Notice of Application for a Variance from the Mason
County Resource Ordinance and
Notice of Public Hearing
Notice is hereby given that Michael McGraw, who is the applicant for the following proposal, has
filed an application for a Variance (VAR2008-00013).
The request fora variance from the Mason County Resource Ordinance No. 77-93 is for the
construction of a single-family residence occupying a total are of 1,125 square feet within the
regulated buffer/setback of Hood Canal. Property location is 183 N. Canal Hide-Away,
Hoodsport, WA. Parcel #32330-51-06007.
Date of complete application: March 10, 2009.
The proposed development is reviewed as a Variance under the Mason County Resource
Ordinance No. 77-93, specifically Section 17.01.110, Fish and Wildlife Habitat Conservation
Areas, which details shoreline buffer requirements and Section 17.01.150, Variances from
Standards, which establishes Variance procedures and criteria. The proposal requires a Habitat
Management Plan and Hearing Examiner approval
A PUBLIC HEARING will be held by the Mason County Hearing Examiner on the proposed
project on Tuesday, May 12, 2009, at 1:00 p.m. in the County Commissioners Chambers, Bldg.

Notice is hereby given that MICHAEL MCGRAW has filed an application (VAR2008-00013) to
reduce the required 50-foot buffer (for a residence and septic system) to 49.00 feet adjacent to a
landslide hazard area. This notice is required under the Mason County Resource Ordinance
17.01.100, Section D(6)(a) for buffer reductions. Notice of application for the reduction. of a
buffer shall be made as provided in Section 15.07.010 of the Mason County Development Code
(which specifies how notice is to be sent to adjacent property owners and posted on site).
A Geotechnical Report was submitted to support the buffer reduction request. The report must
meet the requirements of the Mason County Resource Ordinance 17.01.10 Landslide Hazard
Areas.

We would like to express our opinions about Michael McGraw's application wanting to
change the footage of the 50-foot buffer zone. First he wanted one foot and you granted it
to him, now he wants another nine feet. When does it stop and what are rules put into law
for? Everyone else has to follow the rules so why keep granting exceptions to Mr
Mcgraw. We are definitely against this.

Dear Ms. Hersha,
We recently received the notification in reference to Michael McGraw's
application for a reduction in required buffers from landslide hazards and
residential structures. As co-owners of property on N. Beach Drive, my
sisters and I wish to express our disagreement with the Granting of this
application.
The existing zoning regulations were created to protect sensitive ecological
areas and residential structures. The granting of reduction of these minimal
regulations, in our opinion, is unwise. We ask that this application not be
approved.

Dear Mr:McGraw:
Curtis D Cushman of All American Geotechnical was on site at the above address on May 5, 2001 to see
whether the building site was in compliance with rules established by Mason County Planning. Mike McGraw
was on site to assist in my measurements.
Using a contractor-quality cloth tape, it was found that the closest any portion of the proposed residence was to
the toe of the bluff was 41 feet. As the point picked was the furthest extent of the monolithic slab-footing, no
encroachment will lie within 40 feet of the toe of the bluff. To be specific,there will be no encroachment of the
20 foot right-of-way, the 10 foot wide drainfield (as is now approved), plus the 5 foot drainfield setback(for a
total of 35 feet within the 41 feet available).
As Mr. McGraw cannot site his structure outside of a 49 foot setback from the toe of the bluff, I am
recommending that he send Mason County a letter requesting a setback of 41 feet for the above cited reasons.
This will be in compliance with the needed setbacks as detailed above. This letter should be addressed to
Rebecca Herscha,Planner for Mason County DCD.

Thank you. However, the letter should probably state in some fashion that he (the
geotechnical engineer) feels that the proposed development is safe and will not diminish the
stability oft he slope setback (41 feet). Also, you need to go through the process of public
notification, which includes mailing a notice of buffer reduction to neighboring property owners
and posting the notice on site. Once it has been mailed and posted, the 14 day comment
period begins. After 14 days, and after issuing any building permit, I will need to send out a
Notice of Decision to any interested parties, which begins a 14 day appeal period.
For the Variance mitigation, since you wish to complete this after the home is constructed,
you will need to get an estimate for the mitigation from the biologist, then post a bond for this
amount.
I will be in hearings and meetings all day today, but will try to be available tomorrow for any
questions. Although it looks like I will be sent out to the field to investigate a violation or two.
