Sincerely, Scott L(�Wa necker Land Use Planner Mason County Planning Department 6/5/01 1 of 2 RLC2001-00029 Resource Lands & Critical Area Office Review 6/5/01 Case No.: RLC2001-00029 Comments RLC for Kevin Mohundro Site visit on 5/31/01 to look at critical areas and setback requirements for future residential development of property. The Comprehensive Plan Designation for the area is Rural. Lake Erickson is a non-SMP lake, meaning that it is regulated by the Mason County Resource Ordinance, Fish and Wildlife Habitat Conservation Areas Chapter, 17.01.110. Lake Erickson is considered type 1 water under this ordinance, which provides a 150 foot vegetation buffer plus an additional 15 foot building setback for a total buffer/ setback of 165 feet. 165 feet was measured from the ordinary high water mark of the lake, and there is still sufficient room to site a residence on the property between Tahuya Blacksmith Rd. and Lake Erickson. The applicant is considering siting the house a distance behind the 165 foot setback where the property is more level. The average gradient of the property down to the lake is about 12%. It does not appear that a geological assessment or report would be required to site a residence on the property. There is a wetland area on the opposite side of Tahuya Blacksmith Rd., SE from the property, but it appears to be small and a sufficient distance away from any potential construction on this property. No other critical areas were identified on or near the property. Policy changes subsequent to that determination have been enact ed that . alter the jurisdictional status of Lake Ericson. A new field inspection of'the subject property was conducted on 1/28/02 to determine the resource-related setbacks that may affect the placement of a proposed single family home. The subject parcel has frontage on Lake Ericson. This lake is not under the jurisdiction of the Mason County Shoreline Master Program. It is regulated as a wetland pond per the provisions of the Wetlands chapter of the Mason County Resource Ordinance No. 77-93. The Resource Ordinance requires vegetative buffers and building setbacks from wetlands. Wetlands are categorized in the Resource Ordinance per the Washington Department of Ecology criteria. The size of the vegetative buffer depends on the category of wetland. During the field inspection a wetland survey was conducted to determine the wetland category. Based upon the field assessment, Lake Ericson meets the criteria for a Category III wetland. Category III wetlands require an undisturbed 50' vegetative buffer + a 15' building setback for a total of 65' of setback from the wetland edge. This edge would be identified on the subject parcel as the Ordinary High Water Mark (OHWM) of the lake. A copy of the Wetlands chapter of the Resource Ordinance is enclosed for your review. Site plans for future construction should indicate the OHWM in relation to any proposed structures. am available to identify the OHWM onsite if necessary.
