Tammy Wright Mason County Planning Department Re: Parcel 323192400032 The purpose of this letter is to address potential impacts resulting from the emergency landscape contouring activity within the buffer of two type F streams and a type S stream(Lilliwaup Creek), that took place in response to the damage caused by the flooding of Lilliwaup Creek in December 2007. A Habitat Management Plan was prepared by TWC in September,2008 that addressed and mitigated for the majority of the emergency work within the stream buffer that occurred in response to the December 2007 flood event. However, the HMP did not address the installation of a berm within the Type F and Type S stream buffers, which took place concurrently with the landscape contouring activity. The berm is approximately 15'wide x 6'high x ISO'long, and is comprised of approximately 2000 cubic yards of material. The purpose for the construction of the berm is to protect the Lilliwaup Hatchery facility, including hatching tanks and several buildings, from damage that could occur from future flooding of the streams on the west side of the property. The berm is absolutely necessary given the proximity of the hatchery structures to the streams,and the potential for high impact flood events such as what occurred in December 2007. No damage to the streams or buffers occurred from the berm installation,beyond what was caused by the flood in 2007. No modifications to the stream channel have been completed that would negatively impact Puget Sound Steelhead, Puget Sound Chinook, Hood Canal Summer Chum, or bull trout that may be utilizing the channels. No impacts to water quality or other instream characteristics important to the above listed species are anticipated or are likely to have occurred during the installation of the berm_ The Habitat Management Plan prepared in 2008 provides mitigation recommendations for the completed work within the stream buffers,with the exception of the installation of the berm. That report recommends mitigation in the form of Passive Restoration to return the currently devoid understory to it natural state and function prior to the flood. Passive restoration means allowing natural processes to return to a riparian corridor by stopping activities that cause degradation or prevent recovery (Kauffman et al. 1997). In this case, Passive Restoration entails Invasive Species monitoring and removal, and the preservation of the stream buffers. Native plantings are not appropriate for this site because the soil within the stream buffers is comprised of gravelly cobbly sediment,and is unsuitable for plantings. At this point we cannot identify any additional measures necessary to mitigate the berm. The Passive Restoration Plan provided in the 2009 HMP should provide adequate mitigation to compensate for the construction of the berm within the stream buffers. All recommendations provided in Section 6.0 of that report should be applied to return the currently devoid understory to its natural state and function that existed prior to the flood. This letter should be attached as an addendum to the 2008 Habitat Management Plan prepared by TWC. We trust this information is sufficient for your needs at this time. The completed work took place within tax parcels 323192400000 and 323192400030. A Habitat Management Plan has already been prepared addressing emergency work within the portion of the property located south of the North Lilliwaup Street bridge crossing over Lilliwaup Creek. This Habitat Management Plan Addendum addresses that emergency work that occurred within the portion of the property located north of the North Lilliwaup Street bridge crossing over Lilliwaup Creek. The site is found in the SW 1/4 of Section 19, Township 23 North, Range 03 West WM (See Figure 1, Site Vicinity Map). The purpose of this Habitat Management Plan (HUT) is to address potential impacts resulting from the emergency work within the buffers and banks of a type F stream (Beardslee Creek) and a type S stream (Lilliwaup Creek), occurring in response to the damage caused by the flooding of Lilliwaup Creek in December 2007. Both Type F and Type S streams in Mason County require a 150-foot buffer with an additional 15-foot building setback. The work took place upstream of the Lillewaup Fish Hatchery. An Emergency Mason Environmental Permit was issued by Mason County Staff on July 240' 2008. The MEP was issued to restore and protect the major spawning location for ESA- listed Summer Chum, protect property and structures from further damage, and protect Lilliwaup Hatchery from catastrophic loss of Hamma and Lilliwaup summer chum and Duckabush and Dewatto winter steelhead reared at the facility. The emergency work entailed: 1) The removal of approximately 2100 cubic yards of sediment from the Lilliwaup Creek bank and bed. The sediment removal was necessary prevent further devastation and sediment accumulation to the spawning grounds, and to protect large shade trees from being destroyed by the massive sediment load(See photos below). 