Description of Proposal: After the fact shoreline variance for two (2) 6ft chain link fences
with privacy slats on easterly and westerly property lines of
applicants property, extending into Lake Isabella approximately
10 feet.

The Lead Agency for this proposal has determined that it does not have a probable significant
adverser impact on the environment. An Environmental Impact Statement (EIS) is not required
under RCW 43.21C.030(2)(c). This decision was made after review of a completed Environmental
Checklist and other information on file with the Lead Agency. This information is available to the
public upon request. MITIGATED MEASURES ARE ATTACHED.

Dear Ms.Bennett-Cumming:
Thank you for the opportunity to comment on the mitigated determination of nonsignificance for the after
the fact shoreline variance for two 6-foot chain link fences with privacy slats on easterly and westerly
property lines of applicant's property,extending into Lake Isabella approximately 10 feet(SEP2002-
00064), located at 924 West Delight Park Road, as proposed by Scott P.Woodward. We reviewed the
environmental checklist and have the following comments:
There is nothing in the checklist indicating the need for these fences to extend in to the water, let along
waterward of the residential setback. As currently constructed,the fences violate Residential Use
Regulation#8 in the Mason County Shoreline Master Program which requires that fences not exceed 30"
in height. Is the requested variance both for the height and setback encroachments?
In reviewing the checklist,it appears that these fences fail to meet the variance criteria set forth in WAC
173-27-170. These include the need for the applicant to demonstrate that all reasonable use of the
property is precluded,that the public rights of navigation are not adversely affected, that there are unique
conditions related to the property, that design of the project is compatible with other authorized uses,that
there is no grant of special privilege and that the proposal is the minimum necessary to afford relief.
There is nothing about the proposal,as presented in the checklist,which appears consistent with the above
criteria.
In addition,photocopied photos were hard to read and do not substitute for the required site plans in a
shoreline permit submittal. Site plans must conform to the requirements in WAC 173-27-180 which
includes, in part,the need for a scaled drawing showing the boundary of the entire affected parcel,the
ordinary high water mark of the lake,existing and proposed land contours, dimensions and locations of all
existing and proposed structures,and a delineation of all wetland areas altered or used as part of the
development. Please note that on all variance applications the plans must clearly indicate where
development could occur without approval of a variance.
