The purpose of the project is to construct permanent repairs 12 to roadway damage caused by a landslide at MP 316.5. The proposal is approved subject to conditions. 11 14 TESTIMONY 15 Grace Miller summarized the staff report. Ms. Miller clarified there would be no 16 work in the water and that the proposal is located more than 100 feet from the waterline. 17 David Evans, WSDOT representative, noted that the reason the biological assessment 18 won't be completed until after completion of the project is that the biological assessment is being done under an emergency action and that WSDOT has already l received emergency conservation measures from federal agencies that exceed the best -'0 management practices applicable to the project. Mr. Evans agreed to submit a copy of the conservation measures. The conservation measures include protection of 1 marbled murrelet by prohibiting construction during feeding times. 22 Kevin Dahl, project engineer, confirmed that repairs will extend a little beyond the 23 existing road footprint. 24 EXHIBITS SSDP P. 1 Findings, Conclusions and Decision Exhibits 1-8 identified in the last page of the staff report were admitted during the I hearing. Post-hearing an email from David Evans to Grace Miller regarding 2 conservation measures dated June 1,2015 was admitted as Ex.9. 3 FINDINGS OF FACT Procedural: 4 1. Applicant. The applicant is the Washington State Department of 5 Transportation. 6 2. Hearing. The Hearing Examiner conducted a hearing on the subject 7 application on May 25, 2014, at or about 1:00 p.m., in the Mason County Commissioners Meeting Room. 8 Substantive: 9 10 3. Site/Proiect Description. The applicant has requested approval of a shoreline substantial development permit for the repair of US 101 roadway and 11 stabilization of the slope on the Hood Canal side by building a retaining wall. The purpose of the project is to construct permanent repairs to a landslide at MP 316.5. 12 Highway 101 at MP 316.5 runs parallel to Hood Canal and is approximately 100 to 13 120 feet away from the water body. All work will be within 200 feet of Hood Canal. 14 The property has been and will continue to be used as a transportation corridor for public and private vehicles. It is located within a rural, forested area with steep 15 slopes.The steepest slope is approximately 45%. 16 The landslide that caused the need for repairs occurred on December 10, 2014 during 17 an extreme weather event. Temporary emergency repair work included signage and barrier installation to restrict travel to one lane, erosion control measures and 18 conducting geotechnical investigation. Permanent repairs will include removal of slide debris, tree removal, construction of a soldier pile retaining wall and 19 reconstructing the roadway slope and northbound lane and shoulder. 20 The retaining wall will be located approximately 100 to 120 feet from the OHWM. 21 The fill material behind the wall will be permeable ballast which is crushed rock - 2 1/2" minus, approximately 100 CY. Re-establishing the roadway will consist of 22 approximately 60 CY of crushed surfacing base course - 1 1/4" minus and approximately 50 CY of asphalt. 23 Design steps taken to avoid or minimize impacts to the environment include the 24 following: 25 1)No in-water work will occur as part of this project. SSDP p. 2 Findings, Conclusions and Decision 2) Proper use of Best Management Practices will ensure that no related pollutants, sediment or debris enter waters of the State 3) Consultation with the National Marine Fisheries Services and United States Fish & Wildlife Service will ensure that project activities do not jeopardize listed species or destroy, or adversely affect designated critical habitat. 4) Conservation measures outlined in the Biological Assessments will be included in 4 the construction contract. This project has been declared an emergency action. Therefore, the Biological Assessment will not be complete until after the project is completed. The project is not scheduled to be complete until after October 1,2015.At 6 this time, the biological assessment will begin and be completed before November 1, 2015. 7 4. Characteristics of the Area. The adjacent properties are used for 8 recreation such as bicycling, fishing and camping. Robinswold Girl Scout Camp is adjacent to the project site. An access road through the Girl Scout Camp Robinswold 9 is located between the Highway and Hood Canal, below the slide area. The buildings 10 associated with the camp are located to the northeast of the project limits. 