Olympia,WA 98501-1284 RE: US 101, South of Beacon Point—Major Drainage MP 316.06 to 316.26 No Effect Letter WSDOT Project#XL 3657 Federal Aid#NH-0101(325) Dear Mr. Moberg: The Washington State Department of Transportation(WSDOT)proposes the replacement of a non-fish bearing drainage pipe between milepost(MP)316.06 and MP 316.26 on United States(US) 101 in Mason County,Washington(Attachment A [vicinity map]). This"no effect"letter was prepared by the WSDOT on behalf of the Federal Highway Administration(FHWA)in response to the current U.S. Fish and Wildlife Service(USFWS)and National Marine Fisheries Service(NMFS)Endangered Species Act(ESA)listings(Attachment B [species list]). The USFWS listing indicated that Puget Sound bull trout [Puget Sound Distinct Population Segment (DPS)] (threatened),marbled murrelet(threatened),northern spotted owl (threatened), and designated critical habitat for all three species may occur in the vicinity of the project. The NMFS listing indicated that Chinook salmon [Puget Sound Evolutionarily Significant Unit(ESU)] (threatened), chum salmon(Hood Canal Summer Run ESU)(threatened) and steelhead [Puget Sound DPS] (threatened) and critical habitat for Chinook and chum may occur in the vicinity of the proposed project. WSDOT also evaluated the presence of Essential Fish Habitat(EFH)as indicated in the Magnuson Stevens Fishery Conservation and Management Act (MSA). This project is located in semi-rural Mason County,Washington(Township 24N, Range 3W,and Section 12)within Hydraulic Unit Code(HUC)6—Fulton Creek- Frontal Hood Canal 171100180304 and Water Resource Inventory Area(WRIA) 16 Skokomish-Dosewallips. The existing failing 36-inch culvert will be abandoned in place and replaced with a new 36-inch culvert 90-feet long(Attachment C [project plans]). The project will Dean Moberg February 16, 2011 Page 2 of 5 utilize a pipe "jacking" method to install the new culvert. The project will include installing 90 cubic yards of riprap and 70 cubic yards of granular material on the east slope at the outlet end to give the roadway slope increased integrity for the jacking operation. To install this material an access road will be constructed on the east slope of the highway fill. A jacking pit will also be constructed on the west slope of the highway fill. Construction of the access road and jacking pit will require the clearing and grubbing of several western red cedar, western hemlock,and big leaf maple (Attachment D [photos]). A total of approximately 2,000 square feet will be cleared and grubbed (Table 1 [proposed tree removao. The jacking pit will require 55 cubic yards of excavation, impacting 100 square feet of wetlands. Work will also include 5 cubic yards of fill below the OHWM impacting 50 square feet. The temporary erosion and sediment control (TESC)plan will include implementing a hydraulic bypass to isolate the work area and work outside of flow. The new inlet will be offset 25 feet from the existing inlet and the stream will be redirected to the new pipe inlet. The new pipe will have an outlet directly above the existing culvert and use the same streambed at discharge. At project completion all disturbed areas will be replanted and seeded. This project will include no new impervious surface. The action area is defined as the area of potential impact based on potential aquatic impacts as well as noise and visual disturbance. A right-of-way lease will be obtained for the jacking pit and access road construction. The proposed work is anticipated to start late summer of 2011 and take 20 days for completion. No nighttime work is anticipated. Project equipment includes: compactors,excavators,chainsaws, dump trucks, loaders, sweepers, boring and jacking equipment. According to project plans the loudest equipment associated with this project will be the chainsaws, which will only be required one or two days at the beginning of the project. Chainsaws have been documented to produce noise levels up to 84 decibels maximum (WDOT 2010). Traffic is estimated to be between 2,400 and 2,700 passenger and commercial vehicles daily. Existing baseline noise levels within the project action area are estimated at 64 decibels because of the size of the roadway,daily traffic and posted speed limits(WSDOT 2010). The noise generated by the project is estimated to extend 262 feet in all directions from the work and visual disturbance will extend up Dean Moberg February 16,2011 Page 3 of 5 to 200 feet. The aquatic impact area is expected to be 100"downstream and 100 feet upstream (Attachment E [action area map]). A field review was conducted by the project biologist on January 20, 2011 and physical characteristics of the site as well as potential use by listed species were assessed. The stream was determined to be non-fish bearing in 2009 by WDFW. Topography of project area is typified by steep east facing slopes with numerous low order streams flowing into Hood Canal. Woody vegetation is dominated by western hemlock,western red-cedar and big leaf maple. Dominant shrubs in the action area are elderberry, Indian