we have followed the rule book, and got all permits and inspections when
they were needed.
permits and inspections cost us a lot of time and money.
it makes us mad when neighbors don't follow the rule book, and then brag
about what they get away with and how much money it saved them.
if you saw what was going on down at the end of smithy forge lane with
that Rooze house on the hill to the right you would see a lot of construction
goin on without a scrap of permit paper in site.

I have been asked to write this letter by neighbors who have written two letters, regarding
their concerns , one to you at your Shelton Commissioner's office, and another one to the Shelton
Department of Community Development. They are of an opinion that their minimal writing skills
may have mitigated against consideration of the issues involved, ergo - their request that I present
their concerens - once again.

NOW EVEN I AM PUZZLED AT THE INACTION CONCERNING VALID CITIZEN
COMPLAINTS BROUGHT TO YOUR ATTENTION (ABOVE) AS WELL AS THE SUPPOSED
RESPONSIBLE PEOPLE AT THE DEPARTMENT OF COMMUNITY DEVELOPMENT AT THE
MASON COUNTY LEVEL.
SUSPICION IS THAT THE ARMY OF STAFF BETWEEN THE MAIL RECEIPT AND THE
'ACTION' DESKS ARE TOO OVERLOADED WITH THEIR VARIOUS TASKINGS THAT THEY CAN
NOT SPARE THE TIME TO FLESH OUT THE COMPLAINTS WITH MORE MEANINGFUL
LOCATION DATA. FORTUNATELY ONE OF THE CONCERNED CITIZENS HAS BEEN ABLE TO
ACCESS THE INTERNET AND HAS PROVIDED THE FOLLOWING DATA - IDENTIFYING THE
PROPERTY WHICH THEY ARE CONVINCED WAS FURTHER DEVELOPED WITHOUT THE
COUNTY ISSUING BUILDING PERMITS OR CONDUCTING THE NECESSARY INSPECTIONS TO
ASSURE THAT THE CONSTRUCTION MEETS SAFETY STANDARDS AND IS NOT A DANGER
TO THE OCCUPANTS OR THE NEIGHBORHOOD.
THE PROPERTY IS IDENTIFIED AS PARCEL NUMBER 2230276000080 AT 150 SMITHY
FORGE LN. OWNER IS LISTED AS DAVID & CAROL RAINES, REPORTED TO BEING
PRESENTLY OCCUPIED AND MODIFIED BY CHARLES & PATRICIA RUIZ. SEVERAL NEARBY
PROPERTIES ARE ALSO LISTED AS BEING OWNED BY THESE SAME PEOPLE.

The receipt of this notice shall constitute service regarding notification of alleged violations of
the Mason County Code, and shall also serve as Warning Notice pursuant to Mason County
Code, Title 15, Section 15.13.035. The violation(s) are occurring at the following property:
Enforcement Case: BCC2009-00085

❑ Our office has received a complaint that grading, clearing and construction work are in
progress or have been completed at the parcel described above without required
building permits or approval. Our files indicate that building permit#18529 was issued
in April 1986 to remodel the existing 16-ft x 20-ft non-conforming storage structure with
non-conforming loft and add a 16-ft x 14-ft single story structure converting the entire
structure to a dwelling unit. A copy of the information contained in the files is included
including a building permit application, proposed building plans and site inspection
records. A final occupancy inspection was never performed on the structure as
evidenced by the inspection card enclosed. Final occupancy inspections are required
for all building permits prior to occupancy of the structure. Further investigation of
records available to our office finds that the structure has had additional construction
work including modifications to the roof and adding a full height upper floor, porches
and covers over porches without obtaining the required building permits or approval.
Based upon evidence available to our office we believe the complaint is valid. In order
to properly evaluate whether the complaint is valid a building inspector will need
permission to enter the property. At the time of inspection access to the site was
posted with no trespassing signs.

The parties shall respond to the county within twenty days of the postmark of this notice.
Order
YOU ARE HEREBY ORDERED to abate the alleged violation in the following manner.
1) Contact our office to arrange for a site inspection in order to verify whether the complaint
is valid. During the inspection the Mason County Building Inspector will be able to
review existing conditions and identify exempt and non-exempt structures and
appliances.
2) Apply for building permit(s) for the regulated structures and appliances located on the
parcel.
3) Request and pay required fees in order to obtain a final occupancy approval of building
permit number 18529.
4) Remove all non-exempt structures and contact our office to request a compliance
inspection in order to verify that the structure(s) has been removed.
Penalties
This notice is to inform you that in the event that you fail to comply, we will pursue additional
enforcement action against you, including but not limited to recording against the parcel, civil
infractions, liens against the property through the Mason County Hearings Examiner process
and/or criminal prosecution as allowed under Title 15.13 of the Mason County Code.
