The violation(s) are occurring at the following property: Enforcement Case: BCC2009-00085 Parcel Number: 22302-76-00080 Site Address: 150 NE Smithy Forge Lane, Belfair, WA 98528 Legal Description: Tr 8 of Survey Vol 2, Pg 116 ❑ Our office has received a complaint that grading, clearing and construction work are in progress or have been completed at the parcel described above without required building permits or approval. Our files indicate that building permit #18529 was issued in April 1986 to remodel the existing 16-ft x 20-ft non-conforming storage structure with non-conforming loft and add a 16-ft x 14-ft single story structure converting the entire structure to a dwelling unit. A copy of the information contained in the files is included including a building permit application, proposed building plans and site inspection records. A final occupancy inspection was never performed on the structure as evidenced by the inspection card enclosed. Final occupancy inspections are required for all building permits prior to occupancy of the structure. Further investigation of records available to our office finds that the structure has had additional construction work including modifications to the roof and adding a full height upper floor, porches and covers over porches without obtaining the required building permits or approval. Based upon evidence available to our office we believe the complaint is valid. In order to properly evaluate whether the complaint is valid a building inspector will need permission to enter the property. At the time of inspection access to the site was posted with no trespassing signs. According to the Mason County Assessor records, parties named above hold legal interest in the parcel and are therefore subject to enforcement action for failure to comply. The parties shall respond to the county within twenty days of the postmark of this notice. Order YOU ARE HEREBY ORDERED to abate the alleged violation in the following manner: 1) Contact our office to arrange for a site inspection in order to verify whether the complaint is valid. During the inspection the Mason County Building Inspector will be able to review existing conditions and identify exempt and non-exempt structures and appliances. 2) Apply for building permit(s) for the regulated structures and appliances located on the parcel. 3) Request and pay required fees in order to obtain a final occupancy approval of building permit number 18529. 4) Remove all non-exempt structures and contact our office to request a compliance inspection in order to verify that the structure(s) has been removed. Penalties This notice is to inform you that in the event that you fail to comply, we will pursue additional enforcement action against you, including but not limited to recording against the parcel, civil infractions, liens against the property through the Mason County Hearings Examiner process and/or criminal prosecution as allowed under Title 15.13 of the Mason County Code.