1 1 5. Adverse Impacts. There are no significant adverse impacts associated with the proposal. The design steps already incorporated into the proposal as outlined 1=' in Finding of Fact No. 3 are sufficient to mitigate any adverse impacts to 13 environmental resources and properties in the vicinity. The most pertinent area of concern is impacts to fish and wildlife, as the applicant has not yet completed a 14 biological assessment and it may not be completed until after the project is completed. For this reason, the. conditions of approval will require that the applicant 1 comply with any conservation measures suggested or required by the United States Fish and Wildlife Service and National Marine Fisheries Service during their ESA 16 consultation on the proposal. Beyond that issue, since no work waterward of the shoreline is proposed and the applicant proposes to use best management practices, 17 no adverse impacts to water quality are anticipated. Impacts to existing vegetation 18 will be modest and the conditions of approval require the restoration of any removed vegetation. No other adverse impacts are reasonably evident from the administrative 9 record. 20 21 CONCLUSIONS OF LAW 22 Procedural: 23 1. Authority of Hearing Examiner. MCC 15.03.050(9) authorizes the Examiner to review and issue a final decision regarding shoreline substantial -4 development permit applications.. Substantive: SSDP p. 3 Findings, Conclusions and Decision 2. Shoreline Designation. The shoreline designation of the project site is 1 Conservancy. 2 3. General Review Criteria for Shoreline Substantial Develoument Permit. 3 The applicant is required to obtain a shoreline substantial development permit for any substantial development within the shoreline jurisdiction. Applications for shoreline 4 substantial development permits must be consistent with the Shoreline Master Program for Mason County ("MCSMP"), and the policies and procedures of Chapter 5 90.58 RCW, the Shoreline Management Act ("SMA"). MCC 15.09.055(0(2)(C). A 6 "substantial development" is any development of which the total cost for market value exceeds $6,416 or any development that materially interferes with any normal 7 public use of the water or shorelines of the state. MCC 17.50.040. As noted in the staff report, the proposal will exceed $$6,416 in cost. This proposal is reviewed 8 under the SMP Section for Transportation Facilities. The applicable review criteria 9 are quoted below and applied through corresponding conclusions of law. 10 Transportation Facilities Policy No. 1: Roads should be located on stable soils, back from a water channel using routes that avoid slumps, wetlands, and natural 11 drainage areas. When this is not possible, corrective stabilization measures should be used. 12 4. The repair work is for an existing road that cannot be re-located. The 13 proposed retaining wall serves as a corrective stabilization measure authorized by the 14 policy quoted above. The proposal is consistent with the policy. 15 Transportation Facilities Policy No. 2: Major highways, freeways and railways should be located away from shorelands. 16 17 5. The work will be done for an existing road that cannot be relocated. As the policy is a "should" as opposed to a "shall", the circumstances of the proposed work justify 18 its location within shorelands. 19 Transportation Facilities Policy No. 3: Road locations should be planned to fit the topography so that minimum alterations of natural conditions will be necessary. 20 21 6. The road repair with retaining wall has been designed and will be maintained to prevent erosion and to permit the natural movement of ground water. 22 Transportation Facilities Policy No. 6: Roads located in wetland areas should be 23 designed and maintained to prevent erosion and to permit the natural movement of ground water. 24 25 7. It is unclear if the road is located in a "wetland area". Given that the staff report does not identify any wetlands at the project site and there is nothing in the record to SSDP p.4 Findings, Conclusions and Decision suggest the presence of wetlands, it is determined that no wetlands are at the project 1 site. Transportation Facilities Policy No. 7: Location of roads and railroads should not require the rerouting of stream and river channels. 4 8. No rerouting of stream or river channels is proposed. Transportation Facilities Policy No. 8: Roads should be designed, constructed and 6 maintained to minimize erosion and to permit natural movement of ground water and floodwaters to the extent practical. 