plum and salmonberry. Herbaceous vegetation is dominated by sword fern, grasses and native forbs. The west side of the highway has been recently logged and only a few scattered conifer and deciduous still remain outside WSDOT right-of-way. Listed species will not be susceptible to negative impacts related to project activities. WSDOT has determined that the US 101 South of Beacon Point Major Drainage project will have"no effect"on bull trout,marbled murrelet, northern spotted owl, Chinook salmon,chum salmon, and steelhead. Additionally, the project will have no effect on designated critical habitat for bull trout,marbled murrelet,northern spotted owl, Chinook salmon and chum salmon. These determinations are further justified below. Bull trout, Chinook,chum and steelhead do not occur in the action area. All are documented in the Hood Canal which is over 400 feet downstream of the project location. Listed fish will not be exposed to project related activities because there is no work in fish bearing waters associated with this project and best management practices (BMPs)will be implemented to ensure no foreign materials enter fish bearing waters of the state. WSDOT has determined that this project will have"no effect"to bull trout, Chinook,chum or steelhead. Bull trout, Chinook, and chum critical habitat does not occur within the project action area. The nearest designated critical habitat for these species is in Hood Canal over 400 feet downstream. Designated critical habitat will not be impacted by project related activities because there is no work in fish bearing waters associated with this project and best management practices(BMPs)will be implemented to ensure no foreign materials enter fish bearing waters of the state. WSDOT has determined that this project will have"no effect"to bull trout, Chinook,or chum critical habitat. Marbled murrelet are documented in Mason County. The nearest marbled murrelet detection occurs 4.9 miles northwest. The coniferous trees occurring in the action area are early to mid-seral and lack the needed structure for marbled murrelet presence. Foraging and suitable habitat does not occur within the project action area. WSDOT has determined that this project will have"no effect"to marbled murrelet. Critical habitat is not currently designated for Puget Sound DPS steelhead. The nearest designated marbled murrelet critical habitat is over 1.3 miles northwest of the project. WSDOT has determined that this project will have"no effect"to marbled murrelet critical habitat. Northern spotted are documented in Mason County. The nearest northern spotted owl detection occurs 4.4 west of the project. The coniferous trees occurring in the action area are early to mid-seral and lack the needed structure for northern spotted owl presence. Suitable habitat does not occur within the project action area. WSDOT has determined that this project will have"no effect"to northern spotted owl. Designated northern spotted owl critical habitat does not occur in the project action area. The nearest designated northern spotted owl critical habitat is over 3.3 miles northwest of the project. WSDOT has determined that this project will have"no effect"to northern spotted owl critical habitat. The MSA mandates that NMFS must identify EFH for federally managed marine fish. Federal agencies are required to consult with NMFS Fisheries on all activities or proposed activities authorized, funded or undertaken by the agency that may adversely affect EFH. EFH is defined as the waters and benthos necessary to a species spawning,breeding, feeding or growth to maturity; in short, its entire life cycle. There are 83 marine species managed by NMFS Fisheries that are considered under the MSA including anadromous Chinook and coho salmon stocks in Washington and pink salmon stocks in Puget Sound. The following information is provided for a MSA assessment. The Pacific Fishery Management Council (PFMC) with the concurrence of the Secretary of Commerce defines freshwater EFH as the aquatic component of streams, lakes ponds, wetlands and other water bodies currently or historically accessible to salmon except above certain impassable barriers in Washington, Oregon, Idaho and California identified by U.S. Geological Survey hydrological units. Hood Canal, which is 400 feet downstream, is the closest Pacific salmon EFH present. There will be no work in fish bearing streams associated with this project and BMPs will be implemented to ensure no foreign materials enter fish bearing waters of the state. WSDOT has determined that this project will "not adversely affect"EFH for Pacific salmon. This determination is justified based on the following rationale: • No work in fish bearing streams will occur on this project; • Proper use of BMPs will insure that no pollutants or sediment enter fish bearing waters of the state. We will continue to remain aware of any changes in the status of the species and the project; and are prepared to reevaluate potential project impacts should any changes Dean Moberg February 16,2011 Page 5 of 5 occur.
