SUBJECT:° Lilliwaup Post Office — John Straatman
This memo is a response to the October 30 letter from John Straatman to Gale Ashby of
Ashby Homes, in which Mr. Straatman alleges several unresolved issues and concerns
with the new post office constructed by Mr. Ashby in Lilliwaup. Emmett Dobey was
provided a copy of this letter and asked to respond on behalf of Mason County with
regard to compliance with the requirements of the permits issued for the construction
of the post office. The following is a summary in response to the items listed in the
letter.
On the first page of the letter, Mr. Straatman lists 11 items that he states were not
done per the plan. The majority of these items are cosmetic, or non-code issues that
are not enforced by the County through the international codes. These range from
cracked or damp sheetrock to installation of blinds in the service counter. Mr.
Straatman states problems with the septic system, which was an existing system that
he was allowed to continue using for the new post office. Since the receipt of the
Straatman letter of October 30t", a permit has been issued for replacement of a septic
tank on site. The problems identified were non-structural and issues not enforceable by
the County or building codes.
Mr. Straatman also makes allegations in his letter that the retaining wall was backfilled
all at once and as a result, the retaining wall is "bent" two inches. A Washington
licensed engineer designed the wall, which included the options for a 3', 6', 9' or 12'
wall. There were two inspections done on the retaining (rockery) wall, which consisted
of a progress and final inspection. The wall was built at the three foot high option,
which, based on the engineer report met the slope for the three foot height based on
the cut.
The second page of Mr. Straatman's letter discussed issues related to erosion and
stormwater. Mr. Straatman alleges that erosion control was not in place to prevent
sediment and silt contamination in the bioswales in the front of the property. He
further states that the infilitration trench was covered with dirt during construction.
The building department does not inspect storm drainage plans or infiltration trenches
as part of their inspection to verify the minimum requirements have been met for the
project; however, our building inspectors did witness straw/hay bales in place for the
erosion control. The stormwater and erosion and sediment control plan initially
submitted for the project was reviewed and approved by the Mason County Public
Works Department. During this construction project there was a higher than normal
rainfall, which could account for some runoff of silt or dirt that was not absorbed by the
erosion and sediment controls in place.
Mr. Straatman also identified problems with on-site paving and the rockery (retaining
wall). He states the driveway is not constructed to the plan, the south exit is too high
and that there is only two inches of asphalt for the parking area instead of three inches.
The parking lot is not an inspection requirement of the project. The driveway access is
reviewed and approved by WSDOT. WSDOT is the regulatory agency that issues the
access permit from Mr. Straatman's property to US Hwy. 101. The County does have
requirements for compliance with fire apparatus roads and access. The project does
meet the minimum requirements for fire access per the International Fire Code. The
County is required to assure there is the number and size of parking stalls required for
the proposed use. This verification was done in the plan review stages.
The last portion of Mr. Straatman's letter references the Habitat Management Plan
requirements, specifically relating to plantings and vegetation areas required by the
approved plan, stating the plantings were not done according to the approved plan.
The owner and/or contractor are responsible to meet the requirements of the plan as
developed by their consultant. The County can also require that the applicant/owner
submit a monitoring plan of all plantings installed to ensure healthy growth over a
three-year period. However, this was not required of Mr. Straatman, nor was the
normal monetary bond for costs to ensure the plantings were installed per the approved
plan. The County waived the requirement for a bond due to Mr. Straatman's strong
persistence and the knowledge that the United States Postal Service would be
responsible for the maintenance of the plantings. Without the bond, the County has no
tool to ensure plantings are installed in compliance with the approved Habitat
Management Plan.
Overall the project was reviewed and approved as being in compliance with all
applicable State and County codes. The development of the property required a
geotechnical report for the soils, engineered erosion and sediment control plan and
stormwater drainage plan and a habitat management plan. All these plans were
reviewed and approved by the appropriate County staff, inspections performed in
compliance with the International Building and Fire Codes. The building and rockery
wall both meet the minimum requirements of the code as constructed.

John Straatman — Staff concerns
The information provided in this memo relating to the construction of the post office
facility in Lilliwaup exemplify the mannerisms of John Straatman, which we have seen
and dealt with over the past several years. There have been many confrontations of
County staff by Mr. Straatman over the years, dating back to early 2000 when one of
our building inspectors was accosted in the field during an inspection. This incident was
threatening to the inspector by not allowing him to leave the property, in addition to be
verbally abused by Mr. Straatman.
The unruly and borderline violent incidents with Mr. Straatman have continued over the
years, to the point the Permit Assistance Center has installed 'panic" buttons that tie to
a security company for response in emergency situations. Mr. Straatman attempted to
enter the building prior to the opening of the center by beating on the doors and once
in was belligerent to staff and acted in an unruly and irate manner. He was asked to
leave, only after calls to the Shelton Police and Sheriffs Department for response.
The most recent episode was related to the construction of the Lilliwaup Post Office.
Mr. Straatman was in the office on several occasions, irate and unruly, intimidating
office staff, planning department staff and field personnel. The culmination was he
breaking the glass doors at the center, costing approximately $600.00 to replace. The
actions by Mr. Straatman are a threat to County staff, and as a result we are scheduling
safety training by an outside consultant to assist staff in dealing with such customers.
Subsequently, Mr. Straatman has been charged with malicious mischief for the damage
done to the permit center. Although this is compensation for the property damage
done, it does not remove the potential for continued actions by Mr. Straatman in future
visits he may make to County offices.

Below are a list of unsettled concerns that I and my wife have regarding this project. Please
review these concerns and go according to plan.
l. The bioswale is not finished according to the plans. (The bioswale is not 10 feet;
nor is the top soil 1 foot deep)

`' The blinds for the workroom windows are not there,as the plans show.
3. The window sills are not in the workroom as the plans show.
4. The blinds for the counter area are not there as the plans show.
5. There is no curbing in the Loading Area, as the plans show.
6. Our driveway is not satisfactory,and this is obvious when looking at the plans.
7. After speaking with Tami Clark of the Department of Planning recently,I was
informed that the Wildlife Habitat Management Plan must be carried out as the
plans state and that this will be inspected by Agua Tierra of the Land and Water
Services.
8. Regarding the front door mat: Is this mat durable enough for long term public
use?
9. I spoke to Betsy Dickes on Friday, 2r of May. As far as she is concerned, the
erosion and sediment practices,as reflected in the report,remain an open issue
and that in her opinion, she has never met anyone who has been so uncooperative
as yourself. We are concerned about the long term effects this matter will have
upon us, if this is not satisfactorily resolved.
10. There were no straw bales around bioswale throughout the period of construction
as stated in the plans.
11. We do not understand why we are being charged $875.00 for shaping the hillside,
' when a decision was made earlier between Kamin,yourself and I to remove the
dirt from the job site onto our property rather that hauling it away(which is a
procedure outlined in the plans).
12. The entrance culture stone cap is too wide and not according to plan. (It was
mentioned that a person could hurt themselves if they bumped into it)
n13. The exit approach holds water badly and must be fixed.