7 9. Staff have determined that the road and retaining wall have been designed 8 and will be maintained to minimize erosion and to permit natural movement of ground water to the extent practical and there is no evidence to the contrary. Best management practices proposed by the applicant will prevent erosion during I construction. I I Transportation Facilities Policy No. 9: All debris, overburden and other waste materials from construction should be disposed of in such a way as to prevent their 1-' entry by erosion from drainage, high water, or other means into any surface water 1 body. 14 10. As conditioned. I 'Transportation Facilities Policy No. 14: All transportation facilities in shoreline areas should be located, designed, constructed and maintained to cause the least I possible adverse impacts on the land and water environments, should respect the natural character of the shoreline and should make every effort to preserve wildlife, 17 aquatic life and their habitats. 18 11. As determined in FOF No. 5, the proposal creates no significant adverse 19 impacts and is conditioned and proposed to avoid any impacts to the shoreline resources. 20 1 Transportation Facilities Use Regulation No. 1: Application for roads and railroads must adequately address the following: 22 ' Need must be shown for a shoreline location and that no reasonable upland alternative exists. 23 • The construction is designed to protect the adjacent shoreline against erosion, uncontrolled or polluting drainage and other factors detrimental to the environment -'4 both during and after construction. 25 • That the project will be planned to fit the existing topography as much as possible, thus minimizing alterations to the natural environment. SSDP P. 5 Findings, Conclusions and Decision That all debris, overburden and other waste materials from construction will be disposed of in such a way as to prevent their entry by erosion from drainage into any water body. 12. There is a strong need and no reasonable alternative for the repair work as it addresses a problem on an existing road. Best management practices will prevent 4 erosion during construction and completion of the retaining wall is designed to prevent future erosion. The conditions of approval require restoration of damaged vegetation, ensuring that alterations to the existing environmental are minimized. 6 The conditions of approval require all construction waste material to be disposed of in a manner to prevent their entry into Hood Canal. The criterion is met. 7 Transportation Facilities Use Regulation No. 8: All excavation materials and soils 8 exposed to erosion by all phases of road, bridge and culvert work shall be stabilized and protected by seeding, mulching or other effective means both during and after 9 construction. 10 13. Best Management Practices will be utilized to control stormwater from entering waters of the state. The practices are approved by the Washington State Department of Ecology and are from the latest version of the Washington State 12 Department of Transportation's Highway Runoff Manual. 1) Transportation Facilities Use Regulation No. 9: When permitted to parallel 14 shorelines, roads shall be set back a sufficient distance from the ordinary high water mark to leave a.usable.shoreline area for shoreline recreation or access. 14. The proposed repairs are to an existing road that was likely placed at its 16 present location prior to Use Regulation No. 9 and therefore qualifies as a valid nonconforming use. WAC 173-27-080(2) authorizes repairs of nonconforming 17 structures provided that the degree of nonconformity is not increased. Although the 18 proposed repairs will extend a nominal amount beyond the existing road footprint, this small amount should have no impact on any usable area for shoreline recreation 19 or access. 1> Transportation Facilities Use Regulation No. 10: Storm water runoff shall be ,1 controlled to reduce suspended solids and other pollutants before entering any surface water body. 22 15. Staff have determined that stormwater treatment will be installed to 23 control runoff; reduce suspended solids and other pollutants from entering any surface -14 water body.No impacts to adjacent water bodies are anticipated. 25 DECISION SSDP p. 6 Findings, Conclusions and Decision I The shoreline substantial development permit application for SR 101 repair work (SHR2015-00002)is approved subject to the following conditions: 1) All debris, overburden and other waste materials from construction will be disposed of in such a manner as to prevent their entry by erosion from drainage 4 into any water body. 2) No in-water work will occur as part of this project. 3) Proper use of Best Management Practices will ensure that no related pollutants, 6 sediment or debris enter waters of the State. 4) Consultation with the National Marine Fisheries Services and United States Fish 7 & Wildlife Services will ensure that project activities do not jeopardize listed species or destroy, or adversely affect, designated critical habitat. The applicants 8 will comply with all conservation measures recommended by the Services in anticipation resulting from the consultation. 