2) The removal of approximately 600 cubic yards of clogged sediment from a 60" culvert for Beardslee Creek. Approximately 500 cubic yards of the removed sediment was used to backfill an existing retaining wall within the Lilliwaup Creek buffer for the purpose of protecting an existing residence from bank erosion. An additional 500 cubic yards of the removed sediment was used to fill an overflow channel for Lilliwaup Creek, caused by the flood. The objectives of this HMP are as follows: ■ To evaluate the potential adverse effects to critical area functions as well as fish and wildlife habitat resulting from 1) the completed removal of accumulated aggradation within a type S stream and utilization of the sediment to backfill an existing retaining wall and an overflow channel, both within the stream buffer; and 2) the removal of clogged sediment within a 60" culvert for Beardslee Creek, a Type F stream. Emphasis is placed on the possible loss of habitat for any listed species found to be residing in the vicinity of the parcel. ■ To identify possible mitigation measures that could be implemented to offset the adverse effects resulting from the completed work within the streams and buffers. PROPERTY DESCRIPTION The parcels discussed in this report total 37 acres in size, are located north of the bridge crossing for Lilliwaup Creek, and are north of the Lilliwaup Fish Hatchery office and maintenance buildings. The southern portion of parcel 323192400030 contains a single family residence and lawn area near the east bank of Lilliwaup Creek. Beardslee Creek is a tributary to Lilliwaup Creek, and enters the northeastern portion of parcel 323192400030 and drains into the elbow of Lilliwaup Creek. With the exception of the existing residence and lawn area, vegetation throughout the property is comprised of an overstory of Douglas fir, big leaf maple, and western red cedar, with an understory of salal, swordfern, salmonberry,brackenfern, and evergreen huckleberry. Topography within the property is undulating, consisting of steep slopes and ravines generally grading southerly, down toward Lilliwaup Creek. APPLICABLE SETBACKS The completed project is within the jurisdiction of Mason County. Ordinance 17.01.040 identifies Fish and Wildlife Habitat Conservation Areas adopted by Mason County. The applicable setback for this project is as follows: Habitat Type Buffer Building Setback from Buffer Type F Stream(Beardslee Creek) 150' 15, Type S Stream(Lilliwaup Creek) 150' 15' DESCRIPTION OF HABITAT AND SPECIES Puget Sound Chinook(Oncorhynchus tshawytsha)-Threatened Listed as threatened since March 24, 1999 adult Puget Sound Chinook spawn in several rivers and streams flowing into Puget Sound. The Lilliwaup River estuary is listed by the NOAA Fisheries Northwest Region Critical Habitat Designations for West Coast Salmon and Steelhead in Washington - August 2005 as a Final Critical Habitat Designation. Although Beardslee Creek(a type F stream) is accessible to fish, it does not support optimal habitat for Puget Sound Chinook due to the limited size and lack of sufficient flow during the spawning period. Adult Chinook have been observed spawning in Lilliwaup creek on an intermittent basis. The Lilliwaup hatchery has been used to raise chinook for various restoration programs throughout Hood Canal. The removal of the accumulated sediment was necessary to restore the riparian areas and spawning habitat that was destroyed during the flood. No damage to the streams or buffers occurred from the sediment removal or manipulation. No impacts to water quality or other instream characteristics important to Puget Sound Chinook are anticipated or likely to have occurred. Hood Canal Summer Chum (Oncorhynchus keta)- Threatened Known Hood Canal Summer Chum spawning areas in proximity to the site include Lilliwaup Creek. Summer chum adults are present throughout late summer and early fall while juveniles migrate immediately to the estuary upon hatching. Chum salmon generally prefer medium size gravels that are relatively sand and silt free. The completed project did not require the removal of any trees. As no important habitat features have been removed nor are proposed to be removed, this project will have no adverse impacts on bald eagles. Marbled Murrelet($rachyramphus marmoratus)-Threatened Marbled Murrelets are typically associated with coastal habitats and nest in old-growth forests. Murrelets may fly as far as 50 miles inland to nest, however the average distance is roughly 5-miles from nest to sea. It is only during the summer breeding months that they are commonly found inland. During non-nesting seasons they live at sea. Murrelets require tall mossy trees in coniferous old growth forests with cavities on thick branches where they can construct a cup nest 20-40 meters above the forest floor. Murreletts have been documented laying eggs on rocky ground habitats only when a sufficient forest is unavailable. There are no documented nesting sites surrounding the project site. No potential nesting trees are within the project area. This project will likely have no adverse impact on Marbled Murrelet given there are no documented