The letter notifies Mr. Krohn that a permit is required in order to change the use of a structure to be used to produce wine for public consumption and to offer the wine for sale. The letter is also attached to BCC2010- 00043, a case created to address correspondence concerning the notification of the liquor license application for a winery located at 550 NE Lakeridge Drive in Belfair. I will need to meet with staff and discuss steps which will likely mean requiring that the owner obtain a change of use permit. In addition I have notified the Planner concerning this proposal. Based upon records available to our office it does not appear that a building permit has been approved at the site for such a use. In order to produce wine for public consumption and to offer the wine for sale a change- of-use building permit shall be required by Mason County. Prior to submitting the permit application we encourage you to participate in a pre-application meeting to discuss the proposed project. The pre- application meeting is useful in order to help you assemble a complete permit package. Building permit application forms and pre-submission meeting application is enclosed. The change-of--use permit is required to verify that the structure complies with current code regulations including construction type and loads, exit requirements, fire-safety requirements, on-site septic regulations,water system,etc. To review the change-of-use permit the building department will need construction documents to verify that building elements meet required loads, a floor plan showing the use of rooms, exit information including exit path and lighting, where required, etc. The Fire Marshal will need to verify that there is adequate fire-flow and construction provisions to mitigate in the absence of fire-flow. So, whatever the code requires we would hold them to the same standard as a new building that was to be constructed. If there was something that came up that from a construction stand point that we could work with them on as long as it didn't compromise any Fire,Life,Safety concerns then we sould certainly work with them. In the past I have reviewed such a project as an F1 (wine manufacture)/A-3 wine tasting room (B when less than 50) in accordance to the applicable code using approved allowances for Fire Marshal alternate method. Also just because the proposed use may be a wine manuf. and tasting area it would not necessarily kick in fire sprinklers. It is posible that a fire separation would be required between the Manuf. portion and the tasteing area. I would talk to a planner as to weather the use would be allowed on the property. We recently received notice from the Liquor Control Board notifying us that a person who recently constructed a shop, approved as a "U", has applied for a liquor license. Fire flow is non-existent in the proposed location and it is not likely to attract large groups. Has Chelan developed a policy to address small wineries located in rural areas?
