Mason County Department of Health Services COMMENTING OFFICIAL: Carolyn Jensen, Environmental Health Specialist DATE: December 8, 1992 COMMENT A community well can be placed on the new proposed well site provided the following conditions are met: Mitigation measures must be taken to protect the well from inundation from flood events since the new well site is within the flood plain of the Union River. These mitigation measures must be in accordance with state and local regulations. * The Union River must not provide drinking water to this well; therefore, the well must be sufficiently deep to withdraw water from an aquifer that does not support the Union River. Union River. Ellis Bancroft Tracts, Tr. 2-4 except 2-A & 3-A within NEU, NWU of Section 16, Twn 23N, R 1W. Parcel # 12316 50 00002. 2794 Old Belfair Highway. Four unit apartment complex; and a garage with upstairs apartment unit. After receiving a copy of the Matijevich septic permit, it was apparent that the first condition of the Dale Tahja design was inconsistent with shoreline policy and would not be acceptable. That condition required diverting or tightlining that portion of the stream on the property which would not meet the required 100 foot surface water to drainfield setback. The Department of wildlife's Stephan Ralinowski had similar concerns. Stephan mentioned that Doris Small of the Department of Fisheries had found fish in the stream thus giving the stream no less than a Class III rating. This department cannot approve of the tightlining of any creeks rated Class IV through I, especially when those waters fall within the shoreline jurisdiction. The tightlining of creeks ie an inappropriate method for meeting septic standards. From our discussion on February 10, 1992, Pat Matijevich will engage Dale Tahja in re-evaluating the site to determine whether a new arrangement of buildings and septic can fit within the parameters of the various health and shoreline mandated setbacks. Per shoreline policy, the buildings may not encroach within 50 feet of the Union River or the associated stream. Dew Mr. Yando: Because of present water quality problems in the Union River and Lynch Cove. the Washington State Department of Health(DOH)appreciates the opportunity to comment on the above proposed development Based on the SEPA checklist information received from your office. DOH has the following Comments and concerns on the proposal. The pressurized transport pipe to the proposed drafntleld does not meet WAC 246-272-140 (1) minimum horizontal separations requirements from the surface water,and existmgand proposed wells. Under WAC 248-96-160, the local health officer may, utwn concurrence of DOH, waive these regulations. However. our department has not received a request for Concurrence. We are particularly interested in what additional measures, if any, are provided protecting the h integrity of the transport pipe, surface water, and wells since minimum state setback requirements are not being met. If waivers have been approved locally, this information must be submitted to DOH for review and Concurrence as part of required technical Justification In ths waiver process. Another concern we have is whether a public water system, as defined In WAC 248-54-006, has been approved for the development. The proposal shows a 100 foot radius wound the existing and future wells. The sewage system transports pipe encroaches upon the radius. Subsequently, neither well meets source protection requirements of WAC 248-54-125 for public water systems.