9 5) All work will be done during daylight hours. 6) All roadside impacted by project work shall be restored in kind. The retaining wall will be located approximately 100 to 120 feet from the OHWM.The fill material behind the wall will be permeable ballast which is crushed rock-2 1/2"minus,approximately 100 CY.Re- establishing the roadway will consist of approximately 60 CY of crushed surfacing base course- 1 1/4" minus and approximately 50 CY of asphalt. Design steps taken to avoid or minimize impacts to the environment include the following: 1)No in-water work will occur as part of this project. 2)Proper use of Best Management Practices will ensure that no related pollutants,sediment or debris enter waters of the State 3)Consultation with the National Marine Fisheries Services and United States Fish&Wildlife Service will ensure that project activities do not jeopardize listed species or destroy,or adversely affect designated critical habitat. 4)Conservation measures outlined in the Biological Assessments will be included in the construction contract. This project has been declared an emergency action.Therefore,the Biological Assessment will not be complete until after the project is completed.The project is not scheduled to be complete until after October 1,2015.At this time,the biological assessment will begin and be completed before November 1, 2015. Alternating signal controlled traffic with minor delays will be utilized as a detour during construction. The proposal takes place within the jurisdiction of a Type I Water and shall be reviewed under the Mason County Shoreline Master Program Policies and Use Regulations.The Shoreline Environmental Designation is Conservancy and a Shoreline of Statewide Significance. Per the Mason County Development Code 15.09.055 A.1,this proposal requires a Substantial Development Permit due to the cost exceeding$6416 as well as being beyond the scope of"normal maintenance and repair"as defined under WAC 173-27- 040(2)(b).This SDP proposal is reviewed under the Mason County Code,Shoreline Master Program (SMP)Chapter 17.50.060 Transportation Facilities. A. COMPREHENSIVE PLAN REVIEW: Type III Review for permit applications require that the Hearing Examiner evaluate the proposal for consistency with the County's Development Code,adopted plans and regulations.The Hearing Examiner shall review the proposal according to the following criteria: 1)The development does not conflict with the Comprehensive Plan and meets the requirements and intent of the Mason County Code,especially Title 6,8 and 16. 2)The development does not impact the public health,safety and welfare and is in the public interest. 3)The development does not lower the level of service of transportation and/or neighborhood park facilities below the minimum standards established within the Comprehensive Plan and meets the requirements and intent of the Mason County Code. The project does not conflict with the Comprehensive Plan and meets the requirements and intent of the Mason County Code.The project does positively impact public safety and is in the public interest. The level of service to public transportation and the parks will be improved. 2 B. SHORELINE MASTER PROGRAM REVIEW: The proposal requires a Shoreline Substantial Development Permit because the value exceeds W16.00. The Transportation Chapter of the Shoreline Master Program was used in the review of the project.The applicable Policies and Use Regulations of the Chapter follow: TRANSPORTATION POLICIES: 1. Roads should be located on stable soils,back from a water channel using routes that avoid slumps, wetlands,and natural drainage areas.When this is not possible,corrective stabilization measures should be used. The highway is located on unstable soils and cannot be relocated Therefore, the proposed retaining wall is proposed as the corrective stabilization measure. 3. Road locations should be planned to fit the topography so that minimum alterations of natural conditions will be necessary. The work is necessary to complete the project as designed to WSDOT standards.. 