Description of This SEPA is associated with an application for a
Proposal: Class IV G FPA on a 40-acre site consisting of eight
5-acre parcels.The purpose of the logging is
primarily a "real estate cut" to market these
parcels.The site contains, and is adjacent to,
critical areas; steep slopes to the east and NW and
ravines to the east containing a F-stream (off site)
and two Ns feeder streams.The LSHAs will have a
50' cutting setback, and the streams will have
over-lapping 150' (F) and 75' (Ns) buffers.
Stormwater and erosion control was addressed in
a geo-technical report by Envirotech Engineering
which was found to be complete by the County.
Slope and stream buffers (the greater of the two)
shall be flagged prior to FPA approval.

adverse impact on the environment. An Environmental Impact Statement (EIS) is not required
under RCW 43.21C.030(2)(c).This decision was made after review of a completed Environmental
Checklist and other information on file with the Lead Agency.This information is available to the
public upon request.

CONDITIONS For FPA 2022-00007
1. ARCHAEOLOGICAL RESOURCES
Archaeological or historical resources, such as ruins, sites, buildings, artifacts,fossils, or other
objects of antiquity that may have significance from an historical or scientific standpoint, which
may be encountered by the developer/contractor, shall not be further disturbed. If the
developer/contractor encounters any such artifacts, he/she shall immediately stop work and
notify Mason County and the Washington State Department of Archaeology and Historic
Preservation. Failure to do so may result in civil penalties.
2. STORM WATER & EROSION CONTROL
Escape of silty water or mud from this property shall be considered a violation of County
and State storm water management regulations and could subject the applicant(s) to
civil fines or penalties. The applicant shall follow the requirements, of the stormwater
and erosion control plan written by Enviotech Engineering (Project# 22130).
3. HOURS OF OPERATION
Noise associated with this application shall not exceed what is allowed under Mason
County Code 9.36. Harvest operations shall start no earlier than 7:00 AM and shall end
before 8:00 PM on a daily basis.
4. SLASH ABATEMENT
This Forest Practice Application indicates that forest debris resulting from the proposed
logging operation may create an extreme fire hazard under RCW 76.04.600 and WAC
332-24-650. An extreme fire hazard could be created if one or more of the conditions
found in WAC 332-24-650 is located within 100 feet of the running surface of a public
road; or is within 500 of an existing structure and/or designated public use area, which
is not owned by the owner of the fire hazard area. The landowner is fully liable in the
event of fire if he or she fails to appropriately abate the hazard. Extreme fire hazards
shall be abated by removing the forest debris, or by other means approved by the
Washington State Department of Natural Resources (DNR).
5. STREAM and STEEP SLOP SETBACKS
The minimum setbacks from the off-site F-Stream is 150'. Cutting setback from the two
on site Ns streams is 75' on each side. In addition to the stream buffer, no vegetation
shall be removed that is within 50' of the critical slopes as described by Envirotech
Engineering in their geotechnical report (Project# 22130). These buffers shall be flagged
and shall be observed.

Thank you for the opportunity to comment on the determination of nonsignificance for the Tru
North FPA Project(SEP2022-00034)located at 171 East Johnson Ridge Drive as proposed by
Tru North Investments. The Department of Ecology(Ecology)reviewed the environmental
checklist and has the following comment(s):
SOLID WASTE MANAGEMENT: Derek Rockett(360)407-6287
All grading and filling of land must utilize only clean fill. All other materials may be
considered solid waste and permit approval may be required from your local jurisdictional
health department prior to filling. All removed debris resulting from this project must be
disposed of at an approved site. Contact the local jurisdictional health department for proper
management of these materials.

No confirmed or suspected contaminated sites are located on or within 1/4 mile of the
property. No other comments.
WATER QUALITY/WATERSHED RESOURCES UNIT:

Erosion control measures must be in place prior to any clearing, grading, or construction.
These control measures must be effective to prevent stormwater runoff from carrying soil
and other pollutants into surface water or stormdrains that lead to waters of the state. Sand,
silt,clay particles, and soil will damage aquatic habitat and are considered to be pollutants.
Any discharge of sediment-laden runoff or other pollutants to waters of the state is in
violation of Chapter 90.48 RCW,Water Pollution Control,and WAC 173-201A,Water
Quality Standards for Surface Waters of the State of Washington, and is subject to
enforcement action.

Construction Stormwater General Permit:
The following construction activities require coverage under the Construction Stormwater
General Permit:
l. Clearing, grading and/or excavation that results in the disturbance of one or more
acres and discharges stormwater to surface waters of the State; and
2. Clearing, grading and/or excavation on sites smaller than one acre that are part of a
larger common plan of development or sale, if the common plan of development or
sale will ultimately disturb one acre or more and discharge stormwater to surface
waters of the State.
a) This includes forest practices (including,but not limited to, class IV conversions)
that are part of a construction activity that will result in the disturbance of one or
more acres, and discharge to surface waters of the State; and
3. Any size construction activity discharging stormwater to waters of the State that
Ecology:
a) Determines to be a significant contributor of pollutants to waters of the State of
Washington.
b) Reasonably expects to cause a violation of any water quality standard.
If there are known soil/ground water contaminants present on-site, additional information
(including,but not limited to: temporary erosion and sediment control plans; stormwater
pollution prevention plan; list of known contaminants with concentrations and depths found;
a site map depicting the sample location(s); and additional studies/reports regarding
contaminant(s))will be required to be submitted. For additional information on contaminated
construction sites,please contact Carol Serdar at Carol.SerdarAecy_wa.gov, or by phone at
(360) 742-9751.
Additionally, sites that discharge to segments of waterbodies listed as impaired by the State
of Washington under Section 303(d)of the Clean Water Act for turbidity, fine sediment,high
pH, or phosphorous,or to waterbodies covered by a TMDL may need to meet additional
sampling and record keeping requirements. See condition S8 of the Construction Stormwater
General Permit for a description of these requirements. To see if your site discharges to a
TMDL or 303(d)-listed waterbody,use Ecology's Water Quality Atlas at:

The applicant may apply online or obtain an application from Ecology's website at:

site operators must apply for a permit at least 60 days prior to discharging stormwater from
construction activities and must submit it on or before the date of the first public notice.

On March 28, 2002 the Washington State Supreme Court ruled that the RCW 90.44.050
permit exemption does not apply where a developer of a residential subdivision proposes
multiple wells to serve each lot in the development if in combination,the withdrawal will
exceed the exemption criteria.

Under a new law that became effective January 19,2018 (ESSB 6091), new ground water
withdrawals from wells within the Kennedy-Goldsborough watershed will be limited to a
maximum annual average of 950 gallons per day,per connection, for indoor and outdoor
domestic uses.
RCW 90.44.050 still limits the overall withdrawal to 5,000 gallons per day and up to one-half
acre of lawn or noncommercial garden irrigation for the entire project as long as the annual
average does not exceed 950 gallons per day per connection. Any use above this level
requires a water right permit.
All water wells constructed shall be in accordance with the provisions of Chapter 173-160
WAC by a driller licensed in the State of Washington. All wells must be located a minimum
of 100 feet from any known, suspected, or potential source of contamination and shall not be
located within 1,000 feet of the property boundary of solid waste landfills. A well report
must be submitted to the Department of Ecology within thirty days after the completion of a
well.
Ecology's comments are based upon information provided by the lead agency. As such,they
may not constitute an exhaustive list of the various authorizations that must be obtained or legal
requirements that must be fulfilled in order to carry out the proposed action.