nesting sites or potential nesting trees in the vicinity of the project area. Northern Spotted Owl(Stria occidentalis caurina)-Threatened Spotted owls require a large amount of land for their nesting and hunting grounds; pairs may occupy up to 58 sq. km. They are territorial and do not migrate, but they may shift their ranges slightly in response to seasonal changes. Suitable spotted owl habitat includes trees relatively large in diameter, multi-layered forest canopy with a moderate to high canopy closure in overstory, midstory, and understory, large, tall, live trees with cavities, broken tops, mistletoe, or platforms of branches capable of holding accumulated organic matter suitable for use as a nest. Dead standing trees and fallen decayed trees supporting abundant populations of prey species are critical to spotted owl populations. Currently there are no spotted owl nesting sites documented in proximity to the project site. As spotted owls are currently not present, and the project is of a scale that has no impact on forested components within the parcel,no impacts to spotted owl or their habitat are expected result from the completed and proposed project. ANALYSIS OF EFFECTS The project lies within a type F stream and a type S stream and associated buffer. No damage to the streams or buffers occurred from the completed work, beyond what was caused by the flood. Using the accumulated sediment to backfill the existing retaining wall was necessary to avoid future damage to the stream buffer and the existing residence. Measures are provided in this report to protect water quality and other habitat features potentially important to all fish species potentially inhabiting the stream. Puget Sound Steelhead (Oncorhvnchuus myklss)-Threatened Listed as Threatened since May 2007, Puget Sound Steelhead spawn in several streams throughout Puget Sound. Spawning usually occurs in moderate to steep gradient sections of streams, usually in heads of riffles or the tails of pools where hydraulic conditions are conducive to intragravel flow. Side channels and the anterior portions of islands are also used. Spawn timing for summer steelhead runs typically ranges from mid May through October while winter run steelhead are present from December through May. Adequate cover from predation, water temperature, and spawning gravel are important factors for instream habitat,while little is currently known about specific marine habitat requirements. Lower Lilliwaup Creek and the associated estuary is listed in the NOAA Fisheries Northwest Region Critical Habitat Designations for West Coast Salmon and Steelhead in Washington-August 2005. The removal of the accumulated sediment in both streams was necessary to restore the riparian areas and spawning habitat that was destroyed during the flood. No further damage to the streams or buffers occurred beyond what was caused by the flood, No modifications to the stream channel have been completed that would negatively impact Puget Sound Steelhead. Measures are provided in this report to protect water quality and other habitat features potentially important to all fish species potentially inhabiting the stream. Bull Trout(Salvelinus malma)-Threatened Bull trout typically inhabit very cold, clear headwater streams at high elevations that are supported by snowmelt. For spawning and early rearing, bull trout require loose, clear gravel,relatively free of fine sediments. There is no documentation of bull trout in Lilliwaup creek or the unnamed streams passing through the center of the property. Although potential habitat may be present,the completed work will in no way modify instream habitat or water quality potentially important to bull trout. Bald Eagle(Haliaeetus leucocephalus)-State listed: Threatened Habitat areas associated with Bald Eagle include uneven aged coniferous stands with some old-growth components. Nests are typically constructed in larger trees with dead or broken tops providing an unobstructed view of nearby water. Snags and trees with exposed lateral limbs,or dead tops are used as perches and defense stations. No trees were removed for the completed project. No native vegetation was removed for the completed project because it had already been destroyed by the flood. Designated Critical Habitat for Salmonids The Lilliwaup River estuary is listed by the NOAA Fisheries Northwest Region Critical Habitat Designations for West Coast Salmon and Steelhead in Washington - August 2005 as a Final Designation. Therefore, Designated Critical Habitat for Salmonids is within the project area. However,none of the completed actions are likely to destroy designated critical habitat. Actions described in this plan are not expected to jeopardize the continued existence of any listed species. Noise Pollution A slight increase in noise from construction activities was likely to occur during daylight construction hours. No nesting sites are located within the radii of concern that would be impacted by noise associated with the completed sediment removal or backfill activity. Temporary Increase in Sediment and Turbidity