Dear Mr. Fontanini,
This letter is in response to your Initial Review Questionnaire
(IRQ) . You should be aware that all development applications are
subject to an order of invalidity issued by the Western
Washington Growth Management Hearings Board, effective January
14 , 1999 . The effect of this order is that Mason County will not
be able to issue some types of permits until the invalidity is
removed. Enclosed is a pubic notice that explains the situation
in more detail .
You are proposing to convert an existing building into a laundry
mat and internet cafe. According to the Mason County
Comprehensive Plan your facility is located in a portion of the
county that has been designated as a Rural Area. According to the
recently invalidated Mason County land use matrix (Development
Regulations figure 1 . 03 . 020) these uses would be classified as
non-conforming land uses . However, these use would be considered
conforming (as either a "cottage industry" or a "home
occupation" ) if it were on the same parcel as your home (as you
are proposing in this case) .
Further more, section 1 . 05 . 018 A 2 of the Development Regulations
allows the change of use of a otherwise non-conforming use if it
is of equal or lesser intensity than the previous use.
If you choose to proceed with your proposal , your next step will
be to schedule a Pre-Application meeting. At this meeting you
will meet with representatives of the various county departments
who can explain any applicable regulations that your project will
be subject too. If you have further questions please call me at
