FINDINGS OF FACT
FPA Case#2022-00007
APPLICANT: Tru North
APPLICATION DATE: May 10, 2022
Mason County has reviewed the above referenced application for Class IV General Forest
Practices and finds it in conformance with all applicable County land use regulations in
effect at the time of application.
FINDINGS
The proposed FPA is compliant with the following conditions:
The proponent has paid the prescribed fees.
The proponent has filed a complete, signed application.
A map has been received that complies with the requirements of 11.05.120:
(I) Harvest boundaries and tree retention areas.
(II) The approximate location of any structures.
(III) The location of all existing and proposed streets, right-of-ways, easements, skid
roads, haul roads, and landings within the proposal.
(IV) The location of future land development including stormwater management
facilities and vegetation to be retained for site landscaping, open space, wildlife
habitat, screening, and/or buffers.
(V) Site topography at contour intervals of 40 feet.
(VI) Critical areas and critical area buffers regulated pursuant to the Critical Areas
Ordinance.
(VII) Drainage ways and culverts.
(VIII) Site area targeted for further harvest including proposed timing.
(IX) North arrow and scale shall be shown on all site plans. The scale shall be no
smaller than one inch to 200 feet.
That this FPA is in conformance with the following Mason County ordinances:
11.05
That the proposed FPA involves 18 acres of a 40 acre site.
That the notifications required by 11.05.060 have been made if applicable.
Note: Harvest unit is greater than 500 ft from any State Park.
Mason County Resource Ordinance

_X_That at the issuance of this permit will not result in a violation of the Mason
County Resource Lands and Critical Areas Ordinance. The site was inspected by
Michael MacSems of the Mason County Planning Department who determined
on 7/7/22 that any critical area buffer and/or steep slope issues have been
resolved.
Slope setbacks shall be reflagged to 50'. Stream setbacks on Lots 7 and 8 are
flagged 75'buffer. No logging is permitted east of the most western Ns buffer on
Lots 7 and 8. Planner Michael MacSems hung blue and white stripe ribbons at
this line.
Geo-Technical Report/Assessment Review
A Geo-Technical_X Report Assessment(check one) was written by
Envirotech Eng and a submittal checklist was approved as complete by Michael
MacSems of Mason County DCD on 6/17/22.

NOTE: Ground disturbance will not exceed.75 acre and new impervious surfaces
will not exceed S,000 sq ft. In lieu of a Minimum Requirements 1-5 narrative,
stormwater was adequately addresses by Envirotech Engineering as part of the
geo report.

* 1. ARCHAEOLOGICAL RESOURCES
Archaeological or historical resources, such as ruins, sites, buildings, artifacts, fossils, or other objects of antiquity that may
have significance from an historical or scientific standpoint, which may be encountered by the developer/contractor, shall not
be further disturbed. If the developer/contractor encounters any such artifacts, he/she shall immediately stop work and notify
Mason County and the Washington State Department of Archaeology and Historic Preservation. Failure to do so may result
in civil penalties.
* 2. STORM WATER& EROSION CONTROL
Escape of silty water or mud from this property shall be considered a violation of County and State storm water management
regulations and could subject the applicant(s)to civil fines or penalties. The applicant shall follow the requirements, of the
stormwater and erosion control plan written by Enviotech Engineering (Project#22130).

* 3. HOURS OF OPERATION
Noise associated with this application shall not exceed what is allowed under Mason County Code 9.36. Harvest operations
shall start no earlier than 7:00 AM and shall end before 8:00 PM on a daily basis.
* 4. SLASH ABATEMENT
This Forest Practice Application indicates that forest debris resulting from the proposed logging operation may create an
extreme fire hazard under RCW 76.04.600 and WAC 332-24-650.An extreme fire hazard could be created if one or more of
the conditions found in WAC 332-24-650 is located within 100 feet of the running surface of a public road; or is within 500 of
an existing structure and/or designated public use area, which is not owned by the owner of the fire hazard area. The
landowner is fully liable in the event of fire if he or she fails to appropriately abate the hazard. Extreme fire hazards shall be
abated by removing the forest debris, or by other means approved by the Washington State Department of Natural
Resources(DNR).
* 5. STREAM and STEEP SLOP SETBACKS (Modified)
The minimum setbacks from the off-site F-Stream is 150'. Cutting setback from the two on site Ns streams is 75'on each
side. Per an e-mail from Michael Staten of Envirotech Engineering dated 8/24/2022, modifying his original geotechnical
report(Project#22130), trees may be cut in the 50'LSHA buffer provided that stumps are left in place and that two trees are
replanted for every one tree that is cut in the LSHA buffer. The area between the two Ns streams on Lots 7 and 8 cannot be
logged under this permit. Cutting that area will first require a Mason Environmental Permit from Mason County and a
Hydraulics Project Permit from Washington State Fish and Wildlife in order to cross one of the Ns streams.

All provisions of Laws and Ordinances governing this type of work will be complied with whether
specified herein or not. The granting of a permit does not presume to give authority to violate or cancel
the provisions of any other state/local law regulating construction or the performance of construction.

Dear Mr. Kadoun,
This letter is to acknowledge that the Mason County Planning Department has received
the application for your Class IV G FPA(FPA 2022-00007)on the above referenced
parcels. Unfortunately,the application submittal was incomplete, and I won't be able to
review this project until it is complete.
Here is a list of required items:
Needs a site map that contains the information required by MCC 11.05.120 (can be found
on page 3 of the FPA application).
Needs a SEPA Environmental Checklist(cost$1,100)
Needs a geological assessment or geotechnical report(review fee$300)
Needs some level of stormwater and erosion control review. If you are disturbing no
more than.75 acres of ground and creating no more than 5,000 square feet of new
impervious surface,you can submit a Minimum Requirements 1-5 narrative. Beyond that,
an engineered stormwater plan is required(review fee$300).
Need the DOR Tax Number
The County can not begin the formal review of this FPA until the submittal is considered
complete. When the above item(s)have been submitted I can make a Finding of
Completeness,which will start a 120-day review clock(though it will not necessarily
take that long) as, specified under Mason County Title 15 (15'.09.100). The review clock
does not start until the application is deemed complete. This letter should not be
construed to mean that no other information will be required prior to approval. These are
just the basic elements needed to accept this as a complete application. Also,for your
information,per 15.05.040.C,you have up to 180 days to provide the items requested in
this letter. Failure to provide the required material with in 180 days will result in the
closing of this case.

Per Mason County Ordinance 11.05, Section 11.05.120,a site map shall accompany this application which includes the

NOTE: Copies of all FPA Applications will be forwarded to Mason County Public Works for stormwater and erosion
control review. Projects which disturb more than one acre(regardless of total lot size)will require an engineered
stormwater plan consistent with the Mason County Stormwater Ordinance(Chapter 14.48.)and the 2012 WSDOE
Stormwater Manual. Applicants will be charged for Public Works staff time to review these plans and applications.
Property owners should also be aware that the Washington State Department of Ecology(WSDOE)might ask for a
NPDES(National Pollution Discharge Elimination System)Permit. The threshold for such a permit is equivalent to
Mason County's threshold. WSDOE will notify applicants through SEPA review if a NPDES is required.An NPDES is
not a perquisite for FPA approval. It is the responsibility of the applicant to obtain this permit when required.