During Construction The work has the potential, be it unlikely, to temporarily increase turbidity and suspended sediment within the project area. Best Management Practices have been recommended to minimize the adverse effects to sediment supply and turbidity during project implementation. Light and Glare The completed and the proposed project will not and has not resulted in an increase in light and glare. No impacts to fish or wildlife use of the site are expected. MITIGATION MEASURES The purpose of the sediment removal was to restore the channel and gradient of the streams to the conditions that existed prior to the flood, and to save shade trees that were being choked by the sediment accumulation. Given that the streams were overlain with several feet of sediment following the flood, the sediment removal was absolutely necessary. Approximately 1000 cubic yards of the removed sediment was placed within the Lilliwaup Creek stream buffer in two separate areas. 500 cubic yards was used to backfill and stabilize a retaining wall near the existing residence, and 500 cubic yards was used to fill an overflow channel for Lilliwaup Creek,that was created during the December 2007 flood. However, soil occupying the available areas for replanting within stream buffer is comprised of a gravelly, cobbly material, and is not optimal for new plantings. Therefore, the likeliness that reintroduced plantings will succeed is minimal. However, the presence of mature, deciduous trees throughout the stream buffer is expected to contribute leaf litter to the soil and will eventually provide to more suitable soil conditions for native species. Given the lack of suitable soil for new plants and the potential for soil conditions to improve in the future, the appropriate mitigation recommended for the completed work within the buffers is best described as"Passive Restoration". Passive restoration means allowing natural processes to return to a riparian corridor by stopping activities that cause degradation or prevent recovery (Kauffman et al. 1997). Improving land management and letting nature do the repair is often more effective than trying to compensate for the damage. In this case, it is likely that simply reducing or eliminating the sources of degradation and allowing recovery time will be enough to allow the site to naturally regenerate. Upon the field visit, native species such as salmonberry (Rubus spectabilis)were observed to be volunteering in small isolated patches throughout the riparian corridors (See Photo below). Through preservation of the corridor by measures such as limiting foot traffic and activities throughout the stream buffers and removing invasive species, it is likely that the area will revegetate within 5 to 10 years, with as high or higher success rate than that of artificially installed plants. These species are stubborn competitors for light and nutrients and limit success of native plants. Invasive species should be removed from the enhancement zone should they invade. Herbicides should not be used to achieve this due to the proximity to the stream. Persistent cutting during the growing season is sufficient to offset the rhizomes of invasive species if they become a problem. MONITORING Monitoring of the site will begin the first fall following native species plantings and maintained on a seasonal basis. The information gathered will provide the following: 1) condition of the stream buffers; 2) the use of the site by wildlife species; 3) any disturbance caused by the sediment removal and backfill of the retaining wall and overflow channel, and its effect on the protected zone and associated aquatic habitat; 4) any occurrence of exotic species within the stream buffers; 5) any corrective measures that may be deemed necessary to provide desired conditions. This monitoring will be in effect for the duration of three years. The information gathered will be provided in an annual report and submitted to the Director of Mason County Department of Community Development. SUMMARY This report addresses the effects of 1) the removal of 2700 cubic yards of sediment from the accumulated aggradation within a type S stream (Lilliwaup Creek) and a type F stream (Beardslee Creek), caused by the December 2007 flood event and 2) the utilization 1000 cubic yards of the removed sediment to use as backfill to an existing retaining wall and to fill an overflow channel. The remainder of the removed sediment not used for stream restoration was either stockpiled or removed from the site. The purpose of the sediment removal was to re-establish both streams to the approximate contours prior to the flooding of Lilliwaup Creek in December 2007, and to save shade trees from being choked out from the sediment overload. The purpose of the backfill of the retaining wall was to provide stability to the existing retaining wall, in order to protect the existing residence from future damage during flood events. The purpose of the filling the overflow channel was to re-establish the upland elbow area for Lilliwaup Creek. Given the poor onsite soil conditions and