Dear Mr. Flores:
Thank you for the opportunity to comment on the determination of nonsignificance for the construction of a 165 foot
long by six foot high riprap bulkhead to protect an eroding bank (Case No. SEP97-0017), located at North 26970
U.S. Highway 101 in Hoodsport as proposed by Cindy Sund. We reviewed the environmental checklist and have the
following comments:
Shorelands:
The checklist does not give enough information to conclude that an "emergency exemption" from shoreline permit
requirements is appropriate. The proposed project must be consistent with all applicable goals and policies of the
Shoreline Management Act, its rules, and the Mason County Shoreline Master Program. This is required even if the
project is in fact found to be eligible for exemption from the substantial development permit requirements of the act.
Water Quality:
Any work in or adjacent to waterways that will adversely affect water quality must receive specific prior
authorization from the Department of Ecology pursuant to WAC 173-201A-l 10. A short-term water quality
standards modification may be issued if the proponent agrees to a number of specific construction practices and
techniques designed to minimize water quality impacts. The construction schedule will be tied to the schedule on the
Hydraulic Project Approval (HPA).

Your project may require authorization from the U.S. Army Corps of
Engineers under the following regulations:
(X) Section 10 of the River and Harbors Act - A Section 10 permit is
required for construction in or over any navigable waters of the United
States .
(�) Section 404 of the Clean Water Act - A Section 404 permit is
required for the following activities:
a. The addition of material, including deposition of dredged material or
excavated soils, or excavation in a water of the United States,
including wetlands. These activities can include filling, grading,
mechanized land clearing, ditching, channelization, and other
excavation activities that destroy or degrade waters of the United
States (tidal waters, lakes, rivers, streams and wetlands) .
b. The placement of piling when such placement has or would have the
effect of a discharge of fill material in the .waters of the United
States, including wetlands. ,
Wetlands mean those areas that are inundated o�: saturated by surface or
ground water at a frequency and duration sufficient to support, and under
normal circumstances do support, a prevalence of vegetation typically adapted
for life in saturated soil conditions.
