finds that the applicant (Frederick Beninger / Country Estate Development) has presented a proposal to place the 24 inch culvert in the type 5 stream. The implementation of erosion contrbl measures (silt fencing) and the replanting around the culvert where clearing took place will allow the project to address the temporary impacts of the culvert placement. On this date Mason Environmental Permit MEP2000-00005 is approved with the attached conditions. CONDITIONS OF APPROVAL 1) The applicant shall follow the plans and specifications of the proposed culvert, which will convey type 5 stream flows through the subject property. 2) The applicant shall implement erosion control measures (silt fencing and matting) and revegetation measures (reseeding and replanting) following the regrading to backfill around the culvert, and replant with naturally occurring shrubs or trees the vegetation area within 50 feet of the stream where site clearing took place.