potential for site improvement in the future, mitigation for the completed work within the stream buffer is recommended in the form of Passive Restoration, to return the currently devoid understory to it natural state and function prior to the flood. Native plantings are not appropriate for this site given the gravelly cobbly sediment that comprises soil within the stream buffers and is unsuitable for plantings. Passive Restoration for this site entails Invasive Species monitoring and removal, and the preservation of the stream buffers. No impacts to water quality or stream habitat are predicted to have occurred. ' � Approximate `� Parcel Location AN Onsite Soil Conditions based on Mason County Soil Survey Subject Site Soils: Soil type one is located within the southernmost portion of the parcel,and is identified as Grove gravelly sandy loam,0 to 5 percent slopes(Gh.)—This soil is a somewhat excessively drained soil occupying the large glacial outwash plains. The soil has developed from Vashon glacial drift,modified by inclusions of local basaltic rock and mixed material from the Olympic Mountain glaciers. Rainfall ranges from 60 to 100 inches per year. Vegetation is coniferous forest with an undersotry dominated by lower growing mosses,kinnikinnik,and snowberry,mixed with Huckleberry,salal,and Oregon-grape. This soil is strongly to medium acid and less acid with depth. Surface runoff is very slow because of the rapid permeability of the soil and the smooth topography. The soil is in capability subclass VIs. Soil type two has been identified as Grove gravelly sandy loam, S to 15 percent slopes(Gk).-is in places the surface soil and subsoil of this soil are 3 to 6 inches thinner than those of Grove gravelly sandy loam,0 to 5 percent slopes. The site is found in the SW %4 of Section 19, Township 23 North, Range 03 West WM (See Figure 1, Site Vicinity Map). The purpose of this Habitat Management Plan (HMP) is to address potential impacts resulting from the emergency landscape contouring activity within the buffers of two type F streams and a type S stream (Lilliwaup Creek), that took place in response to the damage caused by the flooding of Lilliwaup Creek in December 2007. The damage from the flood entailed several feet of sediment to be deposited over an area occupying approximately 0.75 acre, that contain the type F stream and a settling pond that is the headwater to the second type F stream. Lilliwaup Creek is a type S stream, requiring a 150-foot butler with an additional 15-foot building setback. The Type F streams require a 150-foot buffer and associated 15-foot building setback in Mason County. The purpose of the landscape contouring was to re-establish both stream channels and the pond that existed prior to the flood. In addition to the completed work, this report addresses the proposed installation of riprap at the base of the existing bridge that crosses Lilliwaup Creek and accesses the subject parcel. The purpose of the rip rap installation is to minimize erosion caused by future floods by enhancing the stability of the bank surrounding the bridge. The objectives of this HMP are as follows: ■ To evaluate the potential adverse effects to critical area functions as well as fish and wildlife habitat resulting from 1)the completed landscape contouring within the Type F stream buffers and Type S stream buffer; and 2) from the proposed rip rap installation within the Type S stream buffer. Emphasis is placed on the possible loss of habitat for any listed species found to be residing in the vicinity of the parcel. ■ To identify possible mitigation measures that could be implemented to olYset the adverse effects resulting from the completed landscape contouring within the stream buffers and the proposed rip rap installation within the type S stream buffer. Long Live'rhe Kings Habitat Management Plan TWC No.08W376 September,2008 Page No.2 PROPERTY DESCRIPTION The parcel is maintained as a fish rearing facility, containing maintenance and office buildings and a large lawn area occupied by hatchery rearing tanks. The parcel appears to be comprised largely of fill material, as a wetland area begins abruptly along the eastern property boundary, and continues south toward the estuary for Lilliwaup Creek which drains into Hood Canal. Lilliwaup Creek is located west of the property. Prior to the flood, the western and central portion of the property contained a settling pond and two streams that converge and run southerly, parallel to Lilliwaup River. Based on the channel width and gradient, the streams meet criteria for lishbearing streams. The landscape surrounding both streams was maintained primarily as lawn with some native shrub components, which is now overlain by the gravelly sediment. The stream buffers contain a mature overstory of big leaf maple,western red cedar and red alder that remained in tact during the flood. The property is surrounded by low density residential land use and undeveloped parcels. Topography within the parcel is generally flat. APPLICABLE SETBACKS The completed project is within the jurisdiction of Mason