Project Description:
THE CONSTRUCTION OF APPROXIMATELY 9,000 SQUARE FEET OF PARKING
AREA AND SIDEWALK WITHIN THE 100' BUFFER OF HOOD CANAL.

This permit, with conditions, is granted pursuant to the Mason County Resource Ordinance
(Chapter 17.01 MCC.) Nothing in this permit shall excuse the applicant from compliance with
any other federal, state, or local statutes, ordinances, or regulations applicable to this project.
This permit may be rescinded if the permitee fails to complete the project as proposed or fails
to comply with the standards of this ordinance.

Conditions:
1.) Developers and individuals shall be required to control erosion during construction.
Removal of vegetation shall be avoided and any areas rbed should be restored to
prevent erosion and other environmental impacts. X
2.) The ovisions and recommendations of the Habitat Management Plan shall be enacted.

3.) All u and areas disturbed or newly created by construction activities shall be seeded,
Xg9taattted or given an equivalent type of erosion protection (silt fencing or straw matting).
4.) A d((e&ailed planting plan,with species composition, number, and distribution shall be
prove o and approved by Planning staff prior to final approval of the building permit.

5.) A moni oring plan shall be enacted whereby a qualified biologist shall submit a report
detailing the condition of the restoration area. This report shall be due on the anniversary
date issuance of the building permit and shall be submitted annually for three years.

6.) A survival rate of 90% of plantings is required each year during the three-year monitoring
period. If survival falls below 90%, the applicant shall replant to restore the required
survival percentage and shall d the monitoring report the necessary period to
address the replantings. X ,
7.) No elation of water quality hall occur as a result of this project.

8.) Best nagement Practices shall include: 1) Equipment/machinery will be checked daily
for leaks and necessary repairs; 2) Refueling and lubrication of equipment will occur
off-site. No fuel, lubricating oils, chemicals, or hazardous substances shall be stored
overnight within the project area; 3) Chemicals will not be applied when there is a
possibility of rain; 4) Native vegetation on-site or surrounding the project area will be
protected to the maximum extent possible; 5) Proponent shall comply with all permits and
other requirements of the government authorities or agencies; and 6)Construction will
take a during dry weather within a 160-day time frame during daylight hours.

9.) A mini um of 6,500 square feet of native plantings shall be installed within the northern
and southern portions of the site, and approximately 2,500 square feet of invasive
vegetation including Himalayan blackberry and scotch broom be removed within the
northern portion of the site immediately adjacent to the existing access road to the upland
residence. The recommended mitigation areas are identified on the Site Map in Appendix
A of the Habitat Mment Plan by Agua Tierra Land and Water Services, Inc. dated
May 2005. X VF
10.) Per the attached USPS Maintenance Rider,the USPS is responsible for ordinary repairs
to, maintenance of the demised premises.

a. If thet Postal Service is assuming maintenance responsibility for the demised premises for the first time, the Lessor
must correct all maintenance deficiencies and obtain a written certification from a professional HVAC firm that the
heating, ventilating and air conditioning systems have been maintained and are in proper working condition. The Lessor
will remain responsible until all deferred maintenance work has been completed to the satisfaction of the Postal Service
and Postal Service is in receipt of and accepts the aforementioned written certification.
b. The term "demised premises" as used in this rider includes the premises described in the Lease, the improvements
and appurtenances to such premises and all equipment and fixtures furnished, or to be furnished, by the Lessor under
this Lease.
c. The Postal Service is responsible for ordinary repairs to, and maintenance of the demised premises except for those
repairs that are speciifically made the responsibility of the Lessor in this Lease. The responsibility of the Postal Service
as stated herein will be fulfilled at such time and in such manner as the Postal Service considers necessary to keep the
demised premises in proper condition.
d. The Lessor is responsible for:
(1)Repairs to all common or joint use areas, commori or joint use equipment and fixtures that may be included as
part of this Lease.
(2)All repairs to structural elements and all parts of the roof system. The term "structural elements" as used in this
clause is limited to the foundation, bearing walls, floors (not including floor covering), and column supports. The roof
system includes, but is not limited to, the roof covering, flashing and insulation, and roof beams,joists, and deck.
(3)Repairs resulting from Acts of God, of a public enemy, riot or insurrection.
(4)Inspection, prevention and eradication of termites and any other wood eating insects and for repairs of any
damage resulting therefrom.
(5)Repairs resulting from defects in building construction or installation of equipment, fixtures, or appurtenances
furnished by the Lessor.
(6)Repairs resulting from fire or other casualties, unless such casualties were caused by the negligence of
employees or agents of the Postal Service.
(7)Any ordinary repairs by the Postal Service which were made necessary by the failure of any element for which the
Lessor is responsible.
e. When the need arises for repairs which are the responsibility of the Lessor, including any repairs or actions for which
the Lessor is responsible under paragraph a. hereof, the Postal Service will (except in emergencies) give the Lessor
written notice of the needed repairs and will specify a reasonable deadline for completion of the work. A copy of such
notice will be sent by certified or registered mail to the Lessor's mortgagee and assignee of monies due or to become
due pursuant to this Lease whose names and addresses have been furnished to the Postal Service by the Lessor. If
none of these parties (lessor, mortgagee or assignee) proceed with the work with such diligence so as to ensure
completion within the time specified in the notice (or any extension thereof granted at the sole discretion of the Postal
Service) or actually fails to complete the work within said time, the Postal Service has the right to perform the work, by
contract or otherwise, and withhold the cost of such work (which may include administrative cost and/or interest) from
payments due under this Lease. In addition, the Postal Service may proportionally abate the rent for any period the
demised premises, or any part thereof, are determined by the Postal Service to have been rendered unavailable'to it by
reason of such condition. Alternatively, the Postal Service may, if the demised premises are determined to be unfit for
occupancy, at its sole discretion, cancel this Lease without liability.

4. RENEWAL OPTIONS: The Lease may be renewed at the option of the Postal Service, for
the following separate and consecutive terms and at the following annual rentals:

provided that notice is sent, in writing, to the Lessor at least 90 days before the
end of the original lease term and each renewal term. All other terms and
conditions of this Lease will remain the same during any renewal term unless stated
otherwise herein.
5. UTILITIES, SERVICES, AND EQUIPMENT: Lessor, as part of the rental consideration, shall furnish the following
utilities, services and equipment: (See Lessor Obligations of General Conditions(A.24)and/or attached addendum for definitions.)
Heating System, Air Conditioning Equipment, Light Fixtures, Sewerage System and
Service, Electrical System, Water System and Service.
6. OTHER PROVISIONS: The following additional provisions, modifications, riders, layouts and/or forms were agreed
upon prior to execution and made a part hereof:

NOTIFICATION OF INCOMPLETE APPLICATION

Comments: A site inspection of the proposed project was conducted on 11/5/04 to
assess critical areas. The site plan indicates that parking and paved
roads will be constructed within the 100' shoreline buffer. Per the
enclosed Mason County Resource Ordinance 17.01.110 Fish and
Wildlife Habitat Conservation Areas (FWHCA) section G (1)(i), a
Habitat Management Plan (HMP) shall be prepared for road/street
expansion & construction in FWHCA buffers. A list of wetland
consultants is enclosed for your information, of which some do HMP's.
You may also choose other qualified professionals not on this list. The
requirements for a HMP are outlined in section J.
As discussed earlier, the utilities (bioswale/infiltration pond) will not
need to be addressed in the HMP since they do not encroach more
than 50 feet into the buffer. See section G (2)(c).

Subject: Lilliwaup Post Office
Tammi...John Straatman came in last week, very upset about the status of his building permit for the new
post office at Lilliwaup. He said he had to do a HMP, and that we are requiring a $3,000 bond in
conjunction with the HMP. Emmett and I talked to him about the reasons for the bond. His response was
that he has a legal agreement with the USPS (Federal Government), which states they are responsible for
all maintenance at the site for a period of 20 years,with an option for 10 more. The question was raised
as to whether or not this can substitute for the bond, given the fact the Federal government is the stake
holder in this project. Emmett wanted your input before we told him the agreement was sufficient and
would work in place of the monetary bond. Mr. Straatman provided us a copy of the agreement with the
requirements stated of the responsibility of the LISPS. Let me know what you think. Thanks.