6.Roads located within wetland areas should be designed and maintained to prevent erosion and to permit the natural movement of ground water. By constructing the new retaining wall on the slide area, the highway is being protected and meets this policy. TRANSPORTATION USE REGULATIONS: 1.Application for roads and railroads must adequately address the following: -The construction is designed to protect the adjacent shoreline against erosion,uncontrolled or polluting drainage and other factors detrimental to the environment both during and after construction. -That the project will be planned to fit the existing topography as much as possible,thus minimizing the alterations to the natural environment. That all debris,overburden and other waste materials from construction will be disposed of in such a way as to prevent their entry by erosion from drainage into any water body. The proposed retaining wall will maintain the highway location for public safety and erosion control will be implemented during and after construction. Disturbed areas will be replanted with native vegetation. 3 8.All excavation materials and soils exposed to erosion by all phases of road,bridge and culvert work shall be stabilized and protected by seeding,mulching or other effective means both during and after construction. Best Management Practices will be utilized to control stormwater from entering waters of the state. Methods are approved by the Washington State Department of Ecology and are from the latest version of the Washington State Department of Transportation's Highway Runoff Manual. 10. Stormwater runoff shall be controlled to reduce suspended solids and other pollutants before entering any surface water body. The project will repair the US 101 roadway and stabilize the slope on the Hood Canal side of the roadway by building a retaining wall. The work consists of removal of slide debris, constructing a retaining wall (soldier pile wall) 18.5 feet east of the existing US 101 centerline, with a length of 225 feet and reconstructing 1,000 LF of northbound US 101. The wall will be constructed of steel piling placed on approximately 6 foot centers into the existing soils by drilling a 24 to 30 inch diameter shaft. Piling shafts will be approx. 80 - 85 feet deep. Wood lagging will be installed between the steel piles to provide the wall face. Excavation will be required at the face wall to a daylight point downslope to achieve the installation of the wood lagging at the final bottom of the wall profile. A short additional road may be constructed off of this dirt road to access the slide area in order to construct the retaining wall and /or new slope protection. The damaged asphalt will then be removed from the US 101 northbound lane, WSDOT approved fill and gravel for compaction will be replaced and new asphalt applied. All work will be within 200 feet of Hood Canal. On the north end of the project there is a culvert conveying drainage underneath US 101 from the west to the east. This culvert will be straddled by piling installed for the soldier pile wall. Wood lagging will be installed over the top of the culvert, but will not impact the culvert. Best Management Practices will be utilized to control storm water from entering waters of the state. Methods are approved by the Washington State Department of Ecology and are from the latest version of the Washington State Department of Transportation's Highway Runoff Manual. General description of the site Flat, rolling, hilly, steep slopes, mountainous, other: Rural, forested area, with steep slopes. b. What is the steepest slope on the site (approximate percent slope)? Steepest slope on the site is approx. 45%. -2 - EV T c. What general types of soils are found on the site (for example, clay, sand, gravel, peat, muck)? If you know the classification of agricultural soils, specify them and note any prime farmland. Project is located within the Hoodsport stony, and sandy loam soils. No prime farmland. d. Describe the purpose, type, and approximate quantities of any filling or grading proposed. Indicate source of fill. Approx. 1,300 CY of fill will be used to construct the new retaining wall. Some erosion may occur during construction, which will be minimized by creating a Temporary Erosion and Sediment Control plan (TESL), and using Best Management Practices (BMP's). g. A culvert will be placed in the ditch and gravel placed on top in order to widen the west side of US 101 southbound lane to the required 15 ft. width for a temporary construction purposes. If so, describe the type of waste and anticipated volume of discharge. This project will not discharge waste materials into surface waters. b. ( ) 5) Area of suitable habitat within 60 meters (65 yards) of project activity that will be exposed to elevated noise levels from use of heavy equipment and chainsaws and visual stimuli sufficient to cause disruption (LAA) to nesting murrelets during the nesting season (April 1 - Sept. 22). 6) Area of suitable habitat between 60 meters (65 yards) and 0.25 mile of project activity that will be exposed to elevated noise levels from use of heavy equipment and chainsaws sufficient to cause disturbance (NLAA) to nesting murrelets (NLAA) during the nesting season (April 1 - Sept 22).