County. Ordinance 17.01.040 identifies Fish and Wildlife Habitat Conservation Areas adopted by Mason County, and Ordinance 17.01.070 identifies Wetland Areas adopted by Mason County. The applicable setback for this project is as follows: Habitat Type Buffer Building Setback from Buffer Type F Stream 150' 15' Type F Stream 150' 15' Type S Stream(Lilliwaup Creek) 150' 15, Category II Wetland 150' 15' DESCRIPTION OF HABITAT AND SPECIES Puget Sound Chinook(Oncorhynchus tshawytsha)-Threatened Listed as threatened since March 24, 1999 adult Puget Sound Chinook spawn in several rivers and streams flowing into Puget Sound. The Lilliwaup River estuary is listed by the NOAA Fisheries Northwest Region Critical Habitat Designations for West Coast Salmon and Steelhead in Washington - August 2005 as a Final Critical Habitat Designation. Adult Chinook have been observed spawning in Lilliwaup creek on an intermittent basis. The Lilliwaup hatchery has been used to raise Chinook for various restoration programs throughout Hood Canal. The landscape contouring was necessary to restore the riparian areas and spawning habitat that was destroyed during the flood. No damage to the streams or buffers occurred from the landscape contouring. The proposed rip rap installation is not likely to impact Puget Sound Chinook as impacts will be mitigated through the placement of Large Woody Debris throughout the rip rap structure. No impacts to water quality or other instream characteristics important to Puget Sound Chinook are anticipated or likely to have occured. Hood Canal Summer Chum (Oncorkynchus keta)-Threatened Known Hood Canal Summer Chum spawning areas in proximity to the site include Lilliwaup Creek. Summer chum adults are present throughout late summer and early fall while juveniles migrate immediately to the estuary upon hatching. Chum salmon generally prefer medium size gravels that are relatively sand and silt free. The landscape contouring was necessary to restore the riparian areas and spawning habitat that was destroyed during the flood. No damage to the streams or buffers occurred from the landscape contouring beyond what was caused by the flood. The proposed rip rap installation is not likely to impact Hood Canal Summer Chum as impacts will be mitigated through the placement of Large Woody Debris throughout the rip rap structure. Measures are provided in this report to protect water quality and other habitat features potentially important to all fish species potentially inhabiting the stream. Puget Sound Steelhead (Oncorhynchus mykiss)-Threatened Listed as Threatened since May 2007, Puget Sound Steelhead spawn in several streams throughout Puget Sound. Spawning usually occurs in moderate to steep gradient sections of streams, usually in heads of riffles or the tails of pools where hydraulic conditions are conducive to intragravel flow. Side channels and the anterior portions of islands are also used. Spawn timing for summer steelhead runs typically ranges from mid May through October while winter run steelhead are present from December through May. Adequate cover from predation, water temperature, and spawning gravel are important factors for instream habitat, while little is currently known about specific marine habitat requirements. Lower Lilliwaup Creek and the associated estuary is listed in the NOAA Fisheries Northwest Region Critical Habitat Designations for West Coast Salmon and Steelhead in Washington-August 2005. The landscape contouring was necessary to restore the riparian areas and spawning habitat that was destroyed during the flood. No further damage to the streams or buffers occurred beyond what was caused by the flood. No modifications to the stream channel have been completed that would negatively impact Puget Sound Steelhead. Measures are provided in this report to protect water quality and other habitat features potentially important to all fish species potentially inhabiting the stream. Bull Trout(Salvelinus malma)-Threatened Bull trout typically inhabit very cold, clear headwater streams at high elevations that are supported by snowmelt. For spawning and early rearing, bull trout require loose, clear gravel,relatively free of fine sediments. There is no documentation of bull trout in Lilliwaup creek or the unnamed streams passing through the center of the property. Although potential habitat may be present, the completed and proposed work will in no way modify instream habitat or water quality potentially important to bull trout. Bald Eagle(Haliaeetus leucocephalus)-State listed: Threatened Habitat areas associated with Bald Eagle include uneven aged coniferous stands with some old-growth components. Nests are typically constructed in larger trees with dead or broken tops providing an unobstructed view of nearby water. Snags and trees with exposed lateral limbs,or dead tops are used as perches and defense stations. There are no documented Bald Eagle nesting sites in the vicinity of the project area. The completed project did not require the removal of any trees. The proposed project does not require the removal of any