Reviewing the scope of the project, indicates that this parcel currently has no legal access. The only route that legal access could be obtained, is across the DNR parcels, and it has not been acquired. Spring Hill Road, as one of several roads accessed from Hurd Road, allows access to approximately nineteen parcels, six of which appear to have structures. This appears to be a county wide issue of the Department of Community Development allowing the development of properties that do not have legal access over DNR parcels. A further complication to this project is that the DNR parcels have been burdened with a Recreation and Conservation Office Covenant,to keeping those lands preserved for Public Recreation Purposes. It is DNR's opinion that a grant of an easement would likely be deemed to be an inconsistent use per the Recreation and Conservation Office. The Covenant will be in effect until March 29th,2041,and would severely limit the options available to users of Hurd Road,which is a private road. If the project proponent wishes to acquire legal access, it would likely require payment of full market value(RCW 79.36.355)as well an additional exchange of recreation land equal to or greater than the land needed. Such land would need to also be equivalent or greater usefulness, and the location must be near the location for which the public recreation purposes for which state assistance was originally granted(RCW 79A.15.030 implemented by WAC 286-27-066),and at the determination of the Recreation and Conservation Office only.
