Dear Jack:
Thank you for meeting with Rick Mraz and myself on-site several weeks ago. The
purpose of the meeting was to discuss the implications of my original letter dated
December 19, 2003. I understand that your financial means to address this matter are
limited, so we discussed alternatives that may help you reduce the costs associated with
compliance requirements. The alternatives include:
• To avoid the costs associated with formal wetland delineation and categorization,
assume that Category II Wetland buffer requirements apply to the wetland system in
question. Assume a conservative wetland edge where upland characteristics become
clearly dominant.
• Consult with the Mason Conservation District to determine if resources are available
to develop and implement the Restoration Plan. Pursuant to my recent discussion
with Kirsten Workman (Conservation District Staff), I understand that Kirsten is able
to work with you on this project. Kirsten supports a due date of June 4, 2004 for
submittal of the Restoration Plan. The Restoration Plan will need to meet the
requirements of Mason County Resource Ordinance section 17.01.200(I). The
Restoration Plan specifically needs to address the restoration of any recently
disturbed areas within the wetland system or associated buffer area. The plan may
incorporate a proposal to retain a road access to the adjacent parcel. The road access
should be the minimum necessary pursuant to County access standards. A mitigation
proposal to offset the road's impact to the regulated buffer should be included in the
Restoration Plan (please see standards in Mason County Resource Ordinance section
17.01.070(F) (Wetlands)) if you wish to apply to retain the new road access.
• If you wish to retain the new portion of access road within any portion of the
regulated buffer, you will need to submit a Mason Environmental Permit application
for that activity. An application form is enclosed for your use. The proposal shall be
addressed in detail in the Restoration Plan(see item directly above).
The individual who prepares the Restoration Plan shall provide a formal estimate
regarding the costs associated with implementation of the Plan. You need to post a
Bond equivalent to the estimate, using the Bond Form that is enclosed. The funds in
question will remain in your account with your financial institution as"frozen funds"
until the three-year monitoring period expires and the project is deemed to be a success
(see section 17.01.200(1)(3)).
You will want to discuss monitoring options with the Conservation District to
determine whether resources are available to facilitate this portion of the compliance
requirement(see section 17.01.200(I)(2)).
In addition to the Restoration Plan and the Bond Form, you will need to submit$360 to
Mason County to cover the costs associated with addressing this issue.
Please submit the Restoration Plan, Restoration Bond and$360 fee by June 7, 2004.