trees. As no important habitat features have been removed nor are proposed to be removed, this project will have no adverse impacts on bald eagles. Marbled Murrelet(Brachyramphus marmoratas)-Threatened Marbled Murrelets are typically associated with coastal habitats and nest in old-growth forests. Murrelets may fly as far as 50 miles inland to nest, however the average distance is roughly 5-miles from nest to sea. It is only during the summer breeding months that they are commonly found inland. During non-nesting seasons they live at sea. Murrelets require tall mossy trees in coniferous old growth forests with cavities on thick branches where they can construct a cup nest 2040 meters above the forest floor. Murreletts have been documented laying eggs on rocky ground habitats only when a sufficient forest is unavailable. There are no documented nesting sites surrounding the project site. No potential nesting trees are within the project area. This project will likely have no adverse impact on Marbled Murrelet given there are no documented nesting sites or potential nesting trees in the vicinity of the project area. Northern Spotted Owl(Stria occWntalis caurina)-Threatened Spotted owls require a large amount of land for their nesting and hunting grounds; pairs may occupy up to 58 sq. km. They are territorial and do not migrate, but they may shift their ranges slightly in response to seasonal changes. Dead standing trees and fallen decayed trees supporting abundant populations of prey species are critical to spotted owl populations. Currently there are no spotted owl nesting sites documented in proximity to the project site. As spotted owls are currently not present, and the project is of a scale that has no impact on forested components within the parcel,no impacts to spotted owl or their habitat are expected result from the completed and proposed project. ANALYSIS OF EFFECTS The project lies within the regulated buffers of two type F streams and a type S stream. Project scale in the protected area is as follows: Development Type Habitat Type Project scale Landscape contouring Type S stream and Type F Stream buffers 0.75 acre Rip Rap installation Type S Stream Less than 50 lineal feet Vegetation Disturban ce v The completed landscape contouring occurred in the portion of the property that is devoid of understory vegetation due to the material deposited from the flood. No trees were removed for the landscape contouring. No native vegetation was removed for the landscape contouring because it was already destroyed from the flood. The proposed rip rap installation will not require the removal of native vegetation. No vegetation will be disturbed or displaced. Designated Critical Habitat for Salmonids The Lilliwaup River estuary is listed by the NOAA Fisheries Northwest Region Critical Habitat Designations for West Coast Salmon and Steelhead in Washington - August 2005 as a Final Designation. Therefore, Designated Critical Habitat for Salmonids is within the project area. However, none of the completed or proposed actions are likely to destroy designated critical habitat. Actions described in this plan are not expected to jeopardize the continued existence of any listed species. Noise Pollution A slight increase in noise from construction activities is likely to occur during daylight construction hours. No nesting sites are located within the radii of concern that would be impacted by noise associated with the installation of the rip rap material or completed landscape contouring activity. Best Management Practices have been recommended to minimize the adverse effects to sediment supply and turbidity during project implementation. Light and Glare The completed and the proposed project will not and has not resulted in an increase in light and glare. No impacts to fish or wildlife use of the site are expected. MITIGATION MEASURES Landscape Contouring The purpose of the landscape contouring was to restore the channel and gradient of the streams and settling pond to the conditions that existed prior to the flood. Given that the streams and settling pond were overlain with several feet of sediment following the flood, the landscape contouring was absolutely necessary. Currently, the stream buffers contain a mature vegetative overstory with no understory. Typically, for projects within stream buffers, compensatory mitigation is recommended in the form of native tree, shrub and groundcover plantings throughout the buffer. However, the soil occupying the stream buffers for this site is comprised of a gravelly, cobbly material, and is not optimal for new plantings. Therefore, the likeliness that reintroduced plantings will succeed are minimal. However, the presence of mature, deciduous trees throughout the stream buffer is expected to contribute leaf litter to the soil and will eventually provide to more suitable soil conditions for native species. Given the lack of suitable soil for new plants and the potential for soil conditions to improve in the future, the appropriate mitigation recommended for the completed work within the buffers is best described as "Passive Restoration". Passive restoration means allowing natural processes to return to a riparian corridor by stopping activities that cause degradation or prevent recovery (Kauffman et al. 1997). Improving land management and letting nature do the repair is often more effective than trying to compensate for the damage. In this case, it is likely that simply reducing or eliminating the sources of degradation and allowing recovery time will be enough to allow the site to naturally regenerate. Upon the field visit, native species such as salmonberry (Rubus spectabilis) were observed to be volunteering in small isolated patches throughout the riparian corridors (See Photo below). Through preservation of the corridor by measures such as limiting foot traffic and activities throughout the stream buffers and removing invasive species, it is likely that the area will revegetate within 5 to 10 years, with as high or higher success rate than that of artificially installed plants. Native species are beginning to recruit the stream buffers. Invasive species such as Himalayan blackberry, reed canary grass, Japanese knotweed, and English Ivy may invade the stream buffers. These species are stubborn competitors for light and nutrients and limit success of native plants. Invasive species should be removed from the enhancement zone should they invade. Herbicides should not be used to achieve this due to the proximity to the stream.. Persistent cutting during the growing season is sufficient to offset the rhizomes of invasive species if they become a problem. Rip Rap Installation To mitigate for the proposed rip rap installation under the bridge along the bank of Lilliwaup Creek, it is recommended that the riparian habitat be enhanced through the incorporation of Large Woody Debris into the armoring design. Large woody debris plays an important role in stream habitat by providing organic matter and algae as food, and aquatic habitat for invertebrates and fish. The LWD may be brought in from offsite and randomly situated and anchored to the rip rap to promote pool habitat. The information gathered will provide the following: 1) condition of the stream buffers; 2) the use of the site by wildlife species; 3) any disturbance caused by the landscape contouring activity and its effect on the protected zone and associated aquatic habitat; 4) any occurrence of exotic species within the stream buffers; 5) any corrective measures that may be deemed necessary to provide desired conditions. This monitoring will be in effect for the duration of three years. The information gathered will be provided in an annual report and submitted to the Director of Mason County Department of Community Development. SUMMARY This report addresses the effects of 1) the landscape contouring activity that occurred in response to the deposit of several feet of sediment over an area occupying approximately .75 acre that contains two type F streams, settling pond, and a type S stream; and 2)the proposed installation of rip rap along the bank of Lilliwaup Creek (type S stream) near the existing bridge. The purpose of the landscape contouring was to re-establish both streams and the pond in the approximate location prior to the flooding of Lilliwaup Creek in December 2007. The purpose of the rip rap installation is to protect the existing bridge from erosion caused by Lilliwaup Creek. Native plantings are not appropriate for this site given the gravelly cobbly sediment that comprises soil within the stream buffers and is unsuitable for plantings. Passive Restoration for this site entails Invasive Species monitoring and removal, and the preservation of the stream buffers. No impacts to water quality or stream habitat are predicted to have occurred. To mitigate for the proposed rip rap installation, it is recommended that Large Woody Debris be interspersed throughout the rip rap to enhance the habitat features along the stream bank. ' A ' Approximate a� Parcel Location 1x,•_- at I � Onsite Soil Conditions based on Mason County Soil Survey Subject Site Soils: Soil type one is located within the southernmost portion of the parcel,and is identified as Grove gravelly sandy loam,0 to 5 percent slopes(Gh.)- This soil is a somewhat excessively drained soil occupying the large glacial outwash plains. The soil has developed from Vashon glacial drift,modified by inclusions of local basaltic rock and mixed material from the Olympic Mountain glaciers. Rainfall ranges from 60 to 100 inches per year. Vegetation is coniferous forest with an undersotry dominated by lower growing mosses,kinnikinnik,and snowberry,mixed with Huckleberry,salal,and Oregon-grape. This soil is strongly to medium acid and less acid with depth. Surface runoff is very slow because of the rapid permeability of the soil and the smooth topography. The soil is in capability subclass VIs. Soil type two has been identified as Grove gravelly sandy loam, 5 to 15 percent slopes(Gk).- is in places the surface soil and subsoil of this soil are 3 to 6 inches thinner than those of Grove gravelly sandy loam,0 to 5 percent slopes